CHAPTER 5

AG AGRICULTURAL DISTRICT

10-5-1: PURPOSE:

The intent of the agricultural district, AG, is to discourage small tract and sprawl development in areas of agriculture importance and in areas of environmental concern. It is intended that through the use of this district, agricultural pursuits will be encouraged and environmental concerns protected. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-5-2: PERMITTED USES:

In all the AG districts, no building or land shall be used and no building or structure shall be erected, altered, or enlarged which is arranged, intended or designed for other than one of the uses listed below, unless determined by the town council or designee to be in conformance with similar uses:
   A.   Accessory uses and buildings, including single- and multi-unit dwellings to house employees working on the farm or ranch.
   B.   Agricultural uses.
   C.   Daycare home (meeting state requirements).
   D.   Home occupations.
   E.   Public and private parks.
   F.   Sales, on the premises, of products produced thereon.
   G.   Single-family dwellings (including modular and manufactured homes).

10-5-3: CONDITIONAL USES:

In an AG agricultural district zone, the following uses may be permitted, provided they are reviewed and approved as required in Chapter 11 of this title:
   A.   Bus barns and bus garages.
   B.   Churches or similar places of worship.
   C.   Commercial kennels.
   D.   Drive-in theaters.
   E.   Fishing clubs.
   F.   Golf courses.
   G.   Horse trailers, livestock trailers, and agricultural related trailers sales.
   H.   Hunting clubs.
   I.   Private and public schools.
   J.   Recreational vehicle parks.
   K.   Retail sales of nonmotorized RV type trailers.
   L.   Riding academies.

10-5-4: LOT AREA:

The minimum lot area in this district shall be determined by existing soil conditions, ground water conditions and other physical limitations for residential development. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-5-5: BUILDING HEIGHT:

The maximum building height for buildings designed and constructed for human occupancy shall be twenty six feet (26'). Structures for human occupancy are subject to the building code of the Town of Manhattan. All other agriculture related structures may exceed this height. (Ord. 253, 12-1-1998; amd. 10-5-6: LOT FRONTAGE:

There shall be a minimum lot frontage of not less than five hundred seventy five feet (575') unless the property is used for residential uses with a direct tie to an agricultural producer, then the minimum lot frontage shall be sixty feet (60'). (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-5-7: YARDS:

   A.   Front Yards: There shall be a front yard having a depth of not less than thirty five feet (35') for residential uses.
   B.   Rear Yards: There shall be a rear yard having a depth of not less than twenty five feet (25') for residential uses.
   C.   Side Yards: There shall be side yards having a depth of not less than twenty five feet (25') for residential uses. (Ord. 253, 12-1-1998; amd. Ord. 25-001, 6-12-2025)

10-5-8: ANIMAL ENCLOSURES; SETBACKS:

Except for pastures, any stable, barn, hutch, pen, shed or other such structure built to enclose or house animals or fowl shall be not less than fifty feet (50') from any structure used for human occupancy, and shall be set back not less than fifty feet (50') from any property line.
