CHAPTER 7

MANUFACTURED HOUSING

10-7-1: DEFINITIONS:

For purposes of this chapter, the following words and terms shall have the meanings ascribed to them in this section:
   MANUFACTURED HOME: A structure, constructed after June 15, 1976, in accordance with the HUD manufactured home construction and safety standards, and is transportable in one or more sections, which, in the traveling mode, is eight (8) body feet or more in width or is forty (40) body feet or more in length, or when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained thereon; except, that such term shall include any structure which meets all the requirements of this definition except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the secretary of housing and urban development and complies with the standards established under 42 USC section 5401 et seq.
   MANUFACTURED HOUSING: Single-family dwellings within the R-1 types of zoning districts of this title, provided such structures meet the development standards of manufactured homes on individual lots set forth in section 10-7-2 of this chapter. (Ord. 97, 4-6-1982; amd. 2008 Code)

10-7-2: MANUFACTURED HOME ON INDIVIDUAL LOT:

Development standards for a manufactured home on an individual lot are as follows:
   A.   Shall be multi-sectional and shall be at least twenty feet (20') wide, with a minimum floor area of four hundred (400) square feet per section.
   B.   Shall have a nonmetallic, wood shake or asphalt shingle roof with a minimum slope of sixteen percent (16%) (2:12) and a minimum six inch (6") eaves, or gutter and eaves attached to the entire perimeter of the roof.
   C.   Shall have horizontal aluminum, simulated wood or wood siding. (Ord. 97, 4-6-1982)
   D.   Shall have a foundation fascia that is similar in appearance and durability to masonry foundation of site built dwellings, as approved by the building official, which surrounds the entire perimeter of the structure and completely encloses the space between the siding and the finished grade.    E.   Shall be permanently affixed, with the running gear and towing hitch removed, and set upon a foundation base having an anchoring system that is totally concealed under the structure.
   F.   Shall obtain a building permit from the city building department to ensure that the manufactured home is assembled on site and in compliance with other building standards of the city.
   G.   Shall comply with all other applicable requirements of the zoning district in which the manufactured home is located (such as lot size and setback requirements). (Ord. 97, 4-6-1982)

10-7-3: ACCESSORY STRUCTURES:

Development standards for an accessory structure to a manufactured home on an individual lot are as follows:
   A.   Attached accessory structure, as permitted in the zoning district for which the manufactured home is to be located, shall be similar in material and integrated into the design of the structure. (Ord. 97, 4-6-1982)
   B.   Accessory structures must meet international building code standards or HUD standards. (Ord. 97, 4-6-1982; amd. 2008 Code)

10-7-4: APPLICATION FOR PLACEMENT OF MANUFACTURED HOME:

   A.   Application for approval of manufactured housing on individual lots shall be submitted to the building official on a standard prescribed form. In addition to such information as is generally required for zoning permits and is necessary for administrative purposes, such applications shall also include all information necessary to determine the manufactured home's conformity with section 10-7-2 of this chapter, including: exterior dimensions, roofing pitch, roofing material, size of overhangs, exterior siding, foundation fascia and any other applicable information.    B.   Applicant shall sign the application and provide any additional information necessary to verify such structure does meet the standards of section 10-7-2 of this chapter prior to moving the structure to the building site. The city building department, following issuance of a building permit and upon inspection of the site for the attachment of the structure to a foundation base, shall verify in writing that all standards of section 10-7-2 of this chapter have been met, as certified in the signed application form. 10-7-5: OWNERSHIP OF LOT:

Manufactured home owners or purchasers shall own or be purchasing the land upon which their home is to be placed. Said owner or purchaser shall record with the county recorder a nonrevocable option declaring the manufactured home as real property. These requirements shall not apply within the R-3 mobile home residential zone or within any duly approved mobile home park. Exception may also be granted as a part of a planned unit development approval. (Ord. 97, 4-6-1982; amd. 2008 Code)

10-7-6: SUBDIVISION RESTRICTIONS:

Nothing in this chapter shall permit manufactured homes in subdivisions where they are prohibited by restrictive covenants. (Ord. 97, 4-6-1982)
