CHAPTER 17

T-1 TECHNOLOGY PARK SPECIALIZED INDUSTRIAL TPSI DISTRICT

10-17-1: STATEMENT OF PURPOSE:

The technology park specialized industrial district is established to provide an aesthetically attractive and nuisance free industrial zone exclusively for and conducive to the development and protection of approved research and development and manufacturing. The essential purpose of this district is to achieve industrial development that is an asset to the owners, community and economic development of the region. (1975 Code Ch. 18 § XXII)

10-17-2: USES:

In the technology park specialized industrial district, no building or premises shall be used and no building shall hereafter be erected, converted in use, enlarged, moved or structurally altered unless otherwise provided in this title, except for one or more of the following uses:
Building located on that part of lot 6, block 3, Stout Technology Park, now known as lot 11 certified survey map no. 1639, volume 6 of survey maps page 189, may be used for an educational and/or mini-conference center, research and technology center, telecommunication center, human service center, corporate park headquarters, historical center, guesthouse, motel, restaurant (with or without a liquor license) or single-family residence.
Business and industry, including corporate and regional offices, involved in research and development, technology, manufacturing prototype, product testing and experimental or commercial testing.
Fitness center.
Nursery school, daycare center or child development center.
Open recreational areas, such as parks, playgrounds and soccer fields.
Production, processing, servicing, testing or repair of materials, goods or products, including corporate and regional offices, limited to the following uses, products, components or circumstances:
   A.   Apparel design and manufacture.
   B.   Computer technology and software.
   C.   Educational, psychological and rehabilitative products and materials.
   D.   Electronics and microelectronics products and equipment.
   E.   Food service products and equipment.
   F.   Graphic arts and design products and equipment.
   G.   Industrial design products and equipment.
   H.   Mechanical power transmission products and equipment.
   I.   Medical, orthopedic and dental products and equipment.
   J.   Optical, fiber optical and photographic products and equipment.
   K.   Packaging products and equipment.
   L.   Scientific and precision instruments and components including robotics.
   M.   Telecommunications products and equipment.
Public and private research centers, educational centers, rehabilitation centers, telecommunication centers, nonprofit charitable organizations, and libraries.
Small scale products (finished weight not exceeding 50 pounds) not listed in this section but similar in intent and character. (1975 Code Ch. 18 § XXII; amd. Ord. 2006-23, 11-6-2006; Ord. 2012-14, 9-17-2012; Ord. 2013-02, 2-4-2013)

10-17-3: GENERAL REGULATIONS:

Uses permitted in the TPSI district are subject to the following conditions:
   A.   No use shall be conducted as to cause the harmful discharge of any waste material into or upon the ground, into or within any sanitary or storm system, into or within any water system or water, or into the atmosphere. All uses shall be conducted in such a manner to preclude any nuisance, hazard or commonly recognized offensive conditions or characteristics, including, but not limited to, creation or emission of dust, gas, smoke, noise, fumes, odors, vibrations, particulate matter, chemical compounds, electrical disturbance, humidity, heat, cold, glare or night illumination. Before issuance of a building permit, the building inspector may require evidence that adequate controls, measures or devices have been provided to ensure and protect the public interest, health, comfort, convenience, safety and general welfare from such nuisances, hazard or offensive conditions.
   B.   All business servicing or processing shall be conducted completely within buildings, except off street parking and off street loading and outside storage areas as regulated hereinafter. (1975 Code Ch. 18 § XXII)

10-17-4: DENSITY, HEIGHT AND SETBACK:

   A.   Density: The building to site ratio shall not exceed fifty percent (50%) of the site coverage, and total site coverage including all buildings and paved areas shall not exceed seventy percent (70%) of the gross lot area. A minimum of thirty percent (30%) of the site shall be devoted to green area.
   B.   Height: No building shall exceed forty five feet (45') nor three (3) stories in height.
   C.   Front, Side And Rear Yard Regulations:
      1.   Front Yard: A minimum fifty foot (50') setback from property line is required for all front yards and from all primary streets.
      2.   Side And Rear Yard: A minimum of twenty five feet (25') shall be required for side and back yards.
      3.   Exceptions To Setback Requirements:
         a.   Structures below and covered by the ground.
         b.   Steps, walks, driveways and curbing.
         c.   Landscaping, fences or hedges, not to exceed six feet (6') in height. (1975 Code Ch. 18 § XXII)

10-17-5: VISION CLEARANCE:

Same as subsection 10-4-5G of this title. (1975 Code Ch. 18 § XXII)

10-17-6: PARKING LOT RATIOS:

   A.   Company Employees: A minimum of one parking space for every management employee and one parking space for every three (3) other employees; and
   B.   Company Vehicles: One parking space shall be provided for every company vehicle operating on the premises; and
   C.   Visitors: One parking space per every three hundred (300) square feet of administrative space, with a minimum of four (4) parking spaces to be provided for visitors; and
   D.   Conference/Educational Facility: One parking space for every one hundred fifty (150) square feet of administrative and professional office space, plus one space for every three (3) seats of conference or educational space. (1975 Code Ch. 18 § XXII)

10-17-7: DEVELOPMENT STANDARDS:

   A.   Loading Docks: Loading docks shall be set back a minimum of one hundred feet (100') from the street line if located on the front of the building. Loading docks in the rear or on the side of the building not facing streets shall conform to rear and side yard requirements.
   B.   Storage Areas: No materials, supplies, refuse or equipment, including any trucks owned or operated by the property occupant, shall be stored or parked in any area on the property except inside a building or behind a visual barrier screen or building so that it is not visible from the street.
   C.   Screening Walls: Screening walls for storage areas shall form a complete opaque screen, be of minimum height of six feet (6'), or the height of the material being screened, whichever is higher. The materials used for screening may be plants and/or fencing or building materials compatible with other design elements on the building site. No woven material or chainlink fence shall be used for screening.
   D.   Illumination: Electrical reflectors, spotlights, floodlights and other sources of illumination used to illuminate buildings, landscaping, street graphics and parking and loading areas must be equipped with lenses or other devices which concentrate the illumination upon such buildings, landscaping, street graphics, and parking and loading areas. All lighting shall be reflected away from adjoining properties, residences and public streets. All lighting shall be screened to minimize skyward reflection.
   E.   Identification Signs: No identification signs shall be erected on the property except the following:
      1.   Monument Style Identification Sign: No more than two (2) monument style identification signs, neither of which, excluding base, shall exceed six feet (6') in height nor sixty (60) square feet per sign face, will be permitted. The sign may contain the name of owner/company, logo, park identification, street number and name. Commercial messages are not permitted. Minimum setback from the property line shall be two feet (2').
      2.   Signs On Buildings: No owner/company identification signs may be placed on buildings other than a company logo and/or name identification in individual pin mounted letters. A building sign not to exceed twenty (20) square feet may be mounted next to the main entrance to identify tenants in a multi-tenant building. Sign cabinets are not permitted for such signs and any lighting shall be subdued and limited to highlighting the sign only. Wording is limited to tenants' names and logos and locations in the building. Commercial messages are not permitted on building signs.
      3.   Prohibited Signs: There shall be no animated or neon signs. (1975 Code Ch. 18 § XXII)
