A. General: A lighting plan is required for all nonresidential uses in commercial, industrial, institutional, and public uses including uses developed by other units of local government. At the time any exterior lighting is installed or substantially modified, a lighting plan shall be submitted to the village in order to determine whether the requirements of this section have been met. The approval process typically involves a review by the Zoning Official or his/her designee and in some cases, the village board. A lighting plan shall be required for all special uses, planned unit developments, and requests for variations from the standards imposed in this section.
B. Minimum Plan Requirements: All lighting plans shall include the following:
1. A site plan showing pole locations, building mounted lights, bollard lights with schematic wiring layout and power source connection;
2. Specifications for luminaires and lamp types, poles, wiring, conduit and associated construction including photographs or drawings of proposed luminaires;
3. Pole, luminaire, and foundation details including pole height, height of building mounted lights, mounting height and height of the luminaire;
4. Shielding of light source. To control glare, a ninety-degree cutoff luminaire housing shall be designed for all building-mounted and pole mounted lights on private property. Decorative lighting without shielding may be approved when used to enhance the architectural design of the building or site, subject to review by the Zoning Official.
5. Other information and data reasonably necessary to evaluate the required lighting plan pursuant to the request of the village.
C. Installed Height: The installed height of any luminaire used for outdoor lighting on any zoning lot, except for street lighting, shall not exceed the following limits:

Note:
1. Total height of luminaire located on light poles on concrete bases may extend to 25 feet in height or the height of the building, whichever is lower.
D. Lighting Regulations Based On Zoning Classification:
1. Commercial, Industrial, Office Districts: Except as otherwise stated herein, any luminaire on any zoning lot in a nonresidential lighting zone which emits light directed at a building, sign, or other outdoor feature shall be located and shielded so that the directed light is substantially confined to the object intending to be illuminated.
Except for street lighting, outdoor lighting on any zoning lot in a nonresidential lighting zone is permitted to be lighted between one-half (1/2) hour before sunset and ten o’clock (10:00) P.M. or one hour after the close of business based on normal hours of operation of the business, whichever is later. Thereafter, for safety and security purposes, security lighting is permissible at a total light output not greater than twenty five percent (25%) of the total light output from all outdoor lighting located on the zoning lot during permitted outdoor lighting hours. During security lighting hours, no luminaire may exceed its light output exhibited during permitted outdoor lighting hours.
2. Illumination Standards For Nonresidential Districts:
1. Maximum to minimum light level ratio shall not exceed 15:1.
3. Light Trespass For Residential Districts: Light trespass within any residential district shall be no greater than 0.3 foot-candle at the property line.
E. Conformance: Any existing luminaire or lighting installation used for outdoor lighting in any zoning district on the effective date hereof that does not comply with the requirements of this section shall be considered a nonconforming use. Except as otherwise stated herein, such uses shall be made to comply with the requirements of this section.
Any nonconforming luminaire or light installation existing on any zoning lot in any zoning district as of the effective date hereof shall be made to comply with the requirements of this section or be removed within thirty (30) days if any of the following criteria are met:
1. The luminaire is producing glare that is deemed by the village to create a hazard or nuisance; or
2. The height or location of the luminaire is changed; or
3. The luminaire is changed or replaced (excluding routine maintenance and bulb replacement of equal light output) except if it is part of a parking lot lighting installation consisting of an array of three (3) or more identical luminaires and poles or supporting structures; or
4. The supporting structure for the luminaire is changed or replaced except if it is part of a parking lot lighting installation consisting of an array of three (3) or more identical luminaires and poles or supporting structures; or
5. The use of the luminaire is resumed after a period of abandonment.
Legal nonconforming illumination systems which were not part of a specific village approved lighting plan shall be brought into conformity with the criteria and standards set forth herein when the illumination system is to be replaced or modified to greater than fifty percent (50%) of its replacement value, based on the total project implementation cost.
F. Prohibited Outdoor Lighting: The following outdoor lighting applications are prohibited in all zoning districts:
1. The use of laser light source;
2. The use of flickering, flashing, blinking, scrolling, or rotating lights and any illumination that changes intensity;
3. Architectural lighting of any proportion of a building or structure with a polished or glass exterior surface that uses uplighting;
4. The use of searchlights;
5. The use of neon light as outline lighting to accent buildings or architectural features;
6. The use of mercury vapor light source;
7. Any luminaire creating glare that is deemed by the village to create a hazard or nuisance.
G. Exempt Outdoor Lighting: The following outdoor lighting applications are exempt from all requirements of this section:
1. Underwater lighting used for the illumination of swimming pools and fountains;
2. Lighting required by county, state, or federal law;
3. Temporary lighting used for holiday decoration;
4. Decorative yard lighting characterized by a flame source;
5. Portable lighting temporarily used for maintenance or repair that is not deemed by the village to create a hazard or nuisance;
6. Emergency lighting used by police, firefighting, emergency management, or medical personnel at their discretion as long as the emergency exists;
7. Lighting approved by the village for temporary events such as carnivals, circuses, festivals, picnics, fairs, civic events, and exhibitions; and
8. Temporary lighting required for road construction or other public improvements.
H. Right Of Inspection, Enforcement, And Penalties: The village shall have the right to conduct a post installation inspection to verify compliance with the requirements of this section and, if appropriate, to require remedial action at the expense of the applicant.
