CHAPTER 10

3 ZONING DISTRICTS

10-3-1: Establishment Of Districts

The Village is hereby divided into the following zoning districts:

R-SSuburban Residential and Planned Residential Development District
R-1One-Family and Planned Residential Development District
R-2Two-Family and Planned Residential Development District
R-3Multi-Family and Planned Residential Development District
R-4Multi-Family and Planned Residential Development District. (Ord. 04-51, 2-21-05)
MHMobile Home District
B-1Professional Office District
B-2General Business District
B-3Highway and Service Commercial District
I-1Restricted Industrial District
I-2General Industrial District

10-3-2: Zoning Maps

The location and boundaries of such districts are shown upon the Morton, Illinois, Zoning Map, which Map is hereby adopted and by reference made a part hereof, a copy of which is on file at the Village Clerk’s office.

10-3-3: Zoning Of Streets, Alleys, Public Ways, And Railroad Rights Of Way

Unless otherwise specified, all streets, alleys, public ways, and railroad rights of way shall be considered as being in the same zoning district as is abutting land. Where the street, alley, public way, or railroad right of way serves as the zoning boundary, unless otherwise indicated, the centerline shall serve as the boundary. If a street, alley, public way, or railroad right of way which has served as the zoning line shall be vacated, such zoning boundary shall remain in the center of such vacation. (Ord. 78-31, 3-5-79)

10-3-4: Zoning Of Annexed Territory

All territory which may hereafter be annexed shall be considered as being in the R-S District unless otherwise stipulated by pre-annexation agreement or until otherwise changed by the ordinance amendment procedure, as outlined in this Title.1 (Ord. 80-4, 5-5-80)

10-3-5: Interpretation Of Zoning Boundaries Lines

Where any uncertainty arises as to the location of zoning district lines, as indicated on the zoning maps, the following shall apply:

  1. Zoning district lines generally following streets, alleys, public ways, and railroad rights of way shall be construed as being on the centerline of such ways.
  2. Zoning district lines generally following lot lines shall be construed as being located on lot lines.
  3. Zoning district lines generally following Village limit lines shall be construed as the Village limit line.
  4. Zoning district lines generally following streams or watercourses shall be construed as the centerline of that stream or watercourse.
  5. Where a subdivided lot held in single ownership and being a lot of record at the date of adoption of this Title is indicated as being divided by the zoning boundary, the entirety of such lot shall be considered in the less restrictive district. For the purpose of this Title, the order of restrictiveness of districts from most restrictive to least restrictive shall be in the same order as in 10-3-1.
  6. Where unsubdivided property is indicated as being divided by a zoning boundary, the actual location of the zoning boundary shall be determined by use of the scale contained on such map.
  7. Where physical or natural features at the site are at variance with the Zoning Map, or in cases where the location of the zoning district line is not clarified by the foregoing, the Board of Appeals shall interpret the location of the zoning district line. (Ord. 78-31, 3-5-79)
