Twin Home Duplex Conversion
To provide in Kaysville City for increased flexibility and land utilization in single-family residential development where buildings are designed for two-family occupancy, and the building and lot are divided into two (2) legal ownerships having a common side yard, often called a zero lot line, and designated a twin home in this Title. Also to establish notification procedures to protect the tenants when an existing duplex is to be converted to a twin home.
Twin home and duplex conversion applies to the R-1, R-D, R-2, R-4 and R-M zones. Regulations contained herein do not change regulations of the existing zone districts (as contained in KCC 17-8 through KCC 17-22), but are established in addition. Twin homes as allowed by this Chapter shall be conditional uses and review and approval shall follow procedures established by KCC 17-30, Conditional Uses.
The following tenant notification procedure shall be required.
1.
A four (4) month notification of tenants.
2.
Tenant may terminate lease without penalty.
In conversions to twin homes or new twin home construction, buildings must be brought up to the current International Residential Code which includes but is not limited to:
1.
An inspection by the City Building Inspector to determine the condition of the structure.
2.
Separate utility meters for each unit.
3.
Separate utility connections and shut-offs for each unit.
4.
A one-hour fire wall between units.
1.
No building shall exceed thirty feet (30') in height, except as provided in KCC 17-25-2.
2.
No accessory building shall exceed fifteen feet (15') in height, except as provided in KCC 17-25-2 and KCC 17-31-2.
3.
No main building shall be less than ten feet (10') in height, and no accessory building less than six feet (6') in height.
1.
Twin homes shall provide usable functional open space excluding planting strips, for outdoor leisure, of at least eight hundred (800) square feet per unit.
2.
Twin homes shall provide enclosed storage space of at least twenty (20) cubic feet for each dwelling unit.
The following minimum requirements shall be met:
1.
The lot area shall be not less than four thousand (4,000) square feet for any dwelling unit, or one-half (1/2) of the zone requirement, whichever is the greater.
2.
Only one (1) side yard is required per dwelling unit. The side yard shall not be less than eight feet (8').
3.
The minimum width of any lot for a twin home shall be thirty-two feet (32') or one-half (1/2) of the zone requirement, whichever is greater, at a distance thirty feet (30') back from the front lot line.
4.
The front yard for any building shall be as required in the zone district.
5.
On corner lots, the yards which abut a street shall be not less than twenty feet (20') from the street for both main and accessory buildings.
6.
The minimum rear yard for any main building shall be fifteen feet (15'). Buildings housing farm animals shall not be closer than fifty feet (50') to a dwelling on adjacent property.
