TEMPORARY STRUCTURES
The intent of this Article is to provide for the regulation of temporary structures. These regulations shall apply to temporary residences, temporary construction offices and temporary signs. For the purposes of this Article, the term temporary shall mean a period of up to 12 months.

Prior to the establishment and use of a temporary structure, the procedure set forth below shall be followed:
(1)
The applicant shall submit a plot plan, showing the location of the structure, setbacks, conformance with all applicable zoning requirements of the district in which the structure is to be located and any other pertinent information, to the Town Planner for review.
(2)
Upon favorable review by the Town Planner, the applicant may obtain a permit for the requested structure through the Building Department.
(3)
The permit granted by the Building Department shall expire six months from the date of issuance.
(4)
All written requests for renewal shall be submitted to the Building Department a minimum of ten working days prior to the expiration date.
(5)
Prior to the issuance of the permit by the Building Department, the applicant shall post the appropriate bond with the Town.
(6)
The applicant shall meet any additional requirements necessary for the health, safety and welfare of the residents of the surrounding area.

(a)
Temporary residence. Upon obtaining a building permit for a permanent residence and posting a bond in the amount of $2,000.00, a permit for utilizing a temporary structure on the premises for temporary living quarters by the property owner may be obtained in the A, E, R-1, R-2, R-3 and PD Districts.
(b)
Temporary construction office. A temporary structure for the storage of construction materials and a construction office to be used for managing a construction job may be utilized in all districts with the following restrictions:
(1)
The unit shall be used only during normal construction hours by the construction superintendent, construction workers, contractor, etc.
(2)
While construction is occurring, a temporary construction office may be utilized, provided that it is located within the area of a recorded final plat or an approved site plan.
(3)
The temporary construction office shall not be utilized as living quarters for a caretaker, property owner, contractor or others.
(c)
Temporary offices.
(1)
Residential sales. Temporary residential sales offices for the sale of units in an area shall be permitted in the PD district, with the following restrictions:
a.
Sales shall be limited only to those units within the platted subdivision in which the office is located.
b.
The temporary structure shall be located within the area of a recorded final plat.
c.
The use of a temporary residential sales office shall require the posting of a bond and obtaining a temporary permit with the Building Department.
d.
Sales offices within model homes shall meet the five conditions outlined by Building Department regulations.
(2)
Commercial, business and industrial offices. Temporary nonresidential offices used for sales or business operation purposes shall be permitted in the B, C, I and nonresidential PD Districts, with the following restrictions:
a.
Upon obtaining a building permit for a permanent nonresidential structure and posting a bond in the amount of $5,000.00, a permit for utilizing a temporary structure on the premises by the property owner or representative may be obtained.
b.
The temporary office shall be located within the area of a recorded final plat and an approved site plan.

Temporary signs. All temporary signs shall comply with Article 15 of this Chapter.
