CHAPTER 6

- OPEN SPACE DISTRICT

5-6-1.- Purposes.

The open space district (OS district) is intended to recognize, preserve, and protect the areas of open space within the village.

5-6-2. - Zoning subdistricts.

All lots situated within the OS district shall be zoned into one of the following subdistricts:

(A)

OS-N, which is intended to protect the village's natural resources. All lots within the OS-N district shall be high quality, natural areas and left in their natural condition. Only carefully managed programs to preserve the wild nature of the land and its enjoyment may be allowed as a special use.

(B)

OS-P, which is intended to maintain the village's rural environment and atmosphere. All lots within the OS-P district shall be maintained in, and/or restored to, a natural condition. These areas are intended to preserve the open spaces essential to the village character and protect the resources that do not fall in the OS-N classification.

(C)

OS-R, which is intended to fulfill the village's future recreational needs. Uses that promote the village's general recreation needs may be allowed as a special use within the OS-R district. These special uses include, but are not limited to: ball fields and courts, golf courses, trails and tracks, swimming pools and beaches, picnic and concession areas, and playgrounds and tot lots. The special uses that may be allowed in the OS-N and OS-P districts may be allowed as special uses within the OS-R district as well.

5-6-3. - Permitted uses.

The following uses and no others are permitted as of right in the open space district.

(A)

Open Space.

All lots within the open space district shall be used and maintained for open space purposes only, and no manmade structure shall be permitted in the open space district, except as expressly permitted pursuant to a special use under section 5-6-6 of this chapter.

5-6-4. - Accessory structures and uses.

Accessory structures and uses are permitted in the open space district subject to the provisions of section 5-9-1 of this title.

5-6-5. - Temporary uses.

Temporary uses are permitted in the open space district subject to the provisions of section 5-9-3 of this title.

5-6-6. - Special uses.

The following uses may be permitted in the open space district subject to: a) the issuance of a special use permit as provided in section 5-11-17 of this title and b) compliance with all applicable conservancy or scenic corridor area restrictions contained in title 7 of this code.

(A)

Any manmade structure.

(B)

In the OS-R district, recreational facilities and equipment, including ball fields and courts, golf courses, trails and tracks, swimming pools and beaches, picnic and concession areas, playgrounds and tot lots.

(C)

Personal wireless services antennas, but only subject to the special procedures and standards contained in section 5-9-6 of this title.

(D)

Any other uses which the village board determines are consistent with the overall purpose of the open space district.

(E)

Video gaming, provided that video gaming shall be limited to establishments holding a valid class V liquor license granted pursuant to title 3, chapter 2 of this code.

5-6-7. - Sign regulations.

The sign regulations applicable in the open space district are set forth in section 5-9-5 of this title.

5-6-8. - Use limitations.

(A)

One Principal Use Per Lot. Unless otherwise permitted expressly pursuant to a special use permit or planned unit development approval, each principal use shall be located entirely on a single zoning lot.
