CHAPTER 1262

OFF-STREET PARKING AND LOADING

§ 1262.01 PURPOSE.

   The off-street parking and loading requirements of this chapter promote the general convenience, welfare and prosperity of the community. More specific purposes are:
   (a)   To relieve congestion on streets, so that they can be utilized more fully for movement of traffic;
   (b)   To promote the safety and convenience of pedestrians and shoppers by distributing car movements in the vicinity of intense car concentration;
   (c)   To protect residences from vehicular traffic congestion in adjacent business and other places of intense car concentration;
   (d)   To promote the prosperity of present and future business developments, which depend upon provisions for such conveniences; and
   (e)   To protect residents and pedestrians from the hazards created by use of the streets for parking in areas where an excessive number of vehicles are to be parked.

§ 1262.03 SCOPE OF APPLICATION.

   (a)   New and expanded uses.
      (1)   The off-street parking and loading requirements of this chapter shall apply to any application for a permit for the erection of a new structure, or for the establishment of a new use in an existing building, or for the alteration, addition, or expansion to an existing use that would necessitate more than a 10% increase to the existing parking. The requirements of this chapter shall apply only to such new and expanded uses, alterations, and changes of use and shall not apply to existing use conditions.
      (2)   If any of the modifications in § 1262.03(a)(1) occur and the existing parking or loading stalls exceed the requirements of this chapter, the parking stall quantity in excess of the minimum requirements may be applied to future modifications where applicable.
   (b)   Existing uses. The off-street parking and loading requirements of this chapter shall not apply to buildings and land uses legally in existence on the effective date of this Code, provided that any parking or loading facilities now serving such buildings or uses shall not in the future be reduced below these requirements.
   (c)   Parking and storage of vehicles. See Chapter 1270, Accessory Uses and Structures.

§ 1262.05 PLAN REVIEW.

For any off-street parking area required under this chapter, and for any other proposed parking area for five or more vehicles, a plan shall be submitted with the application for a zoning certificate to the Village Code Enforcement Officer to review for compliance with these regulations and for any other applicable regulations. Any such parking plan shall show the following:
   (a)   The number of parking stalls;
   (b)   The arrangement of parking aisles;
   (c)   The location of driveway entrances;
   (d)   Provisions for vehicular and pedestrian circulation;
   (e)   The location of sidewalks, lighting and curbs on or adjacent to the property;
   (f)   The location of utilities, barriers, shelters, and signs;
   (g)   The location of landscaped areas and the types and location of vegetation to be planted in them;
   (h)   Typical cross sections of pavement, storm water drainage facilities; and
   (i)   Any other relevant information requested by the village.

§ 1262.07 REQUIRED OFF-STREET PARKING STALLS.

