CHAPTER 13A

B-4 NEIGHBORHOOD OFFICE DISTRICT

10-13A-1: USES:

The B-4 neighborhood office district is established to provide commercial areas that will provide services to the public in an attractive, safe and convenient manner. The B-4 district is established for areas that are in close proximity to residences and are predominantly office uses, typically generating low traffic volumes and with limited hours of operation in the evening or on weekends.
In the B-4 neighborhood office district, no building or premises shall be used and no building shall hereafter be erected, converted in use, enlarged, moved or structurally altered unless otherwise provided in this chapter, except for one or more of the following uses:
   A.   Unconditionally permitted uses:
Barbershops, beauty shops, nail salons, and tanning salons.
Business or professional office uses, public or institutional.
Educational services, not including a college or university.
Financial institutions, without drive-through facilities.
Home occupations, provided that: 1) such occupation is incidental to the use of the premises for residential purposes; 2) does not involve any structural alteration of the building or any external construction not customary in dwellings; 3) no article is sold or offered for sale on the premises except such as is produced by such occupation; 4) no stock in trade is kept or sold; 5) no mechanical equipment is used other than such as is permissible for purely domestic purposes; and 6) no person other than a member of the immediate family living on the premises is employed.
Medical, dental, and optical clinics, but not veterinary hospital and/or clinic or services.
Photography, art, music, or dance studios.
Single-family dwellings or two-family dwellings.
Uses customarily incidental to the foregoing uses and accessory buildings or structures. (Ord. 2012-10, 6-4-2012)

10-13A-2: HEIGHT, YARDS, AREA AND OTHER REGULATIONS:

In the B-4 neighborhood office district, the height and width of buildings, the minimum dimension of yards, vision clearance, off street parking, lighting, landscaping, signs, and other requirements shall be as follows for all buildings hereafter erected, converted in use, enlarged, moved or structurally altered:
   A.   Height: Thirty five feet (35') or two and one-half (21/2) stories in height, whichever is least.
   B.   Front Yard Setback: There shall be a front yard setback of twenty five feet (25').
   C.   Side Yard Setback: There shall be a side yard setback of ten feet (10'); except that on any corner lot, the setback on the street side yard of the corner lot shall be twenty five feet (25'); provided, however, on any corner lot having a width of sixty six feet (66') or less, and of record on the effective date hereof, the setback on the street side yard of the corner lot shall be ten feet (10').
   D.   Rear Yard Setback: There shall be a rear yard setback of twenty five feet (25').
   E.   Vision Clearance: Same as provided in subsection 10-4-5G of this title.
   F.   Off Street Parking: Same as provided in section 10-4-7 of this title.
   G.   Illumination: All exterior lighting shall be downlit/cut off (horizontal) lights. Electrical reflectors, spotlights, floodlights and other sources of illumination used to illuminate buildings, landscaping, street graphics and parking and loading areas must be equipped with lenses or other devices which concentrate the illumination upon such buildings, landscaping, street graphics, and parking and loading areas. All lighting shall be reflected away from adjoining properties, residences and public streets. All lighting shall be screened to minimize skyward reflection. Lights for parking areas shall be extinguished no later than ten fifteen o'clock (10:15) P.M. and shall remain extinguished until one-half (1/2) hour before sunrise on the following day. All light poles shall be a maximum height of twenty feet (20').
No buildings consisting of all preengineered steel or smooth concrete block (cinder block) will be allowed.
   H.   Landscaping And Screening: Same as provided in section 9-9-2 of this code. All outdoor storage and trash areas shall be screened from view by an enclosure or by landscape screening, or by a combination of both methods.
   I.   Construction: All sides of the building should use materials consistent with those on the front if visible from public streets or neighboring properties, and should be carefully designed with similar detailing, and be comparable in quality and material. Building design shall include a variety of architectural elements to accomplish visual effect. No buildings consisting of all preengineered steel or smooth concrete block (cinder block) will be allowed.
   J.   Identification Signs: No identification signs shall be erected on the property except the following:
      1.   Monument Style Identification Sign: No more than two (2) monument style identification signs, neither of which, excluding base, shall exceed six feet (6') in height nor sixty (60) square feet per sign face, will be permitted. The sign may contain the name of owner/company, logo, street number and name. Commercial messages are not permitted. Minimum setback from the property line shall be two feet (2').
      2.   Signs On Buildings: No owner/company identification signs may be placed on buildings other than a company logo and/or name identification in individual pin mounted letters. A building sign not to exceed twenty (20) square feet may be mounted next to the main entrance to identify tenants in a multi-tenant building. Sign cabinets are not permitted for such signs and any lighting shall be subdued and limited to highlighting the sign only. Wording is limited to tenants' names and logos and locations in the building. Commercial messages are not permitted on building signs.
      3.   Prohibited Signs: There shall be no animated or neon signs. (Ord. 2012-10, 6-4-2012)
