DISTRICTS

10.16.010 ZONING DISTRICTS ESTABLISHED

In order to carry out the provisions of this title, the Town in hereby divided into the following zoning districts:

Low Density Residential
(LR)
Medium Density Residential
(MR)
Medium Density Residential Manufactured
(MDM)
Rural Residential
(RR)
Commercial
(C)
Commercial Retail
(CR)
Light Industrial
(LI)
Developing
(D)

The conditions, requirements and regulations for each of the above established zones are set forth hereafter in this title. (Ord. 2010-2)

10.16.020 LOW DENSITY RESIDENTIAL

The following conditions, requirements and regulations shall be enforced in this zone.

  1. Low density residential designates areas for single family residential living.
  2. Site built only. As defined in MVTC 10.12.010.
  3. Minimum lot size = 10,000 sq. ft.
  4. Minimum lot width at front property line may not be less than 75 feet; 40 feet for a lot fronting on a cul-de-sac.
  5. Minimum front setback = 20 feet from property line.
  6. Minimum side setback = No portion of the building (eave, wall, foundation) may be located within 10 feet of property line.
  7. Minimum rear setback = 20 feet from property line for any permanent structure (does not include accessory buildings which are not on permanent foundations, not larger than 120 sq. ft., and can be moved).
  8. Minimum Living area of 1,000 square feet.
  9. Height restrictions = a maximum height of two stories or 36 feet from finish grade.
  10. Accessory buildings may not exceed the height of the primary dwelling, or wall height of 14 feet, whichever is lower, and must blend with the architectural style and appearance of the dwelling. Maximum size is limited to 75% of the total living area of the primary dwelling at ground line. No more than 25% of the total lot area may be occupied by accessory buildings.
  11. Detached garages will be permitted by conditional use.
  12. Apartments are not permitted in detached garages.
  13. Farm animals are not permitted in low density residential areas. (Ord. 2010-2)

10.16.030 MEDIUM DENSITY RESIDENTIAL

The following conditions, requirements and regulations shall be enforced in this zone.

  1. Medium density residential is designated for mixed use residential living; including single family dwelling, duplex dwelling, and manufactured homes.
  2. Multiple unit dwellings exceeding 4 units may be permitted under conditional use or variance. Mobile home parks are permitted as existing use only.
  3. Site built, manufactured and modular housing permitted. Provided that the manufactured or modular home has never been previously been set up on another site.
  4. Occupancy of the lot is limited to one residential structure to include; single family, duplex or multiple unit dwellings without subdivision.
  5. Minimum lot size = 10,000 sq. ft. (Except for those parcels that have two or more homes on one existing lot and are petitioning the Town to divide said lot into two or more parcels, owner may petition the Town for a variance for smaller lot size.)
  6. Minimum lot width of 85 feet at front property line; 40 feet if lot fronts on a cul-de-sac.
  7. Minimum front setback = 20 feet from any property line adjacent to a street.
  8. Minimum side setback = NO portion of the building (eave, wall, foundation) may be located within 10 feet of property line.
  9. Minimum rear setback = 20 feet from property line for permanent structures greater than 120 sq. ft. or 5 feet from a utility easement, whichever is greater.
  10. Minimum living area of 1,000 square feet.
  11. Rental apartments are not permitted in detached garages.
  12. All manufactured and modular housing must meet current IRC standards.
  13. All manufactured and modular homes must have a minimum of 1000 sq. ft. and a minimum width of 25 feet.
  14. All manufactured and modular homes will be on permanent foundation with tie downs. Homes not requiring a perimeter foundation for support will have a permanent masonry or concrete perimeter wall.
  15. All homes shall have an entry threshold/porch that compliments the style of the structure, architecture and surroundings.
  16. Roof shall consist of asphalt or wood shingles, wood shakes, clay tiles, manufactured metal panels, or similar materials, at a nominal 3/12 pitch. Typical roof types include gable, gambrel, hip, shed, mansard, and salt box.
  17. Facade of the structure shall incorporate window styles, including but not limited to double hung, casement, fixed, sliding, basement, awning, bay, bow, Gothic, and Palladian. Exterior siding materials shall include but not be limited to wood shingles, wood shakes, vinyl, plywood, clap board, aluminum, brick veneer, stone veneer, stucco, brick face stucco, or half timbering. Entrances may include pilasters and pediments.
  18. The structure shall include a minimum roof overhang of 8 inches measured from the outside of the exterior wall.
  19. A building permit and site plan showing proposed building(s)and setbacks from property lines are required.
  20. These standards shall not be waived or varied.
  21. All multi family dwellings must provide off street parking for a minimum of 2 vehicles per unit.
  22. Accessory buildings, including detached garages, may not exceed the height of the primary dwelling and must blend with the architectural style and appearance of the dwelling. Maximum size is limited to 75% of the total living area of the primary dwelling, at ground line. No more than 25% of the total lot area may be occupied by accessory buildings. An accessory building is not permitted unless a primary dwelling is present.
  23. Farm animals are not permitted in medium density residential areas. (Ord. 2010-2)