Except as otherwise provided in this section, the quantity of off-street parking stalls for each newly established principal use on a parcel shall be provided according to the units of measurement indicated for that use in Schedule 1262.07 Off-Street Parking Stall Requirements.
   (a)   Computation of required stalls. The following provision shall govern the computation of the number of off-street parking stalls required.
      (1)   When the calculation of minimum required parking stalls for a particular use results in a fractional number, the number shall be rounded up to the next consecutive whole number.
      (2)   In any places of assembly in which the seats in the auditorium or assembly area consist of benches, pews or other similar seating facilities, and the number of seats are a factor in the calculation of the minimum required parking stalls, each 20 inches of such seating facilities shall be counted as one seat for the purpose of determining the minimum number of required parking stalls.
      (3)   When parking stall requirements are calculated on the number of faculty, staff, students or employees, the maximum number likely to be present at any one time shall govern.
      (4)   For uses not expressly listed in Schedule 1262.07 Off-Street Parking Stall Requirements, parking stalls shall be provided on the same basis as required for the most similar use as determined by the Village Council pursuant to Chapter 1276.
   (b)   Reduction in minimum required parking stalls. In the event that the number of parking stalls required in the Schedule of Off-Street Parking Stall Requirements for a proposed use cannot be placed on the parcel in accordance with these regulations without the demolition of an existing structure or elimination of required landscaping to accommodate a parking area, the Planning Commission may authorize up to a 20 percent reduction in the total number of parking stalls required on the lot. The Planning Commission may issue such an authorization only upon the request of the applicant and only upon determining that the reduction in the number of required parking stalls will not unreasonably increase parking congestion along public streets or in parking areas located on nearby lots. After such authorization is granted, the applicant shall not expand or replace the existing structure unless the full required amount of off-street parking is provided on the lot.
   (c)   Spaces for the handicapped. Handicapped-accessible parking stalls shall be provided in accordance with the provisions of the
Ohio Building Code and may be counted as part of the minimum parking stall requirements of this chapter.
   (d)   Shared parking. Joint use of up to 50 percent of required parking stalls may be permitted for two or more uses located on the same parcel or adjacent parcels provided that the applicant can demonstrate to the village that the uses will not substantially overlap in hours of operation or in demand for the shared stalls. This shall be guaranteed by a written agreement from the owner or between the owners involved and all future owners or assigns which shall be submitted with the required plan. Shared parking stalls shall be located no more than 300 feet from the uses they are intended to serve.

One stall per dwelling unit.

Agricultural
   General Farming
In addition to the requirements for a single-family structure if one exists on the site, one stall per two staff.
   Agriculture with Retail Sales
In addition to the requirements for another principal use if one exists on the site, one stall per every 400 s.f. of greenhouse or sales floor area and four stalls per acre of agricultural land.

Type-A Family Daycare
One stall per employee, plus one stall for drop-off and pick-up for every eight individuals enrolled.

Technical, Trade, and other Specialty School
One stall per employee plus one stall per two registered student capacity or one stall per every three seats in auditorium, whichever is greater.
Government Administrative Facility
Four stalls per 1,000 square feet gross floor area.
Public Utilities Facility
One stall for service vehicle; any additional structure area used for occupancy by persons shall be calculated according to the requirements for professional offices.
Waste Transfer Facility
One space per employee, plus four spaces per acre, plus one space for every operative facility vehicle stored on the lot which is used in the conduct of the business but not to include salvage vehicles in inventory.
Public or Government-Owned Parking Facility
No additional parking requirements.

No additional parking requirements.
Funeral Home
One stall per four seats in parlor plus one stall per two employees plus one stall per facility vehicle.
Crematory
One stall per employee plus one stall for every facility vehicle.

Parks and Recreation
One space per 15,000 square feet of lot area plus one stall per every five seats in a theater, amphitheater, arena, or other stadium- or auditorium-style seating, and one stall per every 1,000 square feet of gross floor area for indoor facilities, where applicable.
Undeveloped Open Space and Conservation Area
No additional parking requirements.
Performing Arts Establishment
One stall per every five seats in a theater, amphitheater, arena, or other stadium- or auditorium-style seating.
Motion Picture Theater
One stall per every five seats in a theater, amphitheater, arena, or other stadium- or auditorium-style seating.
Museum, Historical, or Archaeological Institution
One stall per every 500 s.f. of gross floor area.
Botanical Garden, Arboretum
One stall per every 400 s.f. of greenhouse or accessory retail floor area and four stalls per acre of agricultural land.
Games Arcade
One stall per every 250 s.f. of floor area.

One stall per every 750 square feet of gross floor area.
Research and Development Facility
One stall per every 750 square feet of gross floor area.

One stall per every guest room.

Four stalls per 1,000 feet of gross floor area.

Two stalls per every service bay or one stall per every 250 square feet of gross floor area, whichever is greater.

