CHAPTER 1250

RESIDENTIAL DISTRICTS

§ 1250.01 PURPOSE.

   (a)   The purpose of R-1 Single-Family Residential Districts is to preserve, protect and encourage the development of areas of detached, single-family dwellings within the municipality.
   (b)   The purpose of R-2 Single-Family Residential Districts is to preserve, protect and encourage the development of single-family residential subdivisions that include lots of medium size within the municipality.
   (c)   The purpose of R-3 Medium Density Residential Districts is to preserve, protect and encourage the development of single-family uses on smaller lots within the municipality.

§ 1250.03 GENERAL PROVISIONS.

   (a)   Off-street parking and loading. All uses and structures in the R Districts shall comply with the off-street parking and loading provisions of Chapter 1262, Off-Street Parking and Loading.
   (b)   Signs. Signs are permitted in the R Districts subject to the requirements of Chapter 1264, Signage.
   (c)   Landscaping. Landscaping and buffer yards may be required in the R Districts per Chapter 1266, Landscaping.
   (d)   Accessory uses and structures. Accessory uses and structures, including but not limited to fences, lighting, off-street parking and storage of vehicles, may be permitted in the R Districts subject to the requirements of Chapter 1270, Accessory Uses and Structures.
   (e)   Temporary uses. Temporary uses may be permitted in the R Districts subject to the requirements of Chapter 1272, Temporary Uses.

§ 1250.05 USE REGULATIONS AND SCHEDULE OF PERMITTED AND CONDITIONAL USES.

   (a)   The land use regulations for the R Residential Districts are set forth in the following Schedule 1250.05.
   (b)   Land uses designated by a P are permitted uses that may be subject to additional regulations imposed by this Code.
   (c)   A P followed by a number indicates that the use is a permitted use as previously described, but is subject to an additional regulation found at the end of the following table under the corresponding number.
   (d)   Land uses designated by a C are conditional uses that are subject to review by the Board of Zoning Appeals, and that may be subject to conditional use approval in accordance with the requirements of Chapter 1280, Appeals, Variances, and Conditional Use Permits.
   (e)   Land uses that are marked with a “—“ or that are not listed in the following table are prohibited within the R Districts.

Additional Limitations
1. Two-Family and Multi-Family dwellings must be legally established prior to the adoption of this Zoning Code. If permitted in a district, the use has the rights of nonconforming uses per Chapter 1278, Nonconforming Uses and Structures, except that it shall not be subject to the limitations in § 1278.03(a), Alteration or Reconstruction of a Structure Occupied by a Nonconforming Use, or § 1278.03(b), Enlargement or Expansion Nonconforming Use of Structures or Land.
2. Home Occupations are only permitted as accessory uses and occupant must first obtain a zoning certificate upon showing fulfillment of the requirements for home occupations in Chapter 1270, Accessory Uses and Structures.

§ 1250.07 SIMILAR USE DETERMINATIONS.

   Residential uses not listed specifically in Schedule 1250.05 may be permitted if approved by Village Council pursuant to Chapter 1276 Similar Use Determinations and are in conformance with all other applicable regulations of this Code.

§ 1250.11 SUPPLEMENTARY USE REGULATIONS.

   (a)   Single- and two-family dwellings.
      (1)   Lots shall have only one principal structure.
   (b)   Parking in Residential Districts. No off-street parking area, maneuvering area for parking spaces, or loading area shall be located within any required front yard. This restriction shall not apply to driveways providing access from the street to the parking area. Drives and maneuvering areas reasonably necessary to serve the use are permitted.
      (1)   Parking spaces accessory to uses other than single or two-family residences shall be located in side or rear yards not less than ten feet from any lot line.
      (2)   No vehicle shall be parked on any unpaved area.
      (3)   Trailers and recreational vehicles are prohibited unless:
         A.   The trailer or recreational vehicle is stored or parked by a resident on a lot owned or leased by him for a period not to exceed any part of two calendar days within a single calendar week; or
         B.   If the trailer or recreational vehicle is stored or parked for a period exceeding two calendar days within a single calendar week, it shall be stored within a wholly enclosed building.
      (4)   When not stored within an enclosed building, trailers and recreational vehicles shall be parked in designated parking areas located in a side or rear yard not less than 50 feet from public rights-of-way and ten feet from any lot line.
   (c)   House garage and yard sales. Garage and yard sales are permitted within the R Residential Districts pursuant to Chapter 820, Garage Sales.
   (d)   Enclosed buildings and permanent outdoor storage and activities.
      (1)   In the R-1, R-2 and R-3 Residential Districts, all storage in conjunction with nonresidential uses shall be contained wholly within enclosed buildings unless a conditional use permit for outdoor storage is obtained pursuant to the requirements of Chapter 1280, Appeals, Variances and Conditional Use Permits.
   (e)   Landscaping and buffer yards.
      (1)   All portions of a lot that are not improved shall be landscaped or maintained in an orderly, natural state.
      (2)   All other requirements of Chapter 1266, Landscaping, pertaining to screening and buffering must also be met.
      (3)   All requirements contained in subsections (1) and (2) hereof must be fully complied with before a certificate of occupancy is issued by the Code Enforcement Officer.
   (f)   Mechanical equipment. All ground level and roof top mechanical equipment for all nonresidential and multi-family uses must be fully screened from view from all public rights-of-way by a parapet wall or other screening structure constructed of the same materials as the principal building façade, or adequate landscaping to the height of such equipment.
   (g)   Refuse control. Refuse containers for all nonresidential and multi-family uses must be covered and shall be stored within completely enclosed buildings or placed in corrals providing screening from public streets and adjoining lots.
