To preserve the historical characteristics and heritage of the traditional central commercial area of the village, which by its nature requires special regulation design to enhance the area and ensure that future development or redevelopment is not incompatible with the historical character of the area. The area included within this district has historical significance as being the commercial business center of the village as it was originally laid out. (Ord. 99-06, 6-21-1999)

To achieve the purpose of commercial districts and preserve the C-1 downtown commercial district, it shall be the policy of the village to:

   (A)   Ensure that all redevelopment or new development is consistent in appearance with surrounding buildings and historical characteristics of the area.

   (B)   Promote sound community planning to preserve the heritage, aesthetic interest, values, and customs related to the historic significance of the area.

   (C)   Preserve the economic stability of retail trade and personal service business of the traditional downtown commercial district. (Ord. 99-06, 6-21-1999)

No land shall be used or occupied and no building, structure, or premises shall be erected, altered, enlarged, occupied or used, except as otherwise provided in this title for other than one or more of the following uses:

   Business service establishments:

   Banks.

   Business and management consultants.

   Business office.

   Chamber of commerce.

   Charitable organization.

   Civic association.

   Credit agency.

   Currency exchange.

   Employment agency.

   Financial institution.

   Insurance agency.

   Investment carrier.

   Investment company.

   Labor union and organization.

   Loan agency.

   Mail order house.

   Merchants association.

   News syndicate.

   Newspaper office.

   Parking lot, commercial.

   Picture framing.

   Professional membership association.

   Radio and television service and repair.

   Real estate office.

   Savings and loan.

   Security and commodity broker.

   Social service and fraternal association.

   Theater, indoor only.

   Trade association.

   Video rental establishments, including repair of video equipment.

   Personal service establishments which perform services on the premises:

      Beauty parlor.

      Dry cleaner.

      General minor repair or fix it shop, excluding automobile repair.

      Health and fitness club.

      Interior decorating shop, including upholstering and drapery making.

      Laundry.

      Meeting hall.

      Schools or studios for art, music or dance.

      Tailor or dressmaker.

      Tanning parlor.

      Travel bureau.

      Undertaking establishment and funeral parlor.

   Professional office establishments:

      Accounting, auditing and bookkeeping.

      Artists and industrial designers.

      Attorney and law office.

      Chiropractor's office.

      Dentist's office.

      Doctor's, surgeon's and/or physician's office.

      Engineering and architectural services.

      Land surveyors.

   Medical and dental clinics.

   Optician's office.

   Osteopath's office.

   Private clinic.

   Professional consultants.

   Professional offices.

   Public, quasi-public and governmental buildings and facilities:

      Churches.

      Essential services (as defined in chapter 2 of this title).

      Government buildings and facilities.

      Museum, art gallery.

      Office building.

      Post office.

   Public utility establishment.

   Retail businesses – alcohol sales and consumption, as permitted by the liquor commissioner.

   Retail businesses which supply commodities on the premises:

      Antique store.

      Apparel store.

      Appliance store.

      Art and school supply store.

      Art gallery.

      Bakery, in which the manufacture of goods is limited to goods retailed on the premises only.

      Bicycle store – retail, rental and repair.

      Book and stationery store.

      Business machine store.

      Camera store and photographic store.

      Candy and confectionery store.

      China and glassware store.

      Clothing and costume rental stores.

      Dairy products store.

      Delicatessen.

      Department store.

      Drapery store.

      Drugstore.

      Dry goods store.

      Floor coverings, including rugs and carpets.

      Floral shop.

      Furniture store.

      Garden supply, tool and seed stores.

      General retail store.

      Gift shop.

      Grocery and food store.

      Hardware store.

      Hobby shop.

      Ice cream store.

      Leather goods and luggage store.

      Linoleum and tile store.

      Merchandising machines, sale of products.

      Office supplies and stationery store.

      Orthopedic and medical appliance supply store.

      Paint and wallpaper store.

      Pet shop.

      Photography studio.

