SHOPPING DISTRICTS

§ 156.205 APPLICATION OF PROVISIONS.

   (A)   The following regulations set out in this subchapter shall apply to all C-2 Districts and shall be subject to the provisions of §§ 156.310 through 156.322, 156.335 through 156.345 and 156.360 through 156.364 of this chapter.
   (B)   The purpose of C-2 Community Shopping Districts is to allow commercial retail stores, commercial establishments, service establishments and professional offices that generate sales tax revenues, maintain the city’s property tax base and allow for convenient locations for the members of the public in the broader city community to shop, obtain services and conduct business. The regulations concerning the C-2 Community Shopping Districts are to be construed to prohibit all uses that are property tax exempt.

§ 156.206 PERMITTED AND SPECIAL USES.

   (A)   The following uses are permitted in a C-2 District:
      (1)   Any uses permitted and regulated in C-1 Districts;
      (2)   Art or antique shop;
      (3)   Automobile sales and service conducted wholly within a completely enclosed building;
      (4)   Bank;
      (5)   Bowling alley and billiards;
      (6)   Contractors, offices only (builders, carpenters, electricians and the like);
      (7)   Confectionery store;
      (8)   Department, furniture or radio store, dress shop sales;
      (9)   Interior decorating store;
      (10)   Laundry (self-service and pickup agency);
      (11)   Liquor store;
      (12)   Men’s and women’s clothing sales;
      (13)   Money exchange;
      (14)   Music store;
      (15)   Newsstand or book shop;
      (16)   Non-manufacturing commercial laboratories;
      (17)   Photographic materials shop and/or photographic studio;
      (18)   Tailor and dressmaker;
      (19)   Tavern, cocktail lounge;
      (20)   Undertaking establishment;
      (21)   Upholstery shop;
      (22)   Veterinarian (wholly within enclosed building); and
      (23)   Household appliance shop.
   (B)   The following uses are special uses in the C-2 District:
      (1)   The sale at retail of used automobiles other than within a completely enclosed building where such activity is carried on ancillary to and in connection with the sale at retail of new automobiles conducted wholly within a completely enclosed building;
      (2)   Movie theater; and
      (3)   Cannabis dispensary.

§ 156.207 DISTRICT RESTRICTIONS.

   (A)   The district restrictions specified in the C-1 Districts shall apply to the C-2 Districts as if the same were set forth in this subchapter; except that, no more than ten persons shall be engaged at any one time in the fabrication, repair and other processing of materials.
   (B)   This provision, however, shall not apply to the preparation of food in restaurants, cafés or soda fountains.

§ 156.208 YARD SPECIFICATIONS.

   (A)   Where all frontage is located in the C-2 District, a front yard of a minimum of ten feet in depth shall be required.
   (B)   There shall be a rear yard of not less than 20 feet in depth, which shall be fenced and screened from view.
   (C)   A side yard is not required, except where such use abuts upon the side of a lot in an R District, in which case there shall be a side yard on the lot in the C-2 District, the same as specified for the adjacent R District, and in addition shall be fenced and screened from the view from any adjacent lot in the R District.

§ 156.209 BUILDING HEIGHT LIMITATION.

   No building shall be erected or allowed to exceed 30 feet in height.
