Non-Conforming Uses And Structures

Section 405.390 Lawful Use Existing Prior To Zoning Regulations.

The lawful use of a building existing at the adoption of this Chapter may be continued even though such does not conform with the provisions hereof.

Section 405.400 Use Of Building Becomes Non-Conforming Due To Zoning Change; Procedure.

Whenever the use of a building becomes nonconforming through a change in the zoning ordinance or district boundaries, such use may be continued as long as it remains used in that manner.

Section 405.410 Nonconforming Use May Change To A More Restricted Use; How.

If no structural alterations are made, a nonconforming use of a building may be changed to another nonconforming use of the same or more restricted classifications. Whenever a nonconforming use of a building has been changed to a more restricted use or to conforming use, such shall not thereafter be changed to a less restricted use.

Section 405.420 Damaged Nonconforming Building Or Use May Be Restored.

When a nonconforming building or use, is damaged either partially or wholly by fire, act of God, or the public enemy, it may be restored.

Section 405.430 Nonconforming Uses Not To Be Enlarged Or Extended.

No such nonconforming use shall be enlarged or increased nor extended to occupy a greater area of land than was occupied at the effective date of adoption or amendment of this Chapter.

Section 405.440 Nonconforming Use Discontinued; Procedure.

In the event that a nonconforming use of any building or premises is discontinued, or its normal operation stopped, for a period of six (6) months, the new use must be a permitted use listed in this Chapter for the zoning classification in that area the buildings are in.

Section 405.450 Nonconforming Use In Portion Of Building May Be Extended.

A nonconforming use occupying only a portion of a building may be extended throughout the building.

Section 405.460 Ordinary Repairs To Nonconforming Use.

On any building or structure devoted in whole or in part to any nonconforming use, work may be done in any period of twelve (12) consecutive months on ordinary repairs, or on repair or replacement of non-bearing walls, fixtures, wiring or plumbing, to an extent not exceeding thirty-three percent (33%) of the building as it existed at the time of passage or amendment of this Chapter.

Section 405.470 Nonconforming Manufactured Home.

Any manufactured home that does not comply with the HUD Manufactured Home Construction and Safety Standards of 1976, from and after the effective date of this Chapter, shall be considered a nonconforming use of the land under the provisions of this Chapter; provided, however, that the owner occupying the existing manufactured home may replace said dwelling unit with a newer model manufactured home that meets the "HUD" cited above.
