LOW DENSITY

RESIDENTIAL DISTRICT R-1

§ 156.055 PURPOSE.

   This district is intended provide for the development of single-family residences and two- or three-family residences at a density compatible with existing residential development. This district also accommodates those institutional and public uses compatible with residential neighborhoods.

§ 156.056 PERMITTED PRINCIPAL USES.

   The following uses are permitted within this district; provided that, only one principal use or structure is allowed on a single lot:
   (A)   A church or other place of worship;
   (B)   A nursing home;
   (C)   A park or playground;
   (D)   A public or private school;
   (E)   A single-family dwelling constructed on-site, or assembled as a modular unit which meets the definition in § 156.005 of this chapter; a mobile home or mobile home court is not permitted; and
   (F)   A two- or three-family dwelling, constructed on-site and containing only one story.

§ 156.057 CONDITIONAL USES.

Relocated, previously constructed buildings not qualifying as modular units
Buildings must be sound structurally, meet State Building Codes and have exterior walls, roofs and windows in good repair
No protest signed by 20% or more of the owners of properties located within 150 feet of the lot(s) in question has been submitted
Architectural style must be reasonably compatible with surrounding structures

§ 156.058 ACCESSORY AND TEMPORARY USES.

   The following accessory and temporary uses are permitted in this district:
   (A)   Accessory buildings and uses incidental to the above principal uses;
   (B)   Driveways, sidewalks, patios, retaining walls and steps require a permit. No fee charge;
   (C)   Home occupations under the requirements of § 156.006 of this chapter; and
   (D)   Temporary buildings for and during construction only.

§ 156.059 LOT AREA AND WIDTH.

   Except for existing lots of record which, because of ownership, cannot be reassembled to conform to this requirement, the following lot areas and widths are required.
   (A)   Single-family dwelling. Each lot shall contain a minimum of 7,000 square feet, and be at least 50 feet wide.
   (B)   Two- and three-family dwellings. Each lot shall contain a minimum of 4,000 square feet per dwelling unit, and be at least 50 feet wide.

§ 156.060 YARD REQUIREMENTS.

   Every lot shall have the following yard requirements as measured from the farthest extension of the structure.
   (A)   Front yard.
      (1)   A 30-foot yard shall be provided on all street frontages (as measured from curbline, drainage swale or equivalent drainage facility).
      (2)   Corner lots shall be construed as having two frontages, each of which shall allow for a 30-foot yard.
   (B)   Side yard. Side yards abutting interior lot lines shall not be less than three feet.
   (C)   Rear yard. A rear yard of at least three feet shall be provided.
   (D)   Determination. In determining building lines and yard requirements, the farthermost protruding part of a structure shall be the determining factor.

§ 156.061 BUILDING HEIGHT.

   (A)   Maximum height for all buildings and other structures shall be 24 feet.
   (B)   Maximum height for accessory buildings may not exceed one and one-half times the height of the primary dwelling, and shall not exceed 24 feet for single-family dwellings and two- or three-family dwellings containing only one story.
   (C)   (1)   Accessory buildings located on the same lot (not involving the conduct of a business) including two private garages, or community garage.
      (2)   Garages shall not exceed the following sizes for each lot:

      (3)   Accessory buildings must comply with all setback requirements.
   (D)   No former railcars, semi boxes, containers or corn-parables will be allowed for storage units.
   (E)   Garages must be new, permanent structures and shall have a dwelling located on lot(s).
   (F)   A maximum of two garages will be allowed, whether attached or detached.

§ 156.062 SIGNS.

   The following signs are permitted in this district:
   (A)   For residential uses, non-illuminated signs less than six square feet in area; and
   (B)   For all other uses, non-illuminated signs, including bulletin boards at schools and churches, not exceeding 12 square feet in area; provided, the sign is located at least ten feet from any road right-of- way and does not obstruct traffic visibility.

§ 156.063 GARAGES ON VACANT LOTS.

   One garage shall be allowed on a vacant lot with the following criteria:
   (A)   Section 156.061(C) of this chapter for garage size allowed shall be followed;
   (B)   Maximum height is not to exceed 24 feet;
   (C)   Residential use only, no commercial use allowed;
   (D)   Garage must be placed on a cement foundation that meets the city’s Building Codes, and placed toward the rear of a vacant lot to accommodate for a home to be built at a later date;
   (E)   Proposed garage must have four walls, roof and siding that meet Current Building Codes and an operational door. Pole barns are not an option in this area; and
   (F)   Only one building per lot without a house will be allowed, either a garage or storage shed.
