Certain words or terms used herein shall be interpreted or defined as follows:
ACCESSORY BUILDINGA building detached from or subordinate to the principal building on the same lot, and used for purposes customarily incidental to those of the principal building. No accessory building shall be used for habitable space.
ACCESSORY USEA use customarily incidental and subordinate to the principal use conducted on the same lot, whether such accessory use be conducted in a principal or accessory building.
ALTERATIONAs applied to a building or structure, means a change or rearrangement in any part or in the existing facilities; or an enlargement of any dimension of the building; or the moving from one location or position to another. Ordinary repairs shall not be considered alterations.
ALTERNATIVE TREATMENT CENTERA facility that is authorized to dispense medical cannabis and related paraphernalia at retail to registered qualifying patients in accordance with the provisions of the Jake Honig Compassionate Care Medical Cannabis Act, N.J.S.A. 24:61-1 et seq., which shall also be known as, and is defined in the Act as, a "cannabis retailer."

ANIMAL HOSPITALA place where animals or pets are given medical or surgical treatment, or the Boarding of animals limited to short-term care incidental to the hospital use.
ATTICThat part of a building which is immediately below and wholly or partly within the roof framing. This space must stay unfinished and cannot be used for habitable space.
AUTHORIZED RECREATIONAL MARIJUANA RETAIL FACILITYA facility that is authorized by state law and licensed by all agencies having jurisdiction to sell cannabis and related paraphernalia at retail to consumers for recreational purposes, which shall also be known as, and is defined in the Act as, a "cannabis retailer."

AUTOMOBILE REPAIREstablishments primarily engaged in furnishing automotive repair, service, maintenance, body work or painting, but not including a wrecking, salvage or junkyard.
AUTOMOBILE SALESThe use of any building, land area or other premises for the display and sale of automobiles, vans, trucks or recreational vehicles and including as an accessory use warranty repair work and service.
AUTOMOBILE SERVICE STATIONAny building, land area or other premises or portion thereof used primarily or intended to be used for the retail dispensing or sale of vehicular fuels and including as an accessory use minor repairs and the sale and installation of lubricants, tires, batteries and similar accessories.
AUTOMOTIVE SUPPLY STOREA retail store whose primary business is the sale of automobile parts and supplies, with repair bays as an accessory use limited to minor repairs, and the installation of lubricants, tires, batteries and similar accessories.
AWINGA roof-like cover made of canvas or similar material, that projects no more than six feet from the wall of a building for the purpose of shielding a doorway or window from the elements.
BANKA business establishment authorized to perform financial transactions, such as receiving and lending money.
BAR or TAVERNAn establishment used primarily for the serving of liquor by the drink to the general public.
BASE COURSEThe first line of masonry of a structure above the curb level.
BASEMENTA space having 1/2 or more of its floor-to-ceiling height above the average level of the adjoining ground and with a floor-to-ceiling height of not less than six feet eight inches. A basement shall be counted as a story.
BILLBOARDA sign which directs attention to a product, business, service or entertainment conducted, sold or offered elsewhere than upon the lot on which such sign is situated.
BILLBOARD SIGNA sign which directs attention to anything except the business or function offered upon the premises where the sign is located.
BOARDERAn individual other than a member of a family occupying the dwelling unit or a part thereof, who is furnished sleeping accommodations for a fee and may be furnished meals and/or other services as part of the consideration.
BOARDINGHOUSEA dwelling or part thereof in which lodging is provided by the owner or operator to three or more boarders.
BUFFERA continuous area of open space, landscaped area, fences, walls, berms, or any combination thereof used to physically separate one use of the property from another.
BUILDINGAny combination of materials forming any construction with a fixed location on the ground; the word "building" shall include structures, walls, decks, patios, porches, trailers, mobile homes and other similar structures.
BUILDING AREAThe aggregate of the horizontal cross-section area of the building on a lot, including accessory buildings, whether attached or unattached, but excluding cornices, eaves, gutters and chimneys projecting not more than 24 inches, steps, one-story open porches or decks, balconies and terraces and bay windows not extending through more than one story and not projecting more than three feet.