Fuel Station
No additional parking requirements. See parking requirements for use occurring in conjunction with fuel sales. Designated vehicle area adjacent to fuel pump is not a parking stall.
Car Wash
Each facility must provide sufficient queue area in advance of the car wash area to accommodate two vehicles in advance of a self-service bay or six vehicles in advance of an automatic service bay.
Hardware Store, Building Materials Supply and Small Equipment Sales and Leasing
One stall space per 400 square feet of gross floor area for retail display and sales, plus one stall space per 1000 square feet of gross warehouse and shop floor area, plus one stall space for every facility vehicle stored on the lot.
Lawn and Garden Supply, Commercial Greenhouse or Nursery
Four stalls per 1,000 square feet of gross indoor sales floor area, plus one stall per 1,000 square feet of greenhouse or net outdoor sales and customer display area, plus one stall per every 1.5 employees, plus one stall for every facility vehicle stored on the lot.
Art Gallery
One stall per every 500 s.f. of gross floor area.
Animal Hospital, Veterinary Clinic, Kennel, or Pet Daycare (wholly within enclosed structures)
One stall space per employee, plus one stall space per 100 square feet of client waiting room floor area plus one stall space per exam room and one stall space per 500 s.f. of kennel or dog run area.
INDUSTRIAL
Light Manufacturing
One stall per every 1,000 s.f. of gross floor area.

Heavy-Impact Manufacturing
One stall per every 1,000 s.f. of gross floor area.
Contractor's Storage
One stall per every 1,000 s.f. of gross floor area.
Industrial Machinery and Heavy Equipment Rental and Leasing
One stall space for every rentable vehicle or piece of equipment plus one stall for every two employees.
Oil and Gas Storage
One stall per every 1,000 s.f. of gross floor area.

§ 1262.09 LOCATION OF REQUIRED PARKING STALLS.

   Except as specifically provided in Schedule 1262.07 Off-Street Parking Stall Requirements above, parking stalls required by this chapter shall be located on the same zoning lot as the use to which they are accessory, except where these regulations allow shared parking between uses on different lots pursuant to § 1262.07(d).

§ 1262.11 LIMITATION ON USE OF OFF-STREET PARKING AREAS.

   (a)   No off-street parking area, lot, or garage shall be used for any purpose other than the parking of motor vehicles related to the premises. The sale or repair of vehicles within required parking areas is prohibited. The storage of merchandise within required parking areas is prohibited without a temporary use permit pursuant to Chapter 1272, Temporary Uses.
   (b)   Storage of vehicles in parking areas is prohibited as described in § 1270.09(f)(2)(B).
   (c)   Trucks parked in a front yard in the Residential or RO Districts shall not be larger than one ton gross vehicle weight.
   (d)   Trucks bearing a business name or logo shall not park for more than 24 hours in the front yard in the Commercial or R-O-C Districts.

§ 1262.13 DESIGN AND MAINTENANCE.