      Plumbing and heating shop.

      Radio and television sales.

      Record shop.

      Restaurants.

      Shoe store.

      Sporting goods store.

      Tobacco shop.

      Toy store.

The following uses shall be permitted only if specifically authorized by the Board as allowed in chapter 14 of this title:

   Automobile parts and supply store, automobile repair (minor), automobile sales.

   Bars, taverns, and cocktail lounges as permitted by the Liquor Commissioner.

   Billiard and pool hall.

   Drive-in banking and saving and loan facilities.

   Drive-in restaurants.

   Drive-in uses.

   Gun dealer/shooting range.

   Hotel/Motel.

   Laboratories, medical and dental.

   Nursery school, day nursery, and childcare center.

   Planned commercial development group.

   Residence when behind or on the second floor of a commercial establishment.

Upon application to and issuance by the Code Enforcement Officer of a permit, the following uses may be operated as temporary uses:

   Christmas tree sales, each such permit shall be valid for a period of not more than sixty (60) days.

   Parking lot designated for a special event; provided, however, that each permit shall be valid only for the duration of the designated special event.

   Temporary building, trailer or yard for construction materials and/or equipment, both incidental and necessary to construction in the zoning district. Each permit shall specify the location of the building or yard and the area of permitted operation. Within any development, each such permit shall be valid for a period of six (6) calendar months and shall not be renewed for more than one additional period.

   Temporary mobile signs as provided in chapter 13 of this title.

   Temporary office, both incidental and necessary for the sale or rental of real property. Each permit shall specify the location of the office and the area of permitted operation. Each such permit shall be valid for a period of not more than one year and shall not be renewed for more than two (2) successive periods at the same location. (Ord. 99-06, 6-21-1999)

Accessory uses, buildings, or other structures and devices customarily incidental to and commonly associated with a permitted use or special use may be permitted, provided they are operated and maintained under the same ownership, on the same zoning lot, and do not include structures or features inconsistent with the permitted use or special use. See section 9-3-6 of this title for additional requirements. (Ord. 99-06, 6-21-1999)

All uses not expressly authorized in sections 9-8A-3 through 9-8A-6 of this article, inclusive. (Ord. 99-06, 6-21-1999)

   (A)   Minimum Lot Area: Six thousand (6,000) square feet of separate ground area shall be provided for each parcel containing a permitted or special use.

   (B)   Minimum Lot Frontage: A minimum lot frontage of forty feet (40') shall be provided for each parcel used for a permitted or special use.

   (C)   Yards:

      1.   Front Yard: All structures shall be set back the same distance as the setback from the front lot line as the structures located on adjacent parcels and as approved by the Code Enforcement Officer.

      2.   Side Yard: No side yards shall be required except ten feet (10') shall be provided where the side yard abuts an R zone unless zones are divided by a street or alley. However, in all cases, adequate provision for maintenance of side walls and internal vehicular circulation shall be made.

      3.   Rear Yard: All structures shall be set back at least ten feet (10') from the rear lot line. Rear yards that abut an R zone shall provide twenty five feet (25') except where zones are divided by a street or alley.

   (D)   Maximum Height: No structure or portion thereof shall exceed a height of thirty five feet (35').

   (E)   Floor Area Ratio: Not to exceed one hundred percent (100%).

   (F)   Maximum Lot Coverage: Principal building and any accessory structures combined may not exceed fifty percent (50%). The balance of the lot shall be used for, but not limited to, parking, open space and yard recreation space.

   (G)   Maximum Area Coverage: Including all buildings, structures, sidewalks, parking areas or other hard surface not to exceed eighty percent (80%). The balance of the lot shall be used for, but not limited to, open space and yard recreation space. (Ord. 99-06, 6-21-1999)

   (A)   Outdoor Storage: No outdoor storage shall be permitted.

   (B)   Parking Requirements: In accordance with the applicable regulations set forth in chapter 12 of this title.

   (C)   Sign Requirements: In accordance with the applicable regulations set forth in chapter 13 of this title.

