CHAPTER 20

04 - INTRODUCTION

20.04.005 - Temporary moratorium on solar energy systems and wind energy systems.

A.

Moratorium. No solar energy system or wind energy system shall be approved, sited, placed, constructed, installed, modified, or expanded within the village, and no application for a conditional use, building, administrative, or other permit concerning a solar energy system or wind energy system shall be accepted, considered, or granted by the village. A "solar energy system" has the meaning given in s. 13.48(2)(h)1.g., Wis. Stats. A "wind energy system" means any wind generation or conversion system which converts wind energy into electricity through the use of a wind turbine generator, and includes any turbine, blade, tower, base, pad transformer, electrical connections, and supporting structures.

B.

Effective Dates. This moratorium shall apply to all requests, applications or petitions which have not been filed with the village clerk before the date this provision became effective, and shall remain in effect through July 31, 2014, unless earlier rescinded by the village board.

C.

Waiver. Any person aggrieved by this moratorium may seek a waiver by filing with the village clerk a written request which includes the names of the petitioners, owners, description of the subject property, the relief sought, and the reason for seeking relief. The village board may grant relief or a waiver upon a finding of hardship, on conditions it deems just and necessary. If a waiver is granted, the landowner must comply with all other village ordinances and requirements. Petitioners dissatisfied with the decision of the village board may appeal in accordance with Wis. Stat., Ch. 68.

20.04.010 - Authority.

These regulations are adopted under the authority granted by Sections 61.35 and 62.23(7) of the Wisconsin Statutes.

20.04.020 - Purpose.

The purpose of this title is to promote the health, safety, morals, prosperity, aesthetics, and general welfare of the village by: regulating the use of all structures, lands and waters; regulating lot coverage, population distribution and density, and the size and location of all structures so as to: lessen congestion in and promote the safety and efficiency of the streets and highways; secure safety from fire, flooding, and other dangers; provide adequate light, air, sanitation, and drainage; prevent overcrowding; facilitate the adequate provision of public facilities and utilities; stabilize and protect property values; further the appropriate use of land and conservation of natural resources, preserve and promote the beauty and unique character of the community; and implement the village master plan.

20.04.030 - Interpretation.

In their interpretation and application, the provisions of this title shall be held to be minimum requirements and shall be liberally construed in favor of the village and shall not be deemed a limitation or repeal of any other power granted by the Wisconsin Statutes.

20.04.040 - Title.

The ordinance codified in this title shall be known as, referred to, or cited as the "Zoning ordinance, village of Kohler, Wisconsin."
