ARTICLE III

Zoning Districts and Map

§ 48-14 Establishment.

[Amended 8-19-2004 by L.L. No. 2-2004]
The Town of Mount Morris shall be divided into the following types of districts, which shall be differentiated according to use and area and for the purpose hereafter used and developed:
L.R. Low Density
H.R. High Density
B-1 Business District
B-2 Business District
R.C.P.O. District
I Industrial District

§ 48-15 Zoning Map.

The above districts shall be located, bounded and described as shown by the Zoning Map of the Town of Mount Morris, which has been designated the Official Map of the town, now on file in the office of the Town Clerk, and, together with the boundaries and designations therein, is made part of this chapter.

§ 48-16 Interpretation of district boundaries.

Where uncertainty exists with respect to the boundaries of any of the aforesaid districts as shown on the Zoning Map, the following rules shall apply:
A. 
Distances shown on the Zoning Map are perpendicular or radial distances from street lines measured back to the zone boundary line, which lines, in all cases, where distances are given, are parallel to the street line.
B. 
Where district boundaries are indicated as approximately following the center of streets or highways, street lines or highway right-of-way lines, such center lines, street lines or highway right-of-way lines shall be construed to be such boundaries.
C. 
Where district boundaries are so indicated that they approximately follow the lot line, such lot lines shall be construed to be said boundaries.
D. 
Where district boundaries are so indicated that they are approximately parallel to the center lines or street lines of streets or the center lines or right-of-way lines of highways, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the Zoning Map. If no distance is given, such dimension shall be determined by the use of the scale shown on said Zoning Map.
E. 
Where the boundary of a district follows a railroad line or is parallel thereto, such boundary shall be deemed to be located or shall be measured from a point midway between the main tracks of said railroad line.
F. 
Where the boundary of a district follows a stream, lake or other body of water, said boundary line shall be deemed to be at the limit of the jurisdiction of the Town of Mount Morris, unless otherwise designated. If no distance is given, the dimension shall be determined by the use of the scale shown on said Zoning Map.
