HIGHWAY COMMERCIAL

DISTRICT H-C

§ 156.145 PURPOSE.

   This district is intended to accommodate the business and light industrial uses which require more space than is normally available in the Central Business District, or whose operations require access to the major transportation facilities serving the community. The district should accommodate these uses while preserving the traffic-carrying capacity of the road system and the desirability of abutting land for residential development.

§ 156.146 PERMITTED PRINCIPAL USES.

   The following uses are permitted within this district:
   (A)   Amusement centers and recreational facilities located in enclosed buildings;
   (B)   Automobile and truck sales, service and repair; all uses pertaining to, including service stations and car washes;
   (C)   Beverage bottling and distributing;
   (D)   Building equipment and materials - wholesale and retail, including storage yards;
   (E)   Cleaning and drying establishments;
   (F)   Electric equipment - assembly, repair and sales;
   (G)   Fraternal lodges and clubs;
   (H)   Laboratories;
   (I)   Meeting halls, auditoriums, arenas, indoor theaters;
   (J)   Motels, hotels, convention centers;
   (K)   Outdoor advertising;
   (L)   Police and fire stations;
   (M)   Restaurants, drive-in eating establishments, nightclubs;
   (N)   Retail and wholesale sales, service and repair - agricultural products, products serving agriculture, farm implements, heavy machinery, mobile homes, travel trailers, recreational vehicles;
   (O)   Storage yards;
   (P)   Utilities, public or private;
   (Q)   Veterinary office, clinic, hospital;
   (R)   Warehouses;
   (S)   Wholesale storage or sales; and
   (T)   Other uses commensurate with the above uses and compatible with the purpose of this district.

§ 156.147 CONDITIONAL USES.

   (A)   The following uses must comply with the additional conditions specified below.
   (B)   Approval of these conditional uses must be obtained from the Zoning Commission under the procedures of §§ 156.235 through 156.237 of this chapter.

Recreational vehicle park
Streets shall be at least 10 feet wide, and wider if necessary to accommodate the expected traffic
Streets and RV lots shall be designed to permit safe placement and removal of trailers and vehicles
All parks shall provide for safe and convenient access from public roads or streets
The park shall be equipped at all times with fire-control equipment in good working order, and of a type prescribed by local fire authority
Gas and electric utilities shall be installed in accordance with the appropriate codes
RV vehicles shall be separated from each other and from other structures by at least 15 feet
All RV spaces shall be located at least 25 feet from a public street or highway right-of-way
The density shall not exceed 25 RV spaces per acre

§ 156.148 ACCESSORY AND TEMPORARY USES.

   (A)   Accessory buildings and uses incidental to the principal uses;
   (B)   Buildings or structures used for and during construction or grading;
   (C)   Sale of Christmas trees, baked goods, clothing or like products where no permanent structure is erected;
   (D)   Temporary signs; and
   (E)   Use of open land for meetings, circuses, carnivals.

§ 156.149 LOT AREA.

   (A)   Where public water and sewer service is available, no minimum lot size is required.
   (B)   Where Department of Health and Environmental Sciences approval is required, that agency shall determine the lot size.
   (C)   Where neither of the above conditions apply, the minimum lot size shall be one acre.

§ 156.150 HEIGHT REQUIREMENTS.

   No building or structure may exceed 45 feet in height.

§ 156.151 YARD REQUIREMENTS.

   (A)   Front yard. A front yard of at least six feet shall be provided on all road frontages.
   (B)   Side yard. Side yards abutting interior lot lines shall be at least ten feet.
   (C)   Rear yard. A rear yard of at least ten feet shall be provided.

§ 156.152 OFF-STREET PARKING AND LOADING.

   (A)   Off-street parking facilities must comply with the provisions of § 156.220 of this chapter.
   (B)   Off-street loading areas must comply with the provisions of § 156.221 of this chapter.

§ 156.153 SIGNS.

   Signs within this district shall comply with regulations enforced by state and federal agencies.

§ 156.154 ACCESS POINTS ONTO PUBLIC ROADS.

   (A)   Approaches onto public roads and highways shall be at least 32 feet wide.
   (B)   Approaches onto public roads and highways shall have a grade of 6% or less.
   (C)   (1)   Approaches onto public roads or highways shall be at least 125 feet apart.
      (2)   The centerline of approaches from properties on opposite sides of a public road shall be aligned at the same point on the public road.

§ 156.155 GRADING AND DRAINAGE.

   (A)   The site shall be graded and appropriate drainage facilities installed to remove surface run-off waters in a manner that will not affect adjacent or nearby properties, rivers or public roads.
   (B)   Culverts, curbs, gutters, ditches, swales and other drainage facilities shall be installed to assure that approaches, parking areas and other traffic facilities do not obstruct drainage facilities or adversely affect public road and traffic facilities.
   (C)   Culverts and bridges shall be large enough to accommodate potential runoff from upstream drainage areas.
   (D)   Curbs and gutters or swales shall be required according to the character of the area, density of development and nature of adjoining properties and public streets.