BUILDING HEIGHTThe vertical distance from the average grade of the building corners, to the top of the highest roof beam of a flat roof, or to the mean level of a slop or hip roof.
BUS OR TRUCK DEPOTAny area, lot, parcel, building or structure or part thereof used primarily for the storage of trucks or buses.
BUSINESS SERVICESEstablishments primarily engaged in rendering services to business establishments on a fee or contract basis, such as advertising and mailing, building, plumbing and electrical contracting and maintenance, equipment, car and truck rental and leasing.
CANNABISAll parts of the plant Cannabis saliva L., whether growing or not, the seeds thereof, and every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its seeds, except those containing resin extracted from the plant, which are cultivated and/when applicable, manufactured in accordance with P.L. 2021, c. 16 (N.J.S.A. 24:61-31 et seq.) for use in cannabis products as set forth in the Act, but shall not include the weight of any other ingredient combined with cannabis to prepare topical or oral administrations, food, drink, or other product.

CELLARA story having more than 1/2 of its height, measured from finished floor to finished ceiling, below the average elevation of the finished grade of the ground adjoining the building.
CEMETERYProperty used for interring the dead below ground.
CHEMICAL PLANTSThose establishments which perform chemical or physical changes in the nature and composition of substances, or which store, handle, distribute or use hazardous chemicals as defined in Chapter
290, Hazardous Chemicals (Ord. No. 90-15), as amended. Chemical plants include all producers, distributors, storers of hazardous chemicals or wastes for more than 24 hours, processors, including blending and drying of potentially explosive organic dusts, or users of fertilizers, dyestuffs, liquefied petroleum gas, pharmaceuticals and medical products, explosives, fireworks, ammunition, blasting agents, plastics, vinyl sheeting, resins, adhesives, cosmetics, synthetic rubber, photographic films, synthetic and artificial fibers, detergents, soap, ink except newspapers, paints and organic coatings, pesticides, the multiplicity of inorganic and organic substances classified as miscellaneous chemicals, as well as dyeing and printing of fabric, medical and industrial gases, chemical (household, industrial, medical) solutions, degreasing, screen printing, etching, plating, anodizing, aerosol propellants and includes bulk plants or warehouses for flammable liquids and/or liquefied petroleum gas, ammonia, oxygen and other compressed gases, and bulk plants or warehouses for hazardous chemicals. Excluded from this definition are gasoline stations, auto and truck body shops, and retailers and domestic users of household and automotive chemicals.
CHILD-CARE CENTER or NURSERY SCHOOLAn establishment enrolling four or more children under the age of six years, where tuition fees or other forms of compensation for the care of children is charged, and which is licensed or approved to operate.
CIVIC AND PHILANTHROPIC USEA building or group of buildings designed and constructed for use by civic, charitable, philanthropic, fraternal, trade union, or veterans organizations, but not including any dwelling units or residential facilities.
CLINICA facility for the diagnosis and treatment of outpatients and/or a group practice in which more than one physician work cooperatively.
CLINIC, METHADONEAny facility offering outpatient methadone maintenance services. A methadone clinic shall not be considered to be a professional office, nor shall it be considered as an ancillary or adjunct use to a professional office.
COLLEGE OR UNIVERSITYAn educational institution authorized by the state to award associate's, baccalaureate or higher degrees.
COMMERCIAL RECREATION FACILITYA building or group of buildings used for recreational purposes and operated as a business and open to the public for a fee, including movie theaters, theaters, bowling alleys and skating or roller rinks, but excluding video or amusement arcades.
COMMUNITY COLLEGEAn educational institution authorized by the state to award associate's degrees.
COVERAGE, BUILDINGThe horizontal area measured within the outside of the exterior walls of the ground floor of all principal and accessory buildings on a lot.
