CHAPTER 4

COMMERCIAL AND INDUSTRIAL ZONES

10-4A-1: PURPOSE:

The purpose of the C-1 commercial zone is to provide local commercial service needs and to restrict incompatible uses which may be better located in community or highway oriented shopping areas due to size of the shopping center, location within the community, residential neighborhood areas being served and other factors. 10-4A-2: USES ALLOWED:

The following uses are allowed in the C-1 zone:
Accessory uses to uses allowed.
Automobile service station.
Boarding and rooming houses.
Clinics.
Commercial and private off street parking lots for passenger automobiles.
Government or public utility facilities of a nonindustrial character.
Mortuaries.
Motel.
Nursery school; school for students of art, dancing, dramatics, music, business or secretarial work.
Radio, television and FM broadcasting stations, including aerials when made an integral part of a principal building.
Retail stores and retail or personal service.

10-4A-3: CONDITIONAL USES PERMITTED:

The planning and zoning commission may, after proper notice and public hearing as prescribed in chapter 9 of this title, permit the following uses where such uses are deemed essential or desirable to the public convenience or welfare. The commission shall have the authority to impose such conditions and safeguards as it deems necessary to protect the best interest of the surrounding property or neighborhood from damage, hazard, nuisance, or other detriment.
Auction establishment.
Automobile sales lot, surfaced.
Bowling alley, dance hall, or similar commercial establishments for public gatherings or recreational use.
Church.
Club or lodge.
Drive-in theater.
Hospital.
Multiple-family dwelling.
School.
Travel trailer park. (Ord. 86, 8-19-1980)

10-4A-4: BUILDING HEIGHT:

Any building or structure or portion thereof hereafter erected shall not exceed two and one-half (21/2) stories or twenty five feet (25') in height, unless a greater height is approved by a variance to the provisions of this section. (Ord. 86, 8-19-1980; amd. 2008 Code)

10-4A-5: SETBACK REQUIREMENTS:

All buildings and structures should be situated in such a manner as to not obstruct vehicular vision or prohibit emergency access. (Ord. 86, 8-19-1980)

10-4A-6: LOT AREA:

There shall be no minimum lot sizes; except, that residential uses shall have the same area requirements as set forth in the R-3 zone (section 10-3C-6 of this title). (Ord. 86, 8-19-1980)

10-4A-7: ACCESSORY USES:

Accessory uses are permitted if constructed either at the same time or subsequent to the main building. Such uses shall be limited to two (2) stories in height and shall not encroach upon required setback areas. (Ord. 86, 8-19-1980)

10-4A-8: OFF STREET PARKING AND LOADING:

For off street parking and loading requirements in the C-1 zone, refer to section 10-6-6 of this title. (Ord. 86, 8-19-1980; amd. 2008 Code)

10-4B-1: PURPOSE:

The purpose of the C-2 service commercial zone is to provide areas where activities of a service nature which are more intensive in character than in other commercial zones and which may be semi-industrial in character may be carried out. (Ord. 86, 8-19-1980)

10-4B-2: USES ALLOWED:

The following uses are allowed in the C-2 zone:
Those uses allowed in C-1 zones, other than residential uses, and as regulated therein.
Auction establishment.
Automobile and truck repair shop.
Bottling and distribution plant.
Contractor's shop within a building and including outside incidental storage adequately screened by view obscuring fences from surrounding properties.
Sale of hay, grain, seed and related supplies.
Sale of heavy building materials and machinery.
Sale of salvage goods within an enclosed building.
Sheet metal, roofing or sign painting shop.
Storage warehouse.
Trade or industrial school.

10-4B-3: CONDITIONAL USES PERMITTED:

10-4C-1: PURPOSE:

The M-1 district is established to provide for and encourage the grouping together of light industrial uses capable of being operated under such standards as to location and appearance of buildings and the treatment of the land about them, that they will be unobtrusive and not detrimental to surrounding commercial or residential uses. (Ord. 86, 8-19-1980)

10-4C-2: USES ALLOWED:

The following uses are allowed in the M-1 zone:
Those uses allowed and conditional uses permitted in the C-1 and C-2 zones except multiple-family dwellings, schools, churches, and hospitals.
Contracting equipment, maintenance or operating materials and equipment of a similar nature including lumber, coal, sand and gravel yards.
Food processing.
Laundry and dry cleaning of an industrial character.
Manufacturing, assembling, fabricating, processing, packing, repairing, or storage uses which have not been declared a nuisance by statute, resolution, or any court of competent jurisdiction, and provided these uses shall not cause:
   A.   Unreasonable dust, smoke, gas, fumes, noise, vibration, or odor beyond the boundaries of the site on which such use is conducted.
   B.   Hazard of fire, explosion, or other physical damage to any adjacent building or plant growth.
Wholesaling, warehousing, storage, and distribution.

Boarding commercial kennel - enclosed structures only.
Broadcasting tower for radio or television.
Grain elevator and bulk storage such as for potatoes, hay, and other similar uses.
Planned unit development.
Sewerage treatment plant and similar facilities.
