Notwithstanding any other provision of this chapter, no building or structure, on-lot sewage disposal facility or a street, roadway, parking lot or driveway shall be erected or constructed, either above or below ground level, within 100 feet of any hydrologic sensitive lands, floodplain, stream or lake area in the Township. Nothing in this chapter shall prohibit the construction and maintenance of dams or other structures for the impoundment or retention of water in any such stream, hydrologic sensitive lands, pond or lake or of dug ponds or reservoirs, provided that all applicable requirements and approvals of any public authority having jurisdiction over such matters are met and obtained.

No hydrologic sensitive lands, floodplain, or stream or lake areas, as defined in this chapter, shall be filled with soil, debris, or other material unless it can be shown to the satisfaction of the Zoning Officer that, after consulting with the Township Engineer, the United States Soil Conservation Service and any state or federal agency having jurisdiction thereof, the water quality, water quantity, flow rates and cycles will not be altered to the detriment of adjacent areas and the impact of the proposed filling will not have an unreasonably adverse impact upon the ecology of the area. No stream or brook shall be dammed nor the flow thereof impeded without the specific approval of the State Division of Water Resources or other state or federal agency having jurisdiction thereof.