   (a)   Parking stalls. Each designated parking stall shall meet the minimum dimensional requirements set out in Figure 1262.13-A, the Schedule of Parking Stall and Aisle Dimensions, which is illustrated in Figure 1262.13-A.
   (b)   Handicapped parking stalls. The dimension of parking stalls serving handicapped persons shall conform to the requirements of the Ohio Building Code.
   (c)   Aisles.   Each required parking stall shall have direct and unrestricted access to an aisle of the minimum width set out in Figure 1262.13-A, the Schedule of Parking Stall and Aisle Dimensions, which is illustrated in Figure 1262.13-A, the Parking Stall and Aisle Layout Diagram following the Schedule.
   (d)   Access.    All parking stalls shall be accessed only along designated parking stall aisles arranged perpendicular to access drives wherever possible. No parking shall be permitted along entry drives within 30 feet of the right-of-way or easement line and at greater distances as may be required by the village depending on the traffic generation and parking lot size.
   (e)   Maneuverability areas. In order to promote adequate maneuverability, the following provisions shall be followed:
      (1)   Turn-around area. Where more than three parking stalls are served by a single driveway, a turnaround area shall be provided, or other provision shall be made, to permit cars to exit the parking lot or garage without backing onto any street or sidewalk.
      (2)   Back-up area. Each parking stall shall be provided with a sufficient back-up area to permit egress in one maneuver, consisting of one backward and one forward movement.
   (f)   Surface and drainage.
      (1)   Standard paving surface. Every off-street parking lot shall be surfaced with an asphaltic or portland cement binder pavement providing an all-weather, durable, and dustless surface.
         A.   Individual stalls shall be graded to drain so as to dispose of all surface water within the parking area.
         B.   No surface water from parking areas shall accumulate or drain over a public sidewalk.
      (2)   Alternative surface – pervious paving. The Planning Commission may authorize all or a portion of required off-street parking spaces (not to include drive aisles) to be provided on permeable/porous surfaces, subject to the following criteria.
         A.   The findings of the Planning Commission shall indicate what number or percentage of required parking spaces may be so provided.
         B.   The permeable/porous surface material shall meet the approval of Planning Commission.
         C.   Parking spaces, aisles, etc. shall be marked by flags, biodegradable dyes or paints, or some other method that does not kill grass or plants.
         D.   Permeable/porous surfaces shall be adequately drained.
         E.   Permeable/porous parking areas shall be maintained by the property owner for their intended function for the duration of its life.
   (g)   Outdoor lighting. Fixed lighting shall comply with the provisions contained in § 1270.09(i), Outdoor Lighting .
   (h)   Landscaping. Landscaping in parking areas shall be provided as required by § 1266.13, Off-Street Parking Area Landscaping.
   (i)   Markings. Individual parking stalls on lots shall be denoted by solid painted lines.
   (j)   Barriers. Parking lots and access drives shall be surrounded by continuous curbs. Continuous curbs shall be made of asphalt, concrete, or stone, and shall be six inches in height and six inches in depth.

§ 1262.15 OFF-STREET LOADING REQUIREMENTS.

   (a)   Scope of application. 
      (1)   Subject to the limitations of this section, off-street loading is permitted as an accessory use in all districts.
      (2)   The application of the loading regulations established by this section shall be limited to the same scope as defined in § 1262.03 of this chapter.
      (3)   Nothing herein shall be construed to limit the right of any person to provide off-street loading in excess of the requirements herein established.
      (4)   Any loading occurring in connection with any non-residential use must be provided for on the same lot upon which the use is located.
      (5)   If commercial or industrial establishments are such that shipping and/or receiving goods are not an integral part of the business, the requirements listed in this section may be waived by the Code Enforcement Officer.
   (b)   General standards. Every loading space shall be designed, constructed, and maintained in accordance with the standards and requirements set forth below.
      (1)   Location of loading spaces. Loading spaces shall:
         A.   Not conflict with or overlap with the area used for parking.
         B.   Be located on the same lot as the building or structure to which they are accessory.
         C.   Not be located in any required front yard, and
         D.   Shall not permit any vehicle to extend into any front yard or across any lot line of a more restrictive district while being loaded or unloaded.
      (2)   Access. Loading spaces shall be designed and arranged to provide access to a street or alley in a manner that will create the least possible interference with traffic movement and parking lot circulation. Access to and from loading spaces shall be approved by the village.
      (3)   Surface and drainage. Every loading space shall meet the surface and drainage requirements of § 1262.13(f).
      (4)   Screening. Except for parcels located within industrial districts, if a loading area is visible from a public street, then Planning Commission may require that all operations, materials, and vehicles within any loading space shall be screened in conformance with Chapter 1266 Landscaping.

§ 1262.17 PARKING IN AND ACCESS FROM ALLEYS AND NARROW STREETS; EXCEPTIONS.

   (a)   Access to residential parking areas, including garages, may be from rear alleys of at least ten feet in width.
   (b)   Access to any nonresidential use parking areas, including garages, may be from rear alleys of at least ten feet in width if approved by the Village Code Enforcement Officer.