   (D)   Scope Of Operations: All business establishments shall be retail trade or service establishments dealing directly with consumers. All business, servicing or processing, except for off street parking or loading, shall be conducted within completely enclosed buildings. The Village Board may waive this provision by designating certain days on which business establishments may conduct their businesses outside the building or structure.

   (E)   Screening: Where a commercial or office use abuts or is across the street from a residential district, adequate screening shall be provided as set forth in section 9-3-5 of this title. Any screening required of service yards or other areas which tend to be unsightly shall be accomplished by walls, fencing, planting, or a combination of these as outlined in section 9-3-5 of this title. Screening must enhance architectural features and strengthen vista along important ways of approach or entry.

   (F)   Lighting: Lighting of the facility and parking areas shall be directed away from surrounding properties, and shall meet specifications as set by the Code Enforcement Officer. (Ord. 99-06, 6-21-1999)

   (A)   To promote areas which primarily serve the needs of motorists in a manner conducive to generating business development.

   (B)   To promote regulations for highway associated uses through adequately sized parcels of land allowing for setbacks, clear vision and safe ingress and egress. (Ord. 99-06, 6-21-1999)

To achieve the purpose of the C-2 commercial district, it shall be the policy of the village to:

   (A)   Promote the grouping of C-2 uses to major thoroughfares and to discourage the hazards to safety and nuisance of traffic congestion along public streets.

   (B)   Require adequate off street parking and limited access to road through the use of frontage roads. (Ord. 99-06, 6-21-1999)

No land shall be used or occupied and no building enlarged, occupied, or used, except as otherwise provided in this title, for other than one or more of the following specified uses:

   Any use allowed in the C-1 traditional downtown district.

   Business service establishment which performs services on the premises:

   Automobile diagnostic center or clinic.

   Automobile repair, minor.

   Automobile undercoating establishment.

   Bowling alley.

   Equipment rental and leasing service.

   Funeral home.

   Lawn mowing repair service.

   Motel/Hotel.

   Motorcycle service and repair.

   Public, quasi-public and governmental buildings and facilities:

      Ambulance service.

      "Essential services", as defined in chapter 2 of this title.

      Lodge or fraternal organizations.

      Public, quasi-public and governmental buildings and facilities permitted in the C-1 district.

   Public service or municipal garage.

   Retail business – alcohol sales and consumption, subject to approval by the liquor commissioner:

      Ancillary use in restaurants. Establishments serving meals in a permanent building other than "drive-ins" with the serving of alcohol drinks from only a service bar as an ancillary use not exceeding fifty percent (50%) of the retail sales of the establishment.

      Package liquor sales.

   Retail business, which supplies commodities on the premises:

      Agriculture implement sales and service.

      Automobile accessories, parts, and supplies stores.

      Boat sales and rentals.

      Building services and supplies.

      Camper sales.

      Motor vehicle dealer and motor home dealer.

      Motorcycle sales.

      Restaurants.

      Tire, battery, and accessory dealer.

The following uses shall be permitted only if specifically authorized by the Board as allowed in chapter 14 of this title:

Adult oriented establishments, as identified and under specific additional regulations of section 9-3-10 of this title.

Airports.

Animal hospital.

Assisted living center.

Automobile laundry or car wash.

Automobile service station.

Automotive repair, major.

Bars, taverns, and cocktail lounges as approved by the Liquor Commissioner.

Commercial recreational uses.

Drive-in restaurants, drive-in banks, and other drive-in uses when acting as a primary use in itself and not accessory to a permitted or special use.

Drive-in uses.

Gun dealer/shooting range.

Hospitals.

Lumberyard.

Miniwarehouses for private storage.

Mobile home dealer.

Outdoor storage. All outdoor storage facilities for fuel, raw materials and products shall be enclosed by a fence, wall, or plant materials adequate to conceal such facilities from adjacent properties and the public right-of-way.

