CHAPTER 5

- OFFICE DISTRICTS

5-5-1.- Purposes.

The purpose of the village's two office districts is to provide areas for office development that are consistent with the overall community character of the village. The office district regulations are intended to assure that all office development is sensitive to and has a minimal impact upon the character of the residential heart of the village.

The purpose of the OR office and research district is to allow development of areas attractive to executive headquarters on large, open landscaped sites with every possible assurance that the highest quality of the neighborhood be maintained and to permit office, medical, and research uses that are highly compatible with the uses allowed in any adjacent or nearby residential districts.

The purpose of the O office district is to allow development of areas conducive to office use only, on large, open landscaped sites with every possible assurance that the highest quality of the neighborhood will be maintained and to permit office and medical uses exclusive of manufacturing and assembly that are highly compatible with the uses allowed in any adjacent or nearby residential districts.

5-5-2. - Permitted uses.

The following uses and no others are permitted as of right in the office districts:

(A)

Open space.

(B)

Offices for executive or administrative purposes.

(C)

Advertising and/or public relations agencies.

(D)

Engineering and/or architectural offices.

(E)

Insurance offices.

(F)

Professional offices.

(G)

In the OR district only, the following uses shall also be permitted as of right:

1.

Utility offices.

2.

Training centers.

3.

Manufacturing and assembly uses, where less than 50 percent of the total floor area of the building is utilized for such uses and the remainder is utilized for storage or an otherwise permitted use.

Video gaming, provided that video gaming shall be limited to establishments holding a valid class V liquor license granted pursuant to title 3, chapter 2 of this code.

5-5-3. - Accessory structures and uses.

Accessory structures and uses are permitted in the office districts subject to the provisions of section 5-9-1 of this title.

5-5-4. - Temporary uses.

Temporary uses are permitted in the office districts subject to the provisions of section 5-9-3 of this title.

5-5-5. - Special uses.

The uses listed in the following subsections may be permitted in the office districts subject to the issuance of a special use permit as provided in section 5-11-17 of this title:

(A)

Planned unit developments, but only subject to the special procedures and standards contained in section 5-11-18 of this title.

(B)

Medical laboratories.

(C)

Personal wireless services antennas, but only subject to the special procedures and standards contained in section 5-9-6 of this title.

(D)

In the OR district only, scientific or research laboratories, excluding all but the most incidental pilot plants.

5-5-6. - Parking requirements.

The parking requirements applicable in the office districts are set forth in section 5-9-4 this title.

5-5-7. - Sign regulations.

The sign regulations applicable in the office districts are set forth in section 5-9-5 of this title.

5-5-8. - Buffer yards, landscaping, and screening requirements.

The requirements relating to buffer yards, landscaping, and screening of certain uses and structures in the office districts are set forth in section 5-9-7 of this title.

5-5-9. - Use limitations.

(a)

Operations within Buildings. All business and services, including servicing, storage, processing, or display of goods, except for off-street parking and loading, shall be conducted within completely enclosed buildings.

(B)

Architectural and Landscaping Review. All architectural and landscaping plans, as well as exterior lighting plans, shall be reviewed and approved by the architectural board prior to the issuance of any building permit in accordance with section 5-11-19 of this title.

(C)

Exterior Lighting. All exterior lighting shall be adequately shielded from adjacent properties to prevent glare or spillover.

(D)

Refuse Containers. All refuse containers shall have an attached cover and be shielded from public view.

(E)

One Principal Use Per Lot. Unless otherwise permitted expressly pursuant to a special use permit or planned unit development approval, each principal use shall be located entirely on a single zoning lot.

(F)

Noxious or Offensive Impact Prohibited. No use shall be conducted in any manner which would render it noxious or offensive by reason of dust, refuse matter or water carried waste, odor, smoke, cinders, gas, fumes, noise, vibration, or glare.

(G)

Storage. All storage of materials and equipment used in connection with any permitted or special use shall be enclosed and shielded from public view.

5-5-10. - Bulk, space, and yard requirements.

The building height, lot, yard, setback, floor area ratio and coverage requirements applicable in the office districts are set forth in the following table. Footnote references appear at the end of the table.

Exceptions and Explanatory Notes:

1.

Height Limitation for Accessory Structures. No accessory structure shall exceed 15 feet in height.

2.

Nonconforming Lots. See section 5-10-5 of this title for lot requirements with respect to legal nonconforming lots of record.

3.

Permitted Obstructions in Required Yards. See section 5-9-8 of this title for certain structures and uses that may be located in certain required yards.

4.

Special Conservancy Area and Scenic Corridor Setbacks. Special setbacks for conservancy areas and scenic corridor areas established in title 7 of this code shall control over the yard and setback requirements established in this table.

5.

Parking in Yards in the O District. in the O district only, no parking shall be permitted in any yard.

6.

Side Yards. Side yards abutting a residential district, whether that district is within or without the village's boundaries, shall be not less than 100 feet in width in the OR district and 200 feet in width in the O district.

7.

Parking in Side Yards. in the OR district only, parking of passenger vehicles may be permitted in the interior one-half of any required 75-foot side yard, provided that where such side yard abuts a residential district, no parking shall be permitted in the required yard.

8.

Increased Rear Yards. Rear yards abutting a residential district, whether that district is within or without the village's boundaries, shall be not less than 100 feet in depth in the OR district and 200 feet in depth in the O district.

9.

Parking in Rear Yards in the OR District. In the OR district only, parking of passenger vehicles may be permitted in the interior one-half of any required 75-foot rear yard, provided that where such rear yard abuts a residential district, no parking shall be permitted in the required yard.
