11-1-2: PURPOSE:
The purpose of this title is to establish zone districts and regulations governing the development and use of land within the city in order to preserve, protect, and promote the public health, safety, and welfare in accordance with 65 Illinois Compiled Statutes 5/11-13-1 et seq. (Ord. 1148, 4-27-1987, eff. 6-1-1987; amd. 2013 Code)
11-1-3: JURISDICTION:
A. This title shall be applicable within the corporate limits of the city and within one and one-half (1.5) miles of the corporate limits of the city. (Ord. 1148, 4-27-1987, eff. 6-1-1987)
B. No general or specific zoning classification of any type or form which is or may be imposed under and by virtue of this title shall apply to or affect, in any regard, the lands and territory contained within the county regional airport authority; these lands and territories being specifically and expressly excluded from coverage by this title. Neither by the express or implicit language of this title shall the perimeter zoning of the city extend unto the lands and territory of the county regional airport authority, as the same coverage shall be and is hereby expressly excluded therefrom. 11-1-4: INTERPRETATION AND APPLICATION:
A. Every provision of this title shall be construed liberally in favor of the city, and every requirement imposed herein shall be deemed minimal. Whenever the requirements of this title differ from the requirements of any other lawfully adopted and effective ordinance, regulation, deed restriction, or covenant, the more stringent requirement shall prevail. Regardless of any other provision of this title, no land shall be used and no structure shall be erected or maintained in violation of any duly constituted laws of the state of Illinois or of the United States Of America.
B. If any provision of this title is declared unconstitutional or invalid by a court of competent jurisdiction, that decision shall not affect the validity of the remainder of this title. (Ord. 1148, 4-27-1987, eff. 6-1-1987)
11-1-5: COMPLIANCE REQUIRED:
Except as specifically provided in this title, no building, structure, or land shall be used and no building, structure, or part thereof shall be erected, constructed, reconstructed, occupied, moved, altered or repaired, except in conformity with this title. (Ord. 1148, 4-27-1987, eff. 6-1-1987)
11-1-6: DISCLAIMER OF LIABILITY:
Except as may be provided otherwise by statute or ordinance, no official, city council member, agent, commission or board appointee, or employee of the city shall render himself personally liable for any damage that may occur to persons or property as a result of any act required or permitted in the discharge of duties under this title. Any such person made a party to a civil action, civil rights or constitutional rights damage action, or antitrust action by reason of the discharge of said duties shall be held harmless and indemnified by the city for all damages and attorney fees incurred; provided, that: a) the person makes a timely disclosure of the litigation or threatened litigation to the city; and b) the person authorizes the city to provide primary representation through the city attorney in such litigation or threatened litigation and cooperates with the city in the primary presentation. The city will not indemnify such person for punitive damages assessed against the person nor pay attorney fees incurred by the person for counsel not retained by the city. Said indemnification shall be against all judgments, fines, amounts paid in settlements, and reasonable expenses incurred resulting from any such action or proceeding, or any appeal, to the fullest amount permitted by the laws of the state of Illinois. The foregoing statement of indemnification is deemed to be a contract between the city and each city official, city council member, agent, commission or board appointee, or employee with explicit or implied responsibilities under the provisions of this title.
