SECTION 15D

GASOLINE SERVICE STATIONS

Sec. 15D.1.- Specific use permit required.

A.

Except as provided elsewhere in this section 15D, a gasoline service station located on a property with a property line adjacent to an R-1, R-1-A, R-2, R-3, R-4, R-5, R-6 residential district may not be erected without first receiving approval for a specific use permit.

B.

Application procedures. Application for a specific use permit for a gasoline service station shall be made to the planning development services department of the city. An application will not be considered until it is complete. A complete application must contain the following:

(1)

An inventory of the applicant's existing gasoline service stations that are either within the city or within one mile of the border thereof, including specific information about the location of each gasoline service station.

(2)

Site plan or plans to scale specifying the location of the proposed gasoline service station, energy source infrastructure, other accessory uses, access, parking, fences, landscaped areas, and adjacent land uses.

(3)

A description of anticipated maintenance needs.

(4)

Any additional information which may be requested by the city to fully evaluate and review the application and the potential impact of a proposed gasoline service station.

Sec. 15D.2. - General requirement and regulations for gasoline service stations.

Gasoline service stations requiring a specific use permit. The following regulations shall apply to gasoline service stations for which a specific use permit is required under this section 15D:

(1)

A gasoline service station may be permitted only within 200 feet of the right-of-way lines of intersecting streets.

(2)

A gasoline service station may be permitted at a maximum of two corners at an intersection of two arterial streets and a maximum of one corner of an intersection with a collector or local street.

(3)

Air pumps and vacuums located on property containing a gas pump shall be located at least 150 feet from a residential property line.

Sec. 15D.3. - Effect of state law.

To the extent there exists any conflict between the provisions of this section and applicable state law, the state law provision shall prevail to the extent of the conflict.

Sec. 15D.4. - Fees.

An applicant for a gasoline service station site plan review shall pay, at the time of the application, in addition to any other required fees, a gasoline service station site plan review fee, as applicable, in the amount specified in a resolution by the city council adopting a schedule of fees.

Sec. 15D.5. - Existing gasoline service stations.

A gasoline service station operating on August 5, 2025, may continue to operate as a nonconforming structure until the authority to use such structure is terminated in accordance with this Code and state law.
