Mcgregor City Zoning Code

ARTICLE 1

- GENERAL PROVISIONS

Sec. 1.1. - Title.

This ordinance shall be known as the "Zoning Ordinance of the City of McGregor, Texas".

Sec. 1.2. - Purpose.

The zoning regulations and zoning districts adopted by this ordinance have been adopted in accordance with the Comprehensive Plan of the City of McGregor for the purpose of promoting the health, safety, morals, and general welfare of the City. These regulations are designed to lessen congestion in the streets; to secure safety from fire, panic, and other dangers; to provide adequate light and air; to prevent the overcrowding of land; to avoid the undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, schools, parks, and other public facilities. These regulations have been adopted with reasonable consideration of the character of each zoning district and its suitability for particular uses, and with a view toward conserving the value of building and encouraging the most appropriate use of land throughout the city.

Sec. 1.3. - Intent.

It is the intent of this ordinance, in order to accomplish the purposes set forth in Section 1.2 above to direct development and redevelopment in the city in accordance with the goals, objectives, and policies of the McGregor Comprehensive Plan as it is continually updated by the City Council and the Planning and Zoning Commission of said city; to encourage the most appropriate use of land through the adoption of zoning districts, planned development regulations, and special business districts appropriate to the city and its unique needs; to ensure continuation of the zoning ordinances adopted by the City of McGregor and followed therein from January of 1955 to the date of the adoption of this modification; to provide adequate standards to maintain and improve the development and redevelopment of land through lot area, yard, land use intensity, and building bulk, size and height standards; and to provide for the simplified and coordinated administration and enforcement of this ordinance so that it will be fairly administered and the development review process expedited.

Sec. 1.4. - Official Zoning Map.

The boundaries of zoning districts set out herein are delineated upon the Official Zoning Map of the city, adopted as part of this ordinance as fully as if the same were set forth herein in detail.

A.

Original of Official Zoning Map. One original of the Official Zoning Map shall be filed at the City of McGregor municipal offices and shall be dated and bear the signature of the Mayor and attestation of the City Secretary. This original shall be updated to show zoning district boundary changes only after zoning changes are approved by ordinance in conformance with the procedural requirements of the State of Texas and this ordinance. In case of any question, this copy, together with amending ordinances, shall be controlling.

Copies of Official Zoning Map. An additional copy of the Official Zoning Map shall be placed in the office of the Building Official. The copy shall be used for reference and shall be maintained up-to-date by posting thereon all subsequent zoning changes and shall be identified as the official zoning map. Reproductions for informational purposes may be made of the Official Zoning Map.

Sec. 1.5. - Compliance required.

All land, buildings, structures or appurtenances thereon located within the City of McGregor, Texas which are hereafter occupied, used, erected, altered, removed, placed, demolished, or converted shall be occupied, used, erected, altered, removed, placed, demolished or converted in conformance with the zoning regulations prescribed for the zoning district in which such land or building is located as hereinafter provided or subject to penalties as per this ordinance.

Sec. 1.6. - Severability/savings clause.

Should any section, paragraph, subdivision, clause, phrase, or provision of this ordinance be adjudged invalid or held unconstitutional or invalid, the validity and constitutionality of any remaining section and provision and the validity and constitutionality of the ordinance as a whole shall not be affected.

Sec. 1.7. - Penalty for violation.

Any person or corporation who shall violate or fail to comply with any of the provisions of this ordinance or regulations adopted under it, or who shall build or alter any building or use in violation of any detailed statement or plan submitted and approved hereunder, shall be guilty of a misdemeanor. Each day such violation shall continue to exist shall constitute a separate violation. For each violation a fine of not more than two thousand dollars ($2000.00) may be imposed. The owner or owners of any building or premises or part thereof, where anything in violation of this ordinance shall be placed or shall exist, and any architect, builder, contractor, agent, person, or corporation employed in connection therewith and who may have assisted in the commission of any violation shall be guilty of a separate offense, and upon conviction, shall be fined as herein provided.