Planned Unit Developments, as authorized by Chapter 4 of this title, provided the uses therein shall be limited to those allowed as permitted and/or special uses in the C-2 Commercial District or as a mixed-use development and limited to those uses allowed as permitted and/or special uses in the C-2 Commercial District and multiple-family residential uses.

Residence, secondary to the business use of the premises and not located below the second floor above ground level of the building.

Tattoo parlors.

Upon application to and issuance by the Code Enforcement Officer of a permit, the following uses may be operated as temporary uses: C-1 District temporary permitted uses. (Ord. 99-06, 6-21-1999)

Accessory uses, buildings or other structures and devices customarily incidental to and commonly associated with a permitted use or special use may be permitted, provided they are operated and maintained under the same ownership, on the same permitted use or special use.    (A)   Minimum Lot Area: Forty thousand (40,000) square feet of separate ground area shall be provided for each parcel used for a permitted or special use.

   (B)   Minimum Lot Frontage: A minimum lot frontage of one hundred twenty feet (120') shall be provided for each parcel used for a permitted or special use. Corner lots shall have a minimum of one hundred forty four feet (144') of lot width.

   (C)   Yards:

      1.   Front Yard: All structures shall be set back at least thirty feet (30') from the front lot line.

      2.   Side Yard: All structures shall be set back at least five feet (5') from the side lot line.

      3.   Rear Yard: All structures shall be set in from the rear lot line a distance of not less than fifty feet (50').

      4.   Transitional Yard: Where properties in the C-2 District are adjoining other zoning districts or across road right-of-way from other zoning districts, the required yards shall be at least equal in dimension to the adjoining yards in the adjoining district(s) or the front yards in the district(s) separated from the property by road right-of-way. Where yards in the C-2 District exceed the requirements of the adjoining district(s), the yards of the C-2 District shall apply.

   (D)   Maximum Height: No structure or portion thereof, shall exceed a height of thirty five feet (35'), and no accessory structure shall exceed fifteen feet (15') in height.

   (E)   Floor Area Ratio: Not to exceed one hundred percent (100%).

   (F)   Maximum Lot Coverage: Principal building not to exceed thirty percent (30%). The total of all accessory buildings not to exceed ten percent (10%).

   (G)   Maximum Area Coverage: Including all buildings, structures, sidewalks, parking areas or other hard surface not to exceed eighty percent (80%). The balance of the lot shall be used for, but not limited to, open space and yard recreation space.

   (H)   Minimum Landscaped Area: Two percent (2%) of the total square footage of the real property shall be set aside as a decorative landscaped area on the street side. (Ord. 99-06, 6-21-1999)

   (A)   Outdoor Storage: Shall not be placed within any required front or side yard and shall be set back at least ten feet (10') from the rear lot line.

   (B)   Outdoor Sales: All outdoor sales space shall be provided with a permanent durable concrete or asphalt surface, and shall be graded and drained as to dispose of all surface water.

   (C)   Parking Requirements: In accordance with the applicable regulations set forth in chapter 12 of this title.

   (D)   Sign Requirements: In accordance with the applicable regulations set forth in chapter 13 of this title.

   (E)   Waste Materials: No materials or wastes shall be deposited upon a lot in such a form that they may be transferred off the property by natural causes or forces.

   (F)   Screening: Where a commercial or office use abuts or is across the street from a residential district, adequate screening shall be provided as set forth in section 9-3-5 of this title. Any screening required of service yards or other areas which tend to be unsightly shall be accomplished by walls, fencing, planting or a combination of these as outlined in section 9-3-5 of this title. Screening must enhance architectural features and strengthen vistas along important ways of approach or entry.

   (G)   Lighting: Lighting of the facilities and parking areas shall be directed away from surrounding properties, and shall meet specifications as determined by the Code Enforcement Officer.

   (H)   Performance Standards: Commercial establishments shall comply with the provisions of performance standards as outlined in chapter 9, article C of this title. (Ord. 99-06, 6-21-1999)