1. The chief building official, deputy building official, and such other persons who are duly appointed as code enforcement officers are hereby authorized to inspect luminaires and lighting installations in the zoning districts subject to this section to determine compliance with the applicable provisions and, if necessary, to issue notices of violation to the owner, operator or other person or entity responsible for maintenance of the luminaire or lighting installation, if the luminaire or lighting installation fails to comply with the provisions of this section. The notice of violation shall set forth an appropriate time period of not less than thirty (30) days for compliance. In the event the violation is not corrected within the time limits set forth in the notice of violation, proceedings to enforce compliance with the provisions of this section may be initiated.
2. Any person, firm, corporation or business entity that violates any provision of this section shall be subject to a fine of not less than two hundred fifty dollars ($250.00) and not more than seven hundred fifty dollars ($750.00) for each separate offense. A separate offense shall be deemed committed on each day a violation occurs or continues to occur.
CANOPY: Any overhanging shelter or shade or other protective structure constructed in such a manner as to allow pedestrians or vehicles to pass underneath.
CUTOFF: The point at which all light rays emitted by a lamp, light source, or luminaire are completely eliminated (cut off) at a specific angle above the ground.
CUTOFF ANGLE: The angle formed by a line drawn from the direction of light rays at the light source and a line perpendicular to the ground from the light source, above which no light is emitted.
ENTRANCE DRIVE LIGHTING: Lighting produced solely for illumination of a drive entering into an establishment.
EXTERIOR LIGHTING: The illumination of an outside area or object by any manmade device that produces light by any means.
FIXTURE: The assembly that houses the lamp or lamps and can include all or some of the following parts: a housing, a mounting bracket or pole socket, a lamp holder, a ballast, a reflector or mirror, and/or a refractor or lens.
FLOOD OR SPOT LIGHT: Any light fixture or lamp that incorporates a reflector or a refractor to concentrate the light output into a directed beam in a particular direction.
FOOT-CANDLE (fc): A unit of illumination produced on a surface, all points of which are one foot (1') from a uniform point source of one standard candle.
GLARE: Light emitting from a luminaire with an intensity great enough to reduce a viewer’s ability to see, cause discomfort and, in extreme cases, cause momentary blindness.
HEIGHT OF LUMINAIRE INCLUDING TOTAL HEIGHT: The height of a luminaire shall be the vertical distance from the ground directly below the centerline of the luminaire to the lowest direct light emitting part of the luminaire. The total height shall be the height of the pole, including the base and any mounting arms or other attachments to which the luminaire is attached, as measured from the ground directly below the highest part of the pole or any of its attachments, to the top of the pole or luminaire, whichever the case may be.
ILLUMINATION SYSTEM: The totality of the equipment installed to provide exterior lighting on a developed property. The illumination system shall include all building, canopy, pole, and ground mounted luminaires including all wiring, circuitry, and other devices installed to create exterior lighting.
LAMP: The component of a luminaire that produces the actual light.
LAMP WATTAGE: The amount of power of a lamp expressed in watts.
LIGHT, DIRECT: Light emitted directly from the lamp, off a reflector or reflector diffuser, or through the refractor or diffuser lens of a luminaire.
LIGHT, INDIRECT: Direct light that has been reflected or has scattered off of other surfaces.
LIGHT TRESPASS: The shining of light produced by a luminaire beyond the boundaries of the property on which it is located.
LUMEN: A unit of luminous flux. One foot-candle is one lumen per square foot. For the purpose of this section, the lumen value shall be the initial lumen output rating of a lamp.
LUMINAIRE: A complete lighting unit consisting of a light source and all necessary mechanical, electrical, and decorative parts.
LUMINAIRE, CUTOFF TYPE: A luminaire containing elements such as shields, reflectors, or refractor panels that direct and cut off a direct view of the light source at a cutoff angle.
OPERATING HOURS: The period of time from one hour prior to opening to one hour after closing of a nonresidential establishment.
OUTLINE LIGHTING: An arrangement of incandescent lamps, electric discharge lighting, or other electronically powered light sources to outline or call attention to certain features such as the shape of a building or the decoration of a window.
SECURITY HOURS: The period of time from one hour after closing to one hour prior to opening of a nonresidential establishment.
TEMPORARY EXTERIOR LIGHTING: The specific illumination of an outside area or object by any manmade device that produces light by any means.
WALL OR BUILDING MOUNTED FIXTURE: A fixture attached to an exterior wall, roof, or other exterior surface of a building. No wall mounted fixture shall be allowed to produce light trespass and shall be included in the calculation on photometric plans. (Ord. 2009-O-032, 8-10-2009; amd. Ord. 2025-O-014, 8-11-2025)
