ADMINISTRATIVE MECHANISMS
(a)
There shall be a City of Keystone Heights Local Land Planning Agency (L.P.A.) in accordance with F.S. § 163.3174.
(b)
The L.P.A. shall consist of five members appointed by the Keystone Heights City Council for three-year terms. Members shall be Keystone Heights city residents and shall serve at the pleasure of the city council.
(c)
Agency members shall be appointed for staggered terms, but may continue to serve until their successors have been appointed.
(d)
Members may be appointed to successive terms without limitation.
(e)
The administrator shall be an ex-officio, non-voting member of the L.P.A.
(f)
Members may be removed by the council at any time for failure to attend two of three consecutive meetings without cause and prior approval of the chairman, or for any other good cause related to performance of duty. Upon request of the member proposed for removal, the council shall hold a public meeting on the removal before it becomes effective.
(g)
Appointments to fill any vacancy shall be for the remainder of the unexpired term of office.
(a)
The L.P.A. shall establish a regular meeting schedule and shall meet frequently enough that it can take action in conformance with section 17-52.
(b)
The L.P.A. shall conduct its meetings in accordance with quasi-judicial procedures set forth in articles IV, V, and VI only when hearing and deciding applications for zoning variances and special exceptions.
(c)
Minutes shall be kept of all L.P.A. proceedings.
(d)
All L.P.A. meetings shall be open to the public and whenever feasible the agenda shall be made available in advance of the meeting.
(a)
A majority of the L.P.A. membership (excluding vacant seats) shall constitute a quorum. A quorum is necessary for the agency to take action except that, approval or denial of an application for zoning variance or special use exception shall require three votes.
(b)
All actions of the agency shall be taken by majority vote, a quorum being present.
(c)
A roll call vote may be taken upon the request of any member.
(a)
At its first meeting in January of each year, the agency shall, by majority vote of its membership, elect one of its members to serve as chairman and to preside over the agency's meetings and one member to serve as vice-chairman. The people so designated shall serve for a one year term.
(b)
The chairman and vice-chairman shall take part in all deliberations and vote on all issues.
(c)
The chairman or any member temporarily acting as chairman or the city clerk may administer oaths.
(d)
The chairman may compel the attendance of witnesses by subpoena.
(a)
In accordance with F.S. § 163.3174 the L.P.A. shall:
(1)
Be responsible for the preparation of the comprehensive plan for the City of Keystone Heights.
(2)
Make recommendations to the city council regarding adoption of plan or element or portion thereof.
(3)
Monitor and oversee the effectiveness and status of the comprehensive plan and recommend to the city council such changes as may from time to time be required, including preparation of the periodic reports required by F.S. § 163.3191.
(4)
Review proposed development regulations, codes or amendments thereto and make recommendations to the city council.
(b)
The L.P.A. shall review and make recommendation to the city council on any proposed annexations, zoning map changes or conditional uses.
(c)
The L.P.A. shall also perform any other duties assigned by the council.
(d)
The L.P.A. may adopt rules and regulations governing its procedures and operations not inconsistent with the provisions of this chapter.
(e)
The L.P.A. shall hear and decide:
(1)
Appeals from any order, decision, requirement or interpretation made by the administrator.
(2)
Applications for special exceptions as provided in Section 17-44.
(3)
Applications for variances as provided in Section 17-65.
(4)
Questions involving interpretations of permissible uses and the zoning map including disputed district boundary lines and lot lines, as provided in Section 17-66.
(5)
Any other matter the L.P.A. is required to act upon by any other city ordinance.
Except as otherwise specifically provided, the city council may by vote assign primary responsibility for administering and enforcing all or portions of this chapter from time to time to one or more individuals. The person or persons to whom these functions are assigned shall be referred to as "administrator".