DECKAn uncovered structure, usually constructed of wood or other products, extending from the exterior wall of a residential dwelling and shall be counted as lot coverage.
DENSITYThe permitted number of dwelling units per gross area of land to be developed.
DEVELOPMENTThe construction, reconstruction, conversion, structural alteration, relocation or enlargement of any building or any structure.
DRIVE-IN ESTABLISHMENTPremises constructed for the sale of any goods or services by means of curb, window counter, or self-service, whether to the motoring public or to pedestrians.
DRIVE-IN RESTAURANTAn establishment where food is served for immediate consumption outside the confines of a building and where all or part of that consumption occurs outside the confines of the building on premises.
DRIVE-THROUGH BANKA bank where transactions are made to customers within an automobile outside the confines of a building.
DRIVE-THROUGH RESTAURANTAn establishment where food or drink is served for immediate consumption outside the confines of a building to a customer in an automobile, for consumption off the premises.
DWELLINGAny permanent building or portion thereof designed or used exclusively as the residence of one or more persons.
(1) DUPLEXTwo connected one-family dwelling units, side by side, with a party wall having separate garage doors and a partition wall down the center.
(2) DWELLING, ONE-FAMILYA building occupied or intended for occupancy exclusively by one family or one household, provided with cooking, sleeping and sanitary facilities for the exclusive use of the occupants of the unit; also referred to as a "single-family dwelling."
(3) DWELLING, TWO-FAMILYA building occupied or intended for occupancy as separate living quarters for no more than two families or two households, provided with separate cooking, sleeping and sanitary facilities for the exclusive use of the occupants of each unit.
(4) DWELLING, GARDEN APARTMENT, LOW-RISEA group of two or more multifamily dwellings occupying a lot, having a yard or court in common. A building where common wall construction is used, containing not fewer than four nor more than 12 dwelling units and not exceeding three stories.
(6) DWELLING, MULTIFAMILYA building occupied or intended for occupancy as separate living quarters for three or more families or households, provided with separate cooking, sleeping and sanitary facilities for the exclusive use of the occupants of each unit.
(7) DWELLING, TOWNHOUSEA one-family dwelling in a row of units in which each unit has its own front access to the outside, no unit is located over another unit and each unit is separated from any other unit by one or more common fire-resistant walls.
DWELLING UNITOne or more rooms occupied or intended for occupancy as separate living quarters by one family or household, provided that access is directly from the outside or through a common hall and that separate cooking, sleeping and sanitary facilities are provided within the dwelling for the exclusive use of the occupants.
EATING AND DRINKING ESTABLISHMENTSRetail establishments serving prepared food or drink within an enclosed building for immediate consumption within the building or off the premises, including restaurants, lunch counters, ice cream and pizza parlors, delicatessens, luncheonettes, but excluding drive-in or drive-through restaurants, and bars or taverns.
ESSENTIAL SERVICESThe erection, construction, alteration or maintenance, by public utilities or municipal or other government agency, of electrical, gas, water transmission or distribution systems or collection, communication, water supply or sewage treatment and collection systems, including poles, wires, mains, drains, sewers, pipes, conduits, cables, fire alarm boxes, police call boxes, traffic signals, light stanchions, telephone lines, hydrants and other similar equipment and accessories in connection therewith reasonably necessary for the furnishing of adequate services by such public utilities or municipal or other governmental agencies for the public health, safety or general welfare, but not including buildings.
EXTERIOR SALES AND STORAGE AREAAn exterior space adjacent and accessible to a portion of a building leased to a tenant within a minimum of 40,000 square feet of gross leasable area. Such area shall be enclosed by walls and/or fences with a minimum solid area of 15% of its surface and may be partially or totally roofed. The exterior sales and storage area shall be limited to 25% of the tenant's gross leasable area.
FENCEAn artificially constructed barrier of any material or combination of materials erected to enclose or screen areas of land.
