(1) Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined according to the provisions of section
1-5 of the Code of Ordinances. Each day that a violation is permitted to exist shall constitute a separate offense.
(2) In case any building or structure, including fixtures, is constructed, reconstructed, altered, repaired, converted or maintained, or any building or structure, including fixtures, or land, is used in violation of this zoning ordinance or of any regulation made under the authority conferred hereby (except for setback line violations which shall be proceeded under subsection (3)), the proper authorities of the city, or any owner or tenant of real property within one thousand two hundred (1,200) feet in any direction of the property on which the building or structure in question is located who shows that the owner or tenant's property or person will be substantially affected by the alleged violation, in addition to other remedies, may institute any appropriate action or proceeding to:
(a) Prevent the unlawful construction, reconstruction, alteration, repair, conversion, maintenance or use;
(b) Prevent the occupancy of the building, structure or land;
(c) Prevent any illegal act, conduct, business or use in or about the premises; or
(d) Restrain, correct or abate the violation.
When any such action is instituted by an owner or tenant, notice of such action shall be served upon the city at the time suit is begun, by serving a copy of the complaint on the mayor of the city, and no such action may be maintained until such notice has been given (65 ILCS 5/11-13-15).
(3) In case any structure is erected or constructed in violation of the setback line requirements of this zoning ordinance, the proper officers of the city, in addition to other remedies, may institute any appropriate action or proceeding to:
(a) Prevent the unlawful erection or construction;
(b) Restrain, correct, or abate the violation;
(c) Prevent the occupancy of the structure; or
(d) Prevent any illegal act, conduct, business or use in or about the premises (65 ILCS 5/11-14-4).
