ARTICLE V

RESIDENTIAL DISTRICTS

Section 5.1. Purpose of the residential districts.

The primary purpose of residential districts are to promote a harmonious environment for family living and to such extend the following prohibitions and actions are taken to:
      (1)   Prohibit business, commercial or industrial use of the land, and to prohibit any other use which would substantially interfere with development or continuation of one-family dwellings in the district.
      (2)   Encourage the discontinuance of existing uses that would not be permitted as new uses under the provisions of this ordinance.
      (3)   Discourage any land use which would generate traffic on minor local streets other than normal traffic to serve the residences on those streets.
      (4)   Discourage any use which, because of its character or size, would create requirements and costs for public services, such as fire and police protection, water supply and sewerage, substantially in excess of such requirements and costs if the district were developed solely for one-family dwellings.

Section 5.2. Signs in residential districts.

Signs located in R-1, R-3 and R-4 residential districts shall conform to the requirements of the Marshall Sign Code.

Section 5.3. R-1 districts: One-family residential - Principal permitted uses.

In the R-1 one-family residential district, no land or structure shall be used, and no structure or building shall hereafter be erected or structurally altered, except for uses listed as permitted by right in the R-1 one-family residential district as listed in article VIII.

Section 5.4. Same - Special uses.

Special uses as listed for the R-1 one-family residential district in article VIII in accord with the conditions provided in this article and in accord with the procedures specified in article X.

Section 5.5. Same - Schedule of regulations.

      (1)   For regulations pertaining to allowable building height, size, density and area, refer to article IX.
      (2)   Some dwellings and lots within R-1 one-family residential district may not meet the building lot size, area and bulk requirements set forth in the schedule of regulations. Dwellings already built and lots already platted and recorded at the date of adoption of this ordinance (November 25, 2002) that do not meet the requirements of the schedule of regulations are treated as legal nonconforming lots and structures under this ordinance. Such uses may be continued but their enlargement is restricted (See article XIV.)

Section 5.7. R-3 districts: Two-family residential - Principal permitted uses.

In the R-3 two-family residential district, no land or structure shall be used, and no structure or building shall hereafter be erected or structurally altered, except for uses as permitted by right in the R-3 two-family residential districts as listed in article VIII.

In the R-4 multiple-family residential districts, no land or structure shall be used, and no structure or building shall hereafter be erected or structurally altered, except for uses permitted by right in the R-4 multiple-family residential districts as listed in article VIII.
