The following key shall be utilized in this article to indicate permitted, conditional, special exception and prohibited uses:

The city has an inclusive ordinance as far as uses listed in section 198-207, in that if the use is not a listed use in the tables but is very similar to a like use listed then it would be an allowed use. Uses similar to but have unique qualities may need to be addressed as a text amendment subject to the governing board's approval.

| (1) | A pool shall be enclosed by a fence, at least four feet in height above grade level. The exterior walls of a house or building may be incorporated as a portion of such fence to create a fully enclosed area around the pool. All fence openings or points of entry into any pool shall be equipped with gates. Gates shall be equipped with self-closing and self-latching devices for keeping the gate or door securely closed at all times. The fence or gate shall be void of any holes or openings larger than four inches in one dimension. Above ground pools having side walls at least 48" do not have to meet this requirement as long as the pool has a removable ladder. If decks are built around the above ground pool or an area is dug out for the pool these requirements may apply to maintain the 48" height requirement. | |||||||||||||||
| (2) | If located in a rear yard, the pool shall not be located closer than ten feet from the property line, or 25 feet from any side street right-of-way. If located in a side yard, the pool and surrounding fence shall meet the setback requirements of the particular zoning district. Swimming pools shall not be allowed in any front yard. | |||||||||||||||
| (3) | Prior to construction, any construction plans for pools shall be reviewed and a building permit issued by the building inspection department. | |||||||||||||||
| (4) | Any lights around the pool shall not shine directly onto adjacent lots. | |||||||||||||||
| (5) | Swimming pools, existing on April 1, 1991, shall be fenced in accordance with these regulations within two years of the effective date. All pool surround fencing shall be continuously maintained. | |||||||||||||||

| (6) | All driveways and parking areas shall be dust-free and may be located within the 50-foot setback requirement, but in no case closer than 20 feet. However, any parking areas shall be screened from any adjacent lots zoned or used for residential purposes. | |||||||||||||||

| (1) | A pool shall be enclosed by a fence, at least four feet in height above grade level. The exterior walls of a house or building may be incorporated as a portion of such fence to create a fully enclosed area around the pool. All fence openings or points of entry into any pool shall be equipped with gates. Gates shall be equipped with self-closing and self-latching devices for keeping the gate or door securely closed at all times. The fence or gate shall be void of any holes or openings larger than four inches in one dimension. Above ground pools having side walls at least 48" do not have to meet this requirement as long as the pool has a removable ladder. If decks are built around the above ground pool or an area is dug out for the pool these requirements may apply to maintain the 48" height requirement. | |||||||||||||||
| (2) | If located in a rear yard, the pool shall not be located closer than ten feet from the property line, or 25 feet from any side street right-of-way. If located in a side yard, the pool and surrounding fence shall meet the setback requirements of the particular zoning district. Swimming pools shall not be allowed in any front yard. | |||||||||||||||
| (3) | Prior to construction, any construction plans for pools shall be reviewed and a building permit issued by the building inspection department. | |||||||||||||||
| (4) | Any lights around the pool shall not shine directly onto adjacent lots. | |||||||||||||||
| (5) | Swimming pools, existing on April 1, 1991, shall be fenced in accordance with these regulations within two years of the effective date. All pool surround fencing shall be continuously maintained. | |||||||||||||||

| (1) | This type of operation shall be operated on a profit or nonprofit basis. | |||||||||||||||
| (2) | The pool or any accessory uses such as deck, bathhouse, and clubhouse shall not be located any closer than 50 feet from any front, rear, or side line of residentially zoned or used property. | |||||||||||||||
| (3) | The front yard may contain any portion of a bathhouse, clubhouse, parking or other accessory use. | |||||||||||||||
| (4) | A protective fence no less than six feet in height shall be erected around the pool. During hours when the facility is not used, all gates shall be locked. This fence shall not extend into the required side setback yard area. | |||||||||||||||

| (6) | All driveways and parking areas shall be dust-free and may be located within the 50-foot setback requirement, but in no case closer than 20 feet. However, any parking areas shall be screened from any adjacent lots zoned or used for residential purposes. | |||||||||||||||
| (7) | Prior to construction, all construction plans for buildings and pool shall be reviewed and a building permit issued by the building inspection department. | |||||||||||||||