10.16.040 MEDIUM DENSITY MANUFACTURED RESIDENTIAL

Medium density manufactured residential is designated primarily for single family residential living utilizing manufactured/mobile housing and includes those existing manufactured home parks in operation at the time of the adoption of this code. The following conditions, requirements and regulations shall be enforced in this zone.

  1. Manufactured homes, subject to the following requirements, are permitted. Site built housing consistent with zone requirements are also permitted.
    1. Minimum lot size = 7,500 sq.ft.
    2. Minimum lot width of 75 feet at front property line; 40 feet if lot fronts on a cul-de-sac.
    3. Minimum front setback = 10 feet from any property line adjacent to a street.
    4. Minimum side setback = NO portion of the building (eave, wall, foundation) may be located within a minimum of 15 feet total on both sides, with no less than 5 feet from either side property line.
    5. Minimum rear setback = 10 feet from property line or 15 feet for the nine lots fronting the east side of Oak Street, due to the utility easement, for permanent structures greater than 120 sq. ft. (Ord. 2010-2)
  2. Manufactured housing that incorporates a permanent chassis as an integral component of the structure must meet the following standards:
    1. All manufactured and modular housing must be new construction. New meaning "Never Previously set on another site", except those on Elm Drive, Juniper Drive or in trailer parks may not be older than 20 years of age, must have concrete runners or pads and approved tie down system to prevent shifting from supporting system.
    2. All manufactured and modular housing must meet currently adopted IRC standards.
    3. All manufactured and modular homes, except for those on Elm Drive and Juniper Drive in Mountain View Park II Subdivision and existing manufactured home parks, must have a minimum of 1,000 square feet and a minimum width of 25 feet.
    4. All manufactured and modular homes will have a supporting system as recommended by the manufacturer.
    5. All manufactured and modular homes will be on permanent foundation with tie downs. Homes not requiring a perimeter foundation for support will have a permanent masonry or concrete perimeter wall.
    6. Manufactured homes on Elm Drive and Juniper Drive and existing manufactured home parks are exempt from the concrete or masonry perimeter wall requirement, but will have a durable perimeter wall installed which gives the appearance of a permanent foundation, or skirting which matches the siding on the dwelling.
    7. Each residence shall have an entry threshold/porch that compliments the style of the structure, architecture, and surroundings as required. Minimum entry threshold size = 32 sq. ft.
    8. Roof shall consist of asphalt or wood shingles, wood shakes, clay tiles, manufactured metal panels, or similar materials, at a nominal 3/12 pitch. Typical roof types include gable, gambrel, hip, shed, mansard, and salt box.
    9. Facade of the structure shall incorporate window styles, including but not limited to double hung, casement, fixed, sliding, basement, awning, bay, bow, Gothic, and Palladian.

  3. Business License Required: Anyone providing a service or selling goods and wares in the Town of Mountain View is required to obtain a business license, this includes manufactured home parks. (Ord. 2010-2)

10.16.050 RURAL RESIDENTIAL

The following conditions, requirements and regulations shall be enforced in this zone.

