CHAPTER 4

ZONING MAP AND DISTRICTS

10-4-1: ZONING MAP ADOPTED:

The town is divided into districts, or zones, as shown on the official zoning map which, together with all explanatory matter thereon, is adopted by reference and declared to be a part of this title. Copies of the official map can be found on the town’s website or at town hall. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-4-2: INTERPRETATION OF BOUNDARIES:

Where uncertainty exists with respect to boundaries of any of the aforesaid districts as shown on the zoning map, the following rules shall apply:
   A.   Centerlines: Where district boundaries are indicated as approximately the centerlines of streets or highways, street lines or highway right of way lines shall be construed to be such boundaries.
   B.   Lot Lines: Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be such boundaries.
   C.   Parallel To Centerlines: Where district boundaries are so indicated that they are approximately parallel to the centerlines of highways, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the zoning map. If no distance is given, such dimension shall be determined by the scale of the map.
   D.   Railroad Lines: Where the boundary of a district follows a railroad line, such boundary shall be deemed to be located in the middle of the main tracks of such railroad line. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-4-3: DISTRICT CLASSIFICATIONS:

For the purpose of this title, the town is divided into the following use districts:
AG
Agricultural district
RR
Rural residential district
R-1
Low density residential district
R-3
Medium density residential district
RT
Residential transitional district
CBD
Central business district
NHB
Neighborhood highway business district
L-1
Light industrial district
P-O
Parks and open space district

10-4-4: PROHIBITION OF MARIJUANA BUSINESSES:

   A.   As authorized by Title 16, Chapter 12, MCA, and based on the affirmative vote of the electors of the Town of Manhattan, the following marijuana businesses are permanently prohibited from opening or operating within the boundaries of the town:
      1.   Cultivator;
      2.   Manufacturer;
      3.   Medical marijuana dispensary;
      4.   Adult use dispensary;
      5.   Testing laboratory; and
      6.   Marijuana transporter facility.
   B.   Violation of this section is a municipal infraction and shall be punished as set out in Title 1, Chapter 4 of the Town Code. (Ord. 23-001, 1-12-2023; amd. Ord. 25-001, 6-12-2025)