FLOOD HAZARD AREAThe rivers or other watercourses and adjacent land areas subject to inundation, as defined by the New Jersey Department of Environmental Protection, in the event of the design flood. These areas include but are not necessarily limited to the floodway and flood-fringe areas as delineated on the Flood Insurance Rate Maps and Flood Boundary Maps prepared by the most current Federal Emergency Management Agency.
FLOODPLAINThe area adjoining the channel of the natural river or stream that has been or may be inundated by floodwater.
FLOOR AREAThe sum of the gross horizontal areas of the several floors of a building, measured from the exterior walls of the building.
FLOOR AREA RATIOThe sum of the area of all floors of buildings or structures compared to the total area of the site.
FLOOR AREA, HABITABLEThe sum of the gross horizontal areas of the several interior floors of that portion or portions of a building intended for regular occupancy by persons, including such rooms as living rooms, dining rooms, kitchens, bathrooms, hallways, foyers and like rooms intended for similar uses, but expressly excluding storage areas, garages, cellars, porches, breezeways, decks, patios, portions of attics having headroom of less than seven feet and like areas.
FREESTANDING SIGN or GROUND SIGNAny sign supported by permanent structures or supports that are placed on or anchored in the ground and that are independent from any building or other structure, but are utilized exclusively to support the business or function offered upon the premises where the sign is located.
FUNERAL PARLOR or MORTUARYA building used for the preparation of the deceased for burial and for the display of the deceased and ceremonies connected therewith before burial or cremation.
GARAGE, PRIVATEA garage used for the storage of vehicles exclusively for the occupants of the principal building to which the garage is accessory and shall not be used for habitable space.
GARAGE, PUBLICA garage which is used for the storage of vehicles and open to the members of the general public.
GARAGE, REPAIRPremises which are used for the repair, greasing, servicing or adjusting of motor vehicles but not for the sale of gasoline or diesel fuel, except as incidental and necessary to a repair.
GARAGED or ENCLOSEDThe storage of vehicles as required herein in such a structure defined to be a garage by this chapter or in such enclosure which completely hides the vehicle from view from any adjacent property when such vehicle is stored or parked in such enclosure, except as may be minimally necessary to gain, and only when gaining, access or egress from such enclosure. Nothing contained within this definition of "garaged or enclosed" is intended to modify, amend or revise any construction or maintenance of any such structure or enclosure.
GARDEN SUPPLY CENTERA retail or wholesale establishment providing plants, trees, flowers and other landscaping and gardening materials primarily to the public.
GOVERNMENT USESEstablishments utilized or occupied by any department, commission, independent agency or instrumentality of the United States, of a state, county, authority, district or other governmental unit.
GRADEA reference plane representing the average of finished ground level adjoining the building at all exterior walls. When the finished ground level slopes away from the exterior walls, the reference plane shall be established by the lowest points within the area between the building and the lot line or, when the lot line is more than six feet from the building, between the building and a point of six feet from the building.
GROSS FLOOR AREAThe sum of the gross horizontal areas of all floors of any building or buildings on a lot measured from the exterior faces of exterior walls. In particular, the floor area shall include any basement or cellar space which has been improved for use and all interior balconies and mezzanines.
GROSS LEASABLE AREAThe total floor area for which a tenant pays rent and which is designed for the tenant's occupancy and exclusive use. Gross leasable area does not include mechanical rooms, employee rooms, internal stairs and storage areas on floors below grade and above the first floor. Gross leasable area does not include exterior sales and storage areas.
HOME OCCUPATIONA customary occupation, excluding a home professional office, and excluding establishments offering services to the general public, carried on in a dwelling by the resident thereof as an accessory use in a residence district. The term shall not include businesses or occupations, such as the operation of a beauty parlor, barbershop, auto repair, servicing or body shop, convalescent or nursing home, insurance and real estate agency, boardinghouse, kennel or stable, massage parlor or similar establishments offering services to the general public. The care of up to three children below the age of six years shall be considered a home occupation.
