Sec. 66-101.- Adopted.

(a)

For the purpose of this chapter, the jurisdiction is hereby divided into zones or districts as shown on the official zoning map of the town, which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be a part of this chapter.

(b)

The official zoning map shall be the "digital maps" maintained by the town planning and inspections department. The official zoning map shall be authenticated by the director of planning and inspections. Changes to the official zoning map other than those authorized by duly approved amendments shall be prohibited.

(c)

The official zoning map shall be located in the town hall and shall be the final authority as to the current zoning status of land and water areas, buildings and other structures in the zoning jurisdiction of the town.

Sec. 66-102. - Changes.

If changes are made in the zoning district boundaries or other matter shown on the map, such changes shall be made with an entry on the official zoning map, briefly describing the changes and the date of the changes.

Sec. 66-103. - Replacement.

If the official zoning map becomes damaged, destroyed, lost or difficult to interpret, the town council may, by ordinance, adopt a new official zoning map, which shall be the same in every detail as the map it supersedes.

Sec. 66-104. - Determination of exact location of zoning district boundary lines.

The code enforcement officer shall decide the exact location of zoning district boundary lines when a question arises concerning boundary lines shown on zoning maps, subject to administrative review by the board of adjustment as provided for in section 66-67.

Sec. 66-105. - Maintenance of revisions.

The director of planning and inspections or their designee shall be responsible for the maintenance of the revisions of the official zoning map. Upon notification by the town council that a zoning change has been made, the director of planning and inspections or their designee shall make the necessary changes on the official zoning map within 24 hours following such notification. The department of planning and inspections shall maintain a digital copy of each revision available for inspection by the public.

Sec. 66-106. - Rules for interpretation of zoning district boundaries.

Where uncertainty exists with respect to the boundaries of any of the districts as shown on the official zoning map, the following rules shall apply:

(1)

Boundaries indicated as approximately following the centerline of streets, highways, alleys or railroads shall be construed to follow such centerline;

(2)

Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines;

(3)

Boundaries indicated as following shorelines shall be construed to follow such shorelines, and in the event of a change in the shoreline, such boundaries shall be construed as moving with the actual shoreline. Boundaries indicated as approximately following the centerline of streams, rivers, canals, lakes or other bodies of water shall be construed to follow such centerline;

(4)

Boundaries indicated as parallel to, or extensions of, features indicated in subsections (1)—(3) of this section shall be so construed. Distances not specifically indicated on the official zoning map shall be determined by the scale of the map;

(5)

Where physical or cultural features existing on the ground are at variance with those shown on the official zoning map, or in circumstances not covered by subsections (1)—(4) of this section, the town council shall interpret the district boundaries;

(6)

Where a district boundary line divides a lot which was in single ownership at the time of passage of the ordinance from which this chapter is derived, the town may permit the extension of the regulations for either portion of the lot. In addition, the remaining parcel shall not be less than the minimum required for the district in which it is located.
