Mccall City Zoning Code

CHAPTER 1

AUTHORITY AND PURPOSE

3.1.01: AUTHORITY TO ENACT ZONING REGULATIONS:

This title is enacted pursuant to article XII, section 2 of the constitution of Idaho, and title 67, chapter 65 of the Idaho Code, which empower the city to exercise the police power and to enact a zoning ordinance and to provide for its administration, enforcement and amendment. This title may be cited and referred to as the ZONING ORDINANCE FOR THE CITY OF McCALL. (Ord. 821, 2-23-2006, eff. 3-16-2006)

3.1.02: PURPOSE OF ZONING REGULATIONS:

The purpose of this title (title III) shall be:
   (A)   To maintain and promote the small town character and attraction of the planning jurisdiction, and the natural beauty of the surrounding lands and lakeshore, present and future, for residents and visitors.
   (B)   To ensure that all physical growth is carried out in an orderly way and in a way which complements the landscape, ecology and existing urban character of McCall.
   (C)   To regulate the use of land, and the use, height, location and size of buildings and structures.
   (D)   To implement the McCall area comprehensive plan.
   (E)   To facilitate the provision of public services and to promote and protect the health, safety and welfare of all residents and visitors. (Ord. 821, 2-23-2006, eff. 3-16-2006)

3.1.03: AFFECTED LANDS:

This title applies to all land within the boundaries of the city of McCall, and to all land within the boundaries of the city of McCall area of city impact, both of which areas are commonly referred to together in this title as the planning jurisdiction, including, but not limited to, any lands that may after March 16, 2006, become part of the city of McCall or of the impact area. 3.1.04: AREA OF CITY IMPACT IDENTIFIED:

The land and water areas included within the boundaries set out in the most recent city and county ordinances fixing the same boundary of the city of McCall area of city impact, is the area of city impact referred to in this title and to which, along with lands in the city proper, this title applies. Copies of a map of the impact area shall be on file for use and examination by the public in the office of the city clerk; the current such map is labeled:
   McCall, Idaho
   Area of City Impact

3.1.05: APPLICATION OF REGULATIONS:

   (A)   Conformance Required: Except as herein specified, no land, building, structure or premises, and no part thereof, shall hereafter be used, and no building or part thereof, or other structures, shall be located, erected, moved, reconstructed, extended, enlarged or altered except in conformity with the requirements herein specified for the zone in which it is located; nor shall any yard, lot or open space be reduced in dimensions or area to an amount less than the minimum requirements set forth herein.
   (B)   Conflicting Provisions: In case of a conflict between the provisions of various sections of this title, the more restrictive provisions shall prevail. (Ord. 821, 2-23-2006, eff. 3-16-2006)

3.1.06: ESTABLISHMENT OF ZONING DISTRICTS:

In order to carry out the provisions of this title, the following zones and overlay zones are created for the city of McCall, and the lands within the city are placed into one or more of these zones as depicted on the zoning map or, in the case of overlay districts, as defined in this title. The provisions of this title respecting an overlay district are cumulative with, not in lieu of, the provisions respecting the underlying zoning district. In the event there is a difference between the provisions of this title applied within an overlay district and the provisions of this title applied within the underlying zoning district, the more restrictive provisions will apply.
   (A)   Rural residential (RR) zone: See chapter 3, "Residential Zones And Standards", of this title.
   (B)   Residential, estate (RE) zone: See chapter 3, "Residential Zones And Standards", of this title.
   (C)   Residential, one dwelling unit per acre (R1) zone: See chapter 3, "Residential Zones And Standards", of this title.
   (D)   Residential, four (4) dwelling units per acre (R4) zone: See chapter 3, "Residential Zones And Standards", of this title.
   (E)   Residential, eight (8) dwelling units per acre (R8) zone: See chapter 3, "Residential Zones And Standards", of this title.
   (F)   Residential, sixteen (16) dwelling units per acre (R16) zone: See chapter 3, "Residential Zones And Standards", of this title.
   (G)   Neighborhood commercial (NC) zone: See chapter 4, "Commercial Zones And Standards", of this title.
   (H)   Community commercial (CC) zone: See chapter 4, "Commercial Zones And Standards", of this title.
   (I)   Central business district (CBD) zone: See chapter 4, "Commercial Zones And Standards", of this title.