HOME PROFESSIONAL OFFICEAn occupation within a dwelling unit consisting of the office of a practitioner of a recognized profession, such as doctor, dentist, engineer, accountant, architect or lawyer, if located in the building in which the professional resides, involving no nonresident employees.
HOTELA facility offering transient lodging accommodations to the general public and providing additional services, such as restaurants, meeting rooms or recreation facilities.
HOUSEKEEPING UNITOne or more persons living together in one dwelling unit and sharing living, sleeping and sanitary facilities, and one kitchen, in a domestic relationship based on birth, marriage or other domestic bond, as distinguished from a group occupying a boardinghouse or rooming house, co-op, club, fraternity, hotel or motel.
IMPROVED LOT COVERAGEThe percentage of lot area which is improved with principal and accessory buildings, structures and uses, and including but not limited to driveways, tennis courts, swimming pools, parking areas, garages, walkways, patios, decks, loading areas, hard surfaces or other man-made improvements. Detention or retention basins shall be excluded from such calculations, provided the same are constructed of natural materials. Seventy-five percent of the pavers shall count towards lot coverage.
INNER COURTAn open, unoccupied space enclosed on all sides by exterior walls of a building.
JUNKYARDSAny lot, land, building or structure or part thereof used for the storage, collection, processing, purchase, sale or abandonment of any waste material, including but not limited to wastepaper, rags, scrap metal or other discarded goods, materials, machinery, or two or more unregistered inoperable motor vehicles.
LOADING DOCK/SPACE, OFF-STREETAny paved or otherwise surfaced off-street space provided in a convenient location, only for the loading or unloading of goods, having dimensions of at least 12 feet in width and 30 feet in length, with clear headroom of at least 14 feet, and having direct usable access to a street or driveway.
LOTAny single parcel of land having frontage on an improved public street which is occupied or which is to be occupied by a building and its accessory buildings, if any, or by a group of buildings having any land in common and the buildings accessory to such group, if any, or as a yard to provide open space or other uses for a building on an abutting lot.
LOT, CORNERA lot at the junction of and abutting on two or more intersecting streets.
LOT, DEPTHThe mean distance from the street line of a lot to its opposite rear line, measured parallel to or in the general direction of the side lines of the lot. In a corner lot, the depth is the longer dimension thus measured.
LOT, THROUGHA lot which fronts upon two parallel streets, or which fronts upon two streets which do not intersect at the boundaries of the lot.
LOT, WIDTHThe mean dimension of the lot, measured at right angles to its depth.
MANUFACTURING ESTABLISHMENTEstablishments engaged in the transformation of substances into new products, including assembling, converting, altering, finishing of component parts, the manufacture of products and the blending of materials.
MEDICAL AND DENTAL OFFICEThe office of medical practitioners, including but not limited to medical doctors, dentists, dental surgeons, veterinarians, chiropractors, podiatrists, psychologists and licensed therapists.
MEDICAL CANNABISCannabis dispensed to registered qualifying patients pursuant to the Jake Honig Compassionate Use Medical Marijuana Cannabis Act, P.L. 2009, c. 307 (2010), codified at N.J.S.A. 24:61-1 et seq.

MOBILE HOMEA structure, transportable in one or more sections, which is at least eight feet in width and 32 feet in length, built on a permanent chassis and designed to be used as a dwelling unit, with or without a permanent foundation, when connected to required utilities.
MOTELA facility offering transient lodging accommodations to the general public containing six or more rooms with at least 25% of all rooms having direct access to the outside without the necessity of passing through the main lobby of the building.
NET FLOOR AREA (IN NONRESIDENTIAL BUILDINGS)The sum of the horizontal areas of all floors of any nonresidential building, measured from the interior faces of exterior walls, excluding stairwells, equipment rooms, interior vehicular parking and loading, and all floors below the first or ground floor, except when used for the building's primary use or to serve the public.
NONCONFORMING BUILDINGA building, the size, dimension or location of which was lawful prior to the adoption, revision or amendment of a zoning ordinance, but which fails to conform to the requirements of the zoning district in which it is located by reasons of such adoption, revision or amendment.
