ARTICLE XII

Screening and Fencing

§ 430-89 Purpose; permit required for fence or wall.

A. 
This article is established to recognize the public and private benefits accrued from functional and aesthetic screening and fencing between areas of incompatible land uses, the increasing demand for active and passive recreational areas, and the desirability of providing visual screening of certain parking lots and zoning districts.
B. 
No person shall construct a fence or wall in the City without first obtaining a permit from the Building Inspector. Application for a permit shall be filed with the Building Inspector on a form supplied by the Inspector, together with a sketch of the proposed fence and the payment of the required fee as set by Council resolution.[1]

§ 430-90 Off-street parking and loading areas.

All open off-street parking areas containing more than three spaces, and all open off-street loading areas, shall have effective screening on each side adjoining or fronting on any residential district or any public street.

§ 430-91 District boundary lines.

Any property covered under the provisions of §§ 430-41 through 430-46 may be required to have effective screening along lot lines adjoining any residential district. The type of screening or fencing shall be erected, placed or maintained as deemed acceptable to the Plan Commission.

§ 430-92 Height and location of screening and fencing.

A. 
Fencing, including retaining walls, shall be erected not less than three feet off the property line.
B. 
The maximum height of any fence located in the rear yard or side yard shall be six feet.
C. 
The maximum height of any fence located within a street yard shall be four feet six inches.
D. 
No fencing or screening shall be located nearer than one foot to any public right-of-way.
E. 
Any screening or fencing erected, placed, maintained or grown in a street yard and located less than four feet from the street right-of-way shall not exceed a height greater than four feet six inches as measured from the curb level or its equivalent. Any screening or fencing within 10 feet from any point where a driveway crosses the street right-of-way shall not exceed two feet in height.[1]

F. 
Dog pens and runs shall be erected in the rear yard only and shall be located at least 20 feet from any property line.[2]

§ 430-93 Security fences.

Security fences are permitted on the property lines in all districts except residential districts but shall not exceed 10 feet in height and shall be of an open type similar to woven wire or wrought iron fencing.

§ 430-94 Existing conditions; exemptions.

The Plan Commission may modify the provisions for the requirements of screening and fencing when suitable screening and fencing exist on abutting property or when it determines that such modifications for screening or fencing shall be in harmony with the general purpose and intent of this article.
