CHAPTER 10

1 TITLE, PURPOSE, AND INTENT

10-1-1: Title

This Title shall be known and may be cited as the MORTON ZONING ORDINANCE.

10-1-2: Purpose

This Title is adopted for the following purpose:

  1. Securing adequate light, pure air, and safety from fire and other dangers;
  2. Conserving the taxable value of lands and buildings throughout the Municipality;
  3. Lessening or avoiding congestion in public streets;
  4. Lessening or avoiding the hazards to persons and damage to property resulting from the accumulation or runoff of storm or flood waters; and
  5. Promoting the public health, safety, comfort, morals, and welfare.

10-1-3: Intent

To these ends, this Title is intended to establish certain standards and objectives by:

  1. Regulating and limiting the height and bulk of buildings;
  2. Establishing, regulating, and limiting the building lines along any street, parkway, water channel, or basin;
  3. Regulating and limiting the intensity and use of lot areas and the area of open spaces within and surrounding buildings;
  4. Classifying, regulating, and restricting location of trades and industries and location of buildings designed for specified business, residential, and other uses;
  5. Dividing the Municipality into districts of such number, shape, area, and of such different classes as may be deemed necessary;
  6. Fixing standards to which buildings and structures shall conform;
  7. Prohibiting proposed uses, buildings, or structures incompatible with the district in which located, or eliminating gradually existing uses, buildings, or structures incompatible with the district in which located;
  8. Preventing additions, alterations, or remodeling of existing buildings or structures in such a way as to avoid restrictions and limitations imposed under this Title;
  9. Classifying, regulating, and restricting the use of property on the basis of family relationship. (Ord. 78-31, 3-5-79)