NONCONFORMING LOTA lot, the area, dimension or location of which was lawful prior to the adoption, revision or amendment of a zoning ordinance, but which fails to conform to the requirements of the zoning district in which it is located by reason of such adoption, revision or amendment.
NONCONFORMING USEA use or activity which was lawful prior to the adoption, revision or amendment of a zoning ordinance, but which fails to conform to the requirements of the zoning district in which it is located by reasons of such adoption, revision or amendment.
OFFICEA room or group of rooms used for conducting the offices of business, professional, service, industry or government.
OPEN SPACEAn area within or related to a site designated as a planned development, and designed and intended for the use or enjoyment of residents of the development.
OUTER COURTAn open unoccupied space enclosed on not more than three sides by exterior walls of a building.
PARKA tract of land designated and used by the public for active and/or passive recreation.
PARKING SPACE, OFF-STREETA space which, exclusive of driveways and turning areas, is nine feet wide and 18 feet long and which is accessible from an aisle, driveway or public street and is available for the parking of one automobile. When intended for handicapped parking, such a space shall be eight feet wide with a eight feet wide space for car accessible with a five foot cross-hatched and van accessible eight feet wide with a eight feet cross-hatched accessible area. One of every five handicap spaces must be van accessible.
PERSONAL SERVICESEstablishments engaged primarily in providing services involving the care of a person or his or her apparel, including but not limited to laundry, cleaning and garment services, garment pressing, linen supply, diaper service, coin-operated laundries, dry cleaning plants, carpet and upholstery cleaning, minor repair for radio, television, computer and household appliances, watch repair, locksmith, tailor, photographic studios, beauty shops, barbershops, shoe repair, hat cleaning, and clothing rental.
PLACE OF WORSHIPA building or group of buildings which by design and construction are intended for the conducting of organized religious services and accessory uses associated therewith.
PROFESSIONAL OFFICEThe office of a recognized professional, including but not limited to doctor, dentist, accountant, attorney at law, architect and engineer.
PUBLIC FACILITIESLand and/or buildings used by the Borough of Lodi or any other officially created agency or authority thereof.
RESEARCH AND DEVELOPMENT FACILITIESAn establishment or other facility engaged in the investigation of the natural, physical or social sciences or engineering and development as an extension of such activities with the objective of creating end products.
RESTAURANTAn establishment where food and drink are prepared, served and consumed within an enclosed building, and wherein food is served only to be consumed by customers seated at tables on the premises.
RETAIL SERVICESEstablishments providing services, as opposed to products, including finance, insurance, real estate, travel agencies, health, educational and social services, museums and galleries.
RETAIL TRADEEstablishments engaged in selling goods or merchandise to the general public for personal or household consumption. Even though certain establishments, including but not limited to hardware, paint, glass and wallpaper stores, do a substantial portion of their business with contractors, they are included in this definition of retail trade.
RETENTION BASINThose areas which exist or are created for the storage of stormwater and absorption of this water into the ground.
SATELLITE DISH ANTENNASAny apparatus, including structural supports, which is designed for the purpose of receiving television, internet, satellite or similar signals.
SCHOOLAny building or group of buildings, the use of which meets requirements for primary, secondary or higher education, licensed by the Board of Education of the State of New Jersey.
SETBACK LINEA line drawn parallel with a street line or any other lot line and drawn through the point of a building nearest to the street line or other lot line. The term "required setback" means a line that is established a minimum horizontal distance from the street line or other lot line and beyond which a building or part of a building, including any deck but excluding a ground level patio or an overhang not exceeding two feet, is not permitted to extend toward the street line or other lot line.
SEXUALLY ORIENTED BUSINESSA commercial establishment which, as one of its principal purposes, offers for sale or rent, books, magazines or videos which depict a specified sexual activity.
