ZONING DISTRICTS AND MAP

9-6-1: DISTRICTS ESTABLISHED:

The village of Manteno, for the purpose of this title, is hereby divided into the following zoning districts:
Residential districts:
E-1
Estate residential district
R-1
Single-family residential district
R-2
Two-family attached residential district
R-3
Multiple-family residential district
Commercial districts:
C-1
Downtown commercial district
C-2
Commercial district
Industrial districts:
I-1
Light industrial district
I-2
Heavy industrial district
Specialty districts:
A-1
Agricultural district
OS-1
Open space district
FB-1
Route 50 corridor district

9-6-2: ZONING MAP:

   (A)   Authorization: The location and boundaries of the districts established by this title are indicated upon the map entitled, "Official Zoning Map, Village Of Manteno, Illinois", which, together with all explanatory matter thereon, is hereby adopted by reference and declared to be part of this title.
   (B)   Location Of Map: The official zoning map shall be located in the office of the village clerk and shall be the final authority as to the current zoning status of land and buildings, subject to such authorized amendments which be in effect.
   (C)   Interpretation Of District Boundaries: Where uncertainty exists as to the boundaries of districts as shown on the official zoning map, the following rules shall apply:
      1.   Boundaries indicated as approximately following the centerline of streets, highways or alleys shall be construed to follow such centerlines.
      2.   Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.
      3.   Boundary lines which follow or approximately follow plotted lot lines of other property lines as identified by the "tax identification number" of the parcel assigned by the county of Kankakee shall be construed as following such lines.
      4.   Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks.
      5.   Boundaries indicated as following shorelines shall be construed to follow such shorelines, and in the event of change in the shoreline, shall be construed as moving with the actual shoreline boundaries indicated as approximately following the centerline of streams, or other bodies of water shall be construed to follow such centerlines.
      6.   Boundaries indicated as parallel to or extensions of features indicated in subsections (C)1 through (C)3 of this section shall be so construed. Distances not specifically indicated on the official zoning map shall be determined by dimensions shown on the map, or in the absence of dimensions, by the scale of the map.
      7.   Where a zoning district boundary line divides a lot in single ownership on the effective date of this title, the regulations of this title for either portion of such lot may, at the owner's discretion, apply to the entire area of the lot or twenty five feet (25') beyond the zoning district boundary lines, whichever is the lesser distance.
      8.   All streets, alleys, public ways and railroad rights of way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately abutting upon such alleys, streets, public ways and railroad rights of way, unless otherwise specifically designated, shall be deemed to be the district boundary.
      9.   Where physical or cultural features existing on the ground are at variance with those shown on the official zoning map, or in other circumstances not covered by subsections (C)1 through (C)8 of this section, the planning commission's decision may be presented to the village board in the same matter as an amendment to the zoning ordinance as outlined in chapter 14 of this title.
   (D)   Vacation Of Public Ways: Whenever any street, alley, or other public way is vacated in the manner authorized by the law, the zone adjoining each side of such street, alley, or public way, shall be automatically extended to the center of such vacation and all areas included in the vacation shall then and henceforth be subject to all regulations of the extended zone.
   (E)   Changes: If, by amendment to this title, any change is made in any district boundary, it shall be shown on the official zoning map. The date of the latest updating of the official zoning map shall be shown on the face of the map. (Ord. 99-06, 6-21-1999)

9-6-3: ENTIRE AREA ZONED:

It is the intent that the entire area of zoning jurisdiction, including all land and water areas, streets, alleys, railroads and other rights of way, be included in the districts established by this title. If any area is not shown on the official zoning map as being included in any district, it shall be deemed to be in the R-1 residential district. (Ord. 99-06, 6-21-1999)

9-6-4: ANNEXATIONS:

   (A)   Whenever territory is added to the village by annexation, the zoning for such territory (including, but not limited to, its zoning district classification, special uses, and variations) may be established by means of a preannexation agreement, as provided by law; provided that all otherwise applicable regulations and procedures of this title have been complied with prior to the execution of said preannexation agreement.
   (B)   Whenever any parcel of land is hereafter annexed to the village, in any manner whatsoever, such territory, upon annexation, shall be classified or zoned under this title as an R-1 district, except as may be provided for by a preannexation agreement or an annexation agreement after public hearing by the planning commission.
