38 - SOLAR COLLECTION SYSTEMS
This section shall be applicable only to building-mounted solar collection systems. Building-mounted solar collection systems are permitted in all zoning districts subject to the following:
A.
Roof-Mounted Systems. When a system is mounted on the roof of a structure:
1.
The structure on which it is mounted shall be structurally sound and have weight-bearing capacity sufficient to support the system;
2.
The size of the system shall not exceed or extend beyond the footprint of the structure on which it is mounted;
3.
For systems mounted on a sloped roof, the system shall not extend higher than one foot above the highest point of the roof, and in no event shall the system, when combined with and mounted on the structure, exceed the permitted building height in the district in which the system is located;
4.
For systems mounted on flat roofs, the system shall not extend higher than six feet above the highest point of the roof, and in no event shall the system, when combined with and mounted on the structure, exceed the permitted building height in the district in which the system is located.
B.
Wall-Mounted Systems. When a system is mounted on the exterior side or wall of a structure, the structure on which it is mounted shall be structurally sound and have weight-bearing capacity sufficient to support the system. The size of the system shall not exceed or extend by more than one foot the size of the footprint of the structure on which it is mounted.
C.
A solar collection system may be mounted on the principal use structure or on an accessory use structure.

Freestanding solar collection systems are permitted in any district only by special exception and are subject to the specific standards set forth in this chapter.

A permit is required for installation of a solar collection system within the Town of Middletown.
B.
Property owners who intend to install a solar collection system shall be responsible for negotiating with other property owners in the vicinity for any necessary solar easement and shall record the easement as required. Property owners who fail to secure an easement for the receipt of solar energy act at their own peril and have no recourse against the person allowing or causing the obstruction of the property owner's receipt of solar energy.
C.
A solar collection system shall be situated on property so as to avoid reflection or glare from the system onto neighboring properties and streets and so as to minimize any visual impact to neighboring properties.