SIGNA name, identification, structure, object, illumination, description or any other visual display or decoration which is affixed to, painted on or represented, directly or indirectly, upon a building, structure, object or land, or behind a window and visible from the outside of the building or structure and any of which is for the purpose of directing attention to an organization, object, person, place, activity, institution, service, business or industry.
(1) A sign shall not include the following:
(a) Any display or any official notice of any government and any official agency thereof.
(b) Any official traffic control device within a public right-of-way.
(c) Any flag, emblem or insignia of any government, school or church.
(d) Anything which might otherwise be described as a sign which is located completely within an enclosed building or structure and not visible from the outside of that building or structure.
(e) Any sign indicating the private nature of a driveway or a "no trespassing" or "no soliciting" sign not exceeding 1.5 square feet in area.
(f) Any nameplate or street address sign not exceeding one square foot in area.
(2) SIGN, ADVERTISINGA sign which directs attention to an individual, business, product or service conducted, sold, leased or offered elsewhere than on the premises where the sign is located. For the purpose of this chapter, a billboard shall be considered an "advertising sign."
(3) SIGN, ANIMATEDAny sign that uses movement or change of lighting to depict action or the illusion of movement or create a special effect or scene.
(4) SIGN, AREAThe area enclosed by the outer edge of the outermost frame or border of the sign if it is enclosed in a frame or border or, if the sign is not enclosed in a frame or border, the area of the smallest rectangle which encompasses all of the background and features of the sign, except for temporary banners.
(5) SIGN, BILLBOARDA sign that directs attention to a business, commodity, goods, services or entertainment conducted, sold or offered at a location other than the premises on which the sign is located or containing other lawful messages not pertaining to the activity conducted on that property.
(6) SIGN, BUSINESSA sign which directs attention to an individual, business, product or service conducted, sold, leased or offered on the premises where the sign is located.
(7) SIGN, DIRECTIONAL or INFORMATIONALA nonadvertising sign which directs attention to vehicular or pedestrian entrances or exits, parking areas, reserved parking spaces or similar site elements and is intended only for the safety and convenience of employees, patrons or visitors.
(8) SIGN, FLASHINGA sign with illumination which is not maintained at a constant intensity, color or position at all times.
(9) SIGN, FREESTANDINGA sign having not more than two display sides supported by uprights or braces placed upon the ground and not attached to any building.
(10) SIGN, MOVINGA sign which rotates or shifts or appears to rotate or shift position.
(11) SIGN, REAL ESTATEA sign which directs attention to the sale or rental of the premises or a portion of the premises upon which it is located. The sign shall be no larger than four square feet and must be authorized by the owner of the premises and removed within 30 days of the consummation of the sale or rental.
(a) SIGN, DIRECTIONAL RESIDENTIAL REAL ESTATE OPEN HOUSEA temporary signage placed either upon private property with the permission of the owner of that property or within the public rights-of-way, in either event under the conditions hereinafter set forth and in accordance with laws, ordinances and regulations governing public right-of-way, which signs are limited in language to so much as may be reasonably necessary to give notice to the public of residential property that is then being offered for sale and upon which there is or will be conducted an open house for the purpose of promoting such sale, to give notice of the location and times of such open house and to give notice of the name and address of the licensed real estate broker conducting such open house or the fact that such open house is being conducted by the owner intending to sell the premises.
(12) SIGN, TEMPORARYA sign which directs attention to special or periodic functions of civic, religious, community, veterans, volunteer fire, first aid, charitable or other similar organizations or to the candidacy of an individual or group for nomination or election to a governmental office or to the erection, repair or improvement of a building.
(13) SIGN, WALLA sign placed against or painted on an exterior street facing wall of a building or wall at right angles to a street facing wall of a building so that the display surface is parallel with the surface of the wall and does not extend beyond the limits of the wall or the portion of the building occupied or intended to be occupied by the subject use. A sign placed against or painted on an awning or marquee attached to an exterior street facing wall shall be considered a wall sign.