  1. Rural residential areas allow for a primary residence on a larger lot resulting in reduced density. (Ord. 2010-2)
  2. Rural residential differs from Medium and Low Density in that horses and other domestic animals are permitted in rural residential, but may not be pastured as a principal use. The following will apply for this type of use:
    1. Minimum lot size = 1 acre
    2. Types of dwellings will conform to standards for medium density residential areas.
    3. Setbacks will conform to medium density residential areas.
    4. Accessory buildings (corrals, barns, etc.) are required to be maintained so as to provide shelter and prevent animals from encroaching on neighboring property.
    5. Animals are permitted as long as adequate facilities are provided and maintained to prevent creating a nuisance, and pasturing of animals is not the primary use of the property.
    6. Adequate fencing is required to prevent animals from encroaching on neighboring property.
    7. If proposed for annexation, such subdivision will be planned with streets, water and sewer, and other subdivision requirements that conform to town development regulations. (Ord. 2010-2)

10.16.060 COMMERCIAL

The following conditions, requirements and regulations shall be enforced in this zone.

  1. Commercial zone permits any office, retail, automobile service station, restaurant, day care center, residential or other small scale retail or personal service use servicing the day to day needs of the residents of the surrounding area; nurseries, physical fitness centers, community and fraternal clubs, churches, libraries; supermarkets, department stores, hospitals, automobile sales, lumber yards, wholesale outlets, printing plants, cocktail lounges and taverns, bakeries, theaters, bowling alleys, museums, hotels and motels. Recreational vehicle parks are permitted by conditional use only, which will be considered by the Town Council.
  2. Cocktail lounges, taverns and other liquor establishments may not be located within 1,000 feet of schools, parks, day-care centers, library or religious or cultural facilities.
  3. Minimum front setback is 20 feet from the property line for those properties adjacent to Highway 414 and that property on First Street adjoining Highway 414. (Ord. 2010-2)

10.16.070 COMMERCIAL/RETAIL

The following conditions, requirements and regulations shall be enforced in this zone.

  1. Commercial/Retail zone allows for any professional office, service office, retail, restaurant, or retail or personal service use serving the day to day needs of the residents of the surrounding area; nurseries, physical fitness centers, community and fraternal clubs, supermarkets, department stores, medical clinics, lumber yards, wholesale outlets, cocktail lounges and taverns, bakeries, theaters, bowling alleys, museums, hotels or motels and any other compatible use approved by the Town Council.
  2. Minimum front setback is 20 feet from the property line.
  3. Off street parking, as required by the IBC, shall be provided.
  4. Landscaping as approved by the Town Council shall be installed and maintained.
  5. The following exterior design standards shall apply to all new construction and substantial remodeling of existing structures within this zone:
    1. Structures shall incorporate a general design theme combining the elements of western American and alpine architecture or a "Western Alpine" motif. This architectural theme will include elements such as: pitched roof lines; stone; brick; stucco; timbers; wood siding; earth-tone colors; covered porches or porticos; gable windows; staggered, offset or recessed areas along exterior walls. Examples of western alpine motif include the Mountain View Town Hall, Union Telephone Main Office, Benedicts Thriftway, Pony Express.
    2. Structure exteriors shall not incorporate: metal siding; non-decorative cement block; highly reflective metal roofing, trim or glass; visible flat roof lines;
    3. Proposed exterior design plans shall be submitted to and approved by the Town Zoning Official prior to issuance of a building permit. Decisions of the Building Official may be appealed to the Town Council for review and reconsideration. (Ord. 2010-2)

10.16.080 LIGHT INDUSTRIAL

The following conditions, requirements and regulations shall be enforced in this zone.

  1. Light industrial zone permits any uses permitted in commercial and large scale retail, commercial wholesale uses, storage yards and self storage centers, distributors, major automobile repair shops, machine shops and woodworking shops. (Ord. 2010-2)
