CHAPTER 9

MANUFACTURED HOME PARKS

10-9-1: PURPOSE:

The purpose of this chapter is to provide for manufactured home park development at appropriate locations and to establish standards for development to integrate manufactured homes into an area without adversely affecting surrounding properties and to provide safeguards for residents of manufactured homes.
Manufactured home parks are permitted as a conditional use in the R-3 medium density residential district or as part of a planned unit development (PUD). (Ord. 253, 12-1-1998; amd. Ord. 14-001, 5-14-2014; Ord. 25-001, 6-12-2025)

10-9-2: APPLICABILITY:

This chapter shall govern all manufactured homes which are moved into any manufactured home park within the zoning jurisdiction of the town. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-9-3: SUPPLEMENTAL REGULATIONS:

The regulations in this Chapter shall not be interpreted to supersede or amend any State or Federal regulation pertaining to manufactured home park development. In cases of conflict between the provisions of applicable regulations, the more restrictive shall apply. (Ord. 253, 12-1-1998; amd. 2000 Code; Ord. 25-001, 6-12-2025)

10-9-4: PERMITS:

It shall be unlawful for any person to construct, alter, or extend any manufactured home park unless agencies of the State and Town have issued the necessary valid permits. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-9-5: LICENSES:

It shall be unlawful for any person to operate any manufactured home park unless said person holds a valid license issued by the Town. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-9-6: DESIGN STANDARDS:

Any person desiring to establish or enlarge a manufactured home park shall meet or exceed the following design standards:
   A.   Ambient Conditions: The manufactured home park site shall not be exposed to smoke, dust, noise, odors, or other adverse influences which might create damage to property or bring harm to occupants of the park.
   B.   Site Size: There is no minimum lot size for a manufactured park as long as the proposed park does not exceed the allowable density requirements.
   C.   Density: The maximum density of a manufactured home park shall be six (6) units per acre.
   D.   Site Coverage: Maximum manufactured home lot coverage shall not exceed the district requirements unless proposed as a PUD.
   E.   Lot Size: Minimum lot area shall be dictated by the State DEQ requirements, density requirements, and section 10-9-6 (F) and (G).
   F.   Exterior Setbacks: All manufactured homes and accessory buildings shall be set back not less than twenty feet (20') from all property lines adjacent to the park’s original property lines except front property lines and street property lines. Front and street setbacks shall be the same as the front yard requirements of the district in which the manufactured home park is to be located.
   G.   Interior Setbacks: Within the manufactured home park, manufactured homes shall be located a minimum of twenty feet (20') apart side to side, a minimum of fifteen feet (15') apart rear to rear, or side to rear, a minimum of fifteen feet (15') from any interior roadway and twenty five feet (25') from any public roadway. Any accessory structure such as attached awnings, carports, etc., shall, for the purpose of this Chapter, be considered a part of the manufactured home.
   H.   Height: Maximum height for any structure within a manufactured home park shall be that of the district in which the park is to be located.
   I.   Streets: All manufactured home parks shall be provided with safe and convenient vehicular access from abutting public streets and throughout the manufactured home park that shall be reviewed by the Town Engineer.
      1.   Exterior Access: All manufactured home parks shall have direct access to a dedicated collector street.
      2.   Interior Circulation: Streets within the manufactured home park should be of adequate width to accommodate any contemplated parking and expected traffic load but, in all cases, shall meet at least the following minimum requirements:
         a.   Streets with parallel parking on two (2) sides: forty feet (40') wide, curb face to curb face.
         b.   Streets with parallel parking on one side: thirty two feet (32') wide, curb face to curb face.
         c.   Streets with no parallel parking: twenty four feet (24') wide, curb face to curb face.
         d.   All dead-end streets shall be limited to a maximum length of five hundred feet (500') and shall be provided with a cul-de-sac of at least one hundred feet (100') in diameter.
         e.   Minimum access width to each manufactured home stand shall be sixteen feet (16').
   J.   Parking: Off-street parking spaces shall be provided in accordance with chapter 13 .
   K.   Sidewalks: Concrete sidewalks shall meet Town of Manhattan Design Standards.
   L.   Recreational Area: A minimum of eleven percent (11%) of the gross site area shall be reserved for park and recreational development. Such areas shall be central in location and shall be furnished with trees, grass, benches, recreational equipment, and other facilities for use by park residents. The design and furnishings of the recreational area shall be subject to approval by the Planning Board as part of the conditional use application review.
   M.   Perimeter Planting Strip: A planting strip of not less than twenty feet (20') in width shall be provided along the perimeter of the manufactured home park. The planting strip shall be developed with a mixture of hardy deciduous and coniferous plant material, grass, or ground cover, and maintained thereafter in a neat and orderly manner.
   N.   Utilities:
      1.   All utilities, including connections provided to individual lots, shall meet the requirements of the Town.
      2.   All electric, telephone, gas and other lines within the manufactured home park shall be underground.
   O.   Trash And Garbage: Facilities for the storage and disposal of trash and garbage in a sanitary and lawful manner shall be provided in each manufactured home park.
   P.   Lighting: Street and yard lights, attached to standards approved by the Town Council and Town Engineer, shall be provided in sufficient number and intensity to permit the safe movement of vehicles and pedestrians at night, and shall be located to prevent glare on surrounding properties and public rights of way.
   Q.   Fire Protection: The water supply system serving the manufactured home park shall comply with the rules and regulations of the local fire protection authority, or the system shall meet the standards for adequate fire protection established by the National Fire Protection Association, whichever is more stringent. All fire protection systems are subject to approval by the Town Fire Chief. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-9-7: APPROVAL AS CONDITIONAL USE:

Approval of a manufactured home park shall be obtained through the conditional use permit procedure as specified in Chapter 11 of this Title. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)