SOLAR ENERGY SYSTEMA complete design or assembly consisting of a solar energy collector, an energy storage facility (where used), and components for the distribution of transformed energy.
STORYThat part of any building included between any floor and the floor or ceiling next above. The ground or first story of a building is the lowest story thereof which has its floor level entirely above the level of the ground, except when the ground story has a ceiling seven feet six inches or more above the average elevation of the finished grade of the ground adjoining a building, it shall be considered as a story in determining the height of a building, provided that not more than 1/2 of its height is below the average elevation of the finished grade of the ground adjoining the building.
STORY, HALFA story, under a roof other than a flat roof, the rafter plates of which on at least two opposite walls are less than three feet above the floor itself.
STREETAny street, avenue, boulevard, road, parkway, viaduct, drive or other way which is an existing state, county or municipal roadway, or which is shown upon a plat heretofore approved pursuant to law or which is shown on a plat duly filed and recorded in the office of the County Recording Officer prior to the appointment of a Planning Board and the grant to such Board of the power to review plats, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, curbs, sidewalks, parking areas and other areas within the street lines.
STREET LINEThe dividing line between a lot and a public street, road or highway or other public open space having a width of at least 25 feet.
SWIMMING POOLAny structure having a depth greater than two feet and a water surface area in excess of 100 square feet, which is used for swimming, bathing or wading purposes.
TRAILERA structure standing on wheels, capable of being towed or hauled by another vehicle and used for temporary or long-term human occupancy.
USABLE OPEN SPACEAll multiple-family dwellings shall comply with the following requirements for minimum usable open space per dwelling for the purposes of providing light, air, and recreational space for occupants and other persons coming onto the property: studio - 50 square feet; one bedroom - 100 square feet; two bedroom - 200 square feet; and, three bedroom 300 square feet. Parking lots or areas shall not be credited toward "usable open space."
USEThe specific purposes for which land or a building, structure or facilities is designed, arranged or intended or for which it is or may be occupied or maintained.
UTILITY SERVICESEstablishments engaged in the generation, transmission and/or distribution of electricity, gas or steam, including water and irrigation systems and sanitary systems used for the collection and disposal of garbage, sewage and other wastes by means of destroying or processing materials.
VARIANCEPermission to depart from the strict application of the requirements of this chapter pursuant to law.
VIDEO OR AMUSEMENT ARCADEAny indoor establishment that contains three or more amusement devices of any description, including but not limited to pinball amusement games, computer or video amusement games, or games of chance for the public amusement, patronage or recreation.
VOCATIONAL OR TECHNICAL TRAINING SCHOOLA secondary or higher educational facility primarily teaching usable skills that prepare students for jobs in a trade and meeting the state requirements as a vocational facility.
WAREHOUSEA building or structure used primarily for the storage of goods and materials.
WHOLESALE TRADE OR STORAGEEstablishments or places of business engaged in the storage or selling of merchandise for or to retailers, to industrial, commercial, institutional or professional business users or to other wholesalers, or acting as agents or brokers and buying merchandise for or selling merchandise to such individuals or companies. This shall exclude lumberyards, building supply and garden supply centers engaged in sales of such materials primarily to the public.
YARD, FRONTAn open space, unoccupied except by platform for stairs no more than four feet in length within and extending the full width of the lot between all street lines and the parts of the building nearest to such street lines.
YARD, REARAn open space extending across the full width of the lot lying between the principal building and the rear lot line and measured perpendicular from the rear lot line to the closet point of the building.
YARD, SIDEAn open and unoccupied space, extending the full length of the lot between the side lot line and a line drawn through the point of the building nearest to the lot line. Where there are stairs in said side yard, the side yard shall be unobstructed for at least three feet.
ZONING CERTIFICATE OF COMPLIANCEA certificate upon the change of use, occupancy or ownership of any premises indicating the purpose for which the premises is to be used and certifying the compliance of such use and the compliance of the structure with this chapter and with any conditions that may have been imposed upon such use or structure by either the Board of Adjustment or the Planning Board.
