The village of Mokena, for the purpose of this title, is hereby divided into the following zoning districts:

   A.   Residential:

      1.   E-1 estate residence district;

      2.   R-1 single-family residence district;

      3.   R-2 single-family residence district;

      4.   R-3 single-family residence district;

      5.   R-4 single-family residence district;

      6.   R-5 single-family residence district; and

      7.   R-6 multiple-family residence district.

   B.   Commercial:

      1.   C-1 traditional shopping district;

      2.   C-1A general commercial district;

      3.   C-2 highway commercial district;

      4.   C-3 commercial district; and

      5.   C-4 traditional downtown district.

   C.   Office:

      1.   O-1 office transitional district; and

      2.   O-2 office interstate district.

   D.   Industrial:

      1.   I-1 limited industrial district;

      2.   I-2 general industrial district; and

      3.   I-3 intensive industrial district.

   E.   Special:

      1.   A-1 agricultural district; and

      2.   P-1 public, quasi-public, and conservation district.

   F.   Overlay:

      1.   OR-1 retail overlay district. (Ord. 2000-O-005, 2-14-2000)

   A.   Authorization: The location and boundaries of the zoning districts established by this title are indicated upon the map entitled, "official zoning map, village of Mokena, Illinois", hereafter referred to as the zoning map, which is by this reference incorporated as part of this title. All notations, references, and other information shown on the zoning map, and all amendments thereto, shall be as much a part of this title as if specifically set forth and literally described herein.

   B.   Location Of Map: The zoning map shall be located in the office of the village clerk and shall be the final authority as to the current zoning status of land and buildings, subject to such authorized amendments which be in effect.

   C.   Interpretation Of District Boundaries: Where uncertainty exists as to the boundaries of districts as shown on the official zoning map, the following rules shall apply:

      1.   Boundaries indicated as approximately following the centerline of streets, highways or alleys shall be construed to follow such centerlines;

      2.   Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines;

      3.   Boundary lines which follow or approximately follow plotted lot lines of other property lines as identified by the "tax index number" of the parcel assigned by the county shall be construed as following such lines;

      4.   Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks;

      5.   Boundaries indicated as following shorelines shall be construed to follow such shorelines, and in the event of change in the shoreline, shall be construed as moving with the actual shoreline boundaries indicated as approximately following the centerline of streams, rivers, canals, lakes or other bodies of water shall be construed to follow such centerlines;

      6.   Boundaries indicated as parallel to or extensions of features indicated in subsections C1 through C3 of this section shall be so construed. Distances not specifically indicated on the official zoning map shall be determined by dimensions shown on the map, or in the absence of dimensions, by the scale of the map;

      7.   Where a zoning district boundary line divides a lot in single ownership on the effective date of this title, the regulations of this title for either portion of such lot may, at the owner's discretion, apply to the entire area of the lot or twenty five feet (25') beyond the zoning district boundary lines, whichever is the lesser distance;

      8.   All streets, alleys, public ways and railroad rights of way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately abutting upon such alleys, streets, public ways and railroad rights of way. The centerline of a street, alley, public way or railroad right of way, unless otherwise specifically designated, shall be deemed to be the district boundary;

      9.   Streets or alleys which are shown on the map and which have heretofore been vacated, or which are vacated hereafter, shall be in the same district as the land abutting both sides of the street or alley. If the land abutting each side of the street or alley was located in different districts before the street or alley was vacated, the centerline of the vacated street or alley shall be the district boundary; and

      10.   Where physical or cultural features existing on the ground are at variance with those shown on the official zoning map, or in other circumstances not covered by subsections C1 through C9 of this section, the zoning board of appeals shall interpret the location of district boundaries. Appeals to the zoning board of appeals' decision may be presented to the village board in the same manner as an amendment to this title as outlined in section 9-4-7 of this title.

   D.   Changes: If, by amendment to this title, any change is made in any district boundary, it shall be shown on the official zoning map. The date of the latest updating of the official zoning map shall be shown on the face of the map.

   E.   Availability: Zoning maps, certified by the village clerk as showing the districts created, approved and as amended, shall be available for public reference and/or sale in the office of the village clerk. (Ord. 2000-O-005, 2-14-2000)

It is the intent that the entire area of zoning jurisdiction, including all land and water areas, rivers, streets, alleys, railroads and other rights of way, be included in the districts established by this title. If any area is not shown on the official zoning map as being included in any district, it shall be deemed to be in the E-1 residential district. (Ord. 2000-O-005, 2-14-2000)

   A.   Annexation Of Land: All land annexed to the village after the effective date of this title shall be classified automatically upon such annexation in the E-1 residential district. Where land is classified pursuant to this section, it shall remain so classified unless and until an application to amend such classification is filed and granted pursuant to section 9-4-7 of this title. Such application may be filed prior to or contemporaneously with the annexation of the land in question. (Ord. 2000-O-005, 2-14-2000)
