10.24 DEVELOPMENT

REGULATIONS

10.24.010 OFF-STREET PARKING

The following conditions, requirements and regulations shall be enforced as to off-street parking.

  1. There shall be provided at the time of erection of any main building or at the time such buildings are altered, enlarged, converted or increased in capacity minimum off street parking space with adequate provision for ingress and egress by standard sized vehicles in accordance with requirements of this code.
    1. Required number of spaces shall not be less than listed below, except that the code official may approve less off street parking when the proponent of a use demonstrates that, due to special circumstances involved with a particular use, it is obvious that the off street parking required by this code exceeds any reasonable likely need.
      1. Dwelling units = 2/dwelling unit Restaurant/Health Club = 1/100 gross sq. ft.
      2. Office/Retail/Medical Office = 1/200 gross sq. ft.
      3. Assembly = 1/300 gross sq. ft.
      4. Warehouse/Industrial = 1/500 gross sq. ft.
    2. Where there is a combination of uses on a lot, the required number of parking spaces shall be the sum of that found for each use.
    3. The parking spaces required by this code shall be provided on the same lot as the use or where the exclusive use of such is provided on another lot not more than five-hundred (500) feet radially from the subject lot within the same or less restrictive zoning district.
    4. A minimum width of nine (9) feet shall be provided for each parking stall.
    5. A minimum length of twenty (20) feet shall be provided for each parking stall.
    6. Private driveways shall be at least nine (9) feet wide.
    7. Commercial driveways shall be at least twelve (12) feet wide for one way traffic; twenty-four (24) feet wide for two way traffic.
    8. All parking stalls except for private garage or parking area for exclusive use of a single family dwelling shall be striped substantially.
    9. A four (4) foot high buffer shall be provided for all parking areas of five or more parking spaces adjacent to residential zones.
    10. All lights illuminating a parking area shall be designed and located so as to reflect away from any street and adjacent property. (Ord. 2010-2)

10.24.020 FENCE HEIGHTS

The following conditions, requirements and regulations shall be enforced as to fence heights.

  1. In all residential zones except Medium Density Manufactured (MDM), all fence and retaining wall heights within twenty (20) feet from the front property line (10 feet in MDM), shall not exceed three and one-half (3 ½) feet for a solid material fence or four (4) feet for chain link fence. Fences on a street side of any lot shall be limited to a height or material which does not obstruct the view of traffic or pedestrians on the street. Any fence that is to be built higher than six (6) feet must have a building permit and meet structural requirements to ensure safety and stability.
  2. Fences and retaining walls shall be constructed of the following types of approved materials: Vinyl, chain link, masonry, wood and wrought iron, or other materials as approved by the Building Official. Barbed wire, wire mesh or pre-constructed fence panels are prohibited in all zones except Rural Residential. (Ord. 2010-2)

10.24.030 LOCATION OF ACCESSORY BUILDINGS

The following conditions, requirements and regulations shall be enforced as to accessory building.

  1. Accessory buildings shall occupy the same lot as the main use or building.
  2. All accessory buildings shall be separated from the main building by ten (10) feet.
  3. An accessory building used as a private garage may be located in any portion of the rear yard or side yard, subject to minimum setbacks.
  4. All accessory buildings under one-hundred twenty (120) square feet, used for storage or other similar use, may be located in any portion of the rear yard or side yard. No storage building shall be located in the front yard. (Ord. 2010-2)

10.24.040 LANDSCAPING REQUIREMENTS

The following conditions, requirements and regulations shall be enforced as to landscaping for all zones within the corporate limits of the Town of Mountain View.

  1. Landscaping is required for all new buildings and additions over five-hundred (500) square feet. All landscaping shall be completed within one (1) year from the date of occupancy of the building. (Ord. 2010-2)

10.24.050 SIGNS

The following conditions, requirements and regulations shall be enforced as to signs.

  1. General. A sign shall not hereafter be erected, re erected, constructed, altered or maintained, except as provided by this code, and after a permit has been issued by the appropriate official. (Ord. 2010-2)
  2. Signs in Residential Zones.
    1. Residential developments of four or more dwelling units shall be permitted one development complex sign for each public street frontage not within the project. Such signs may be placed in any location on private property provided the sign complies with the same height limitations specified for fences. Maximum sign area for each sign shall be two (2) square feet plus one (1) square foot for each dwelling unit or lot, not to exceed twenty-five (25) square feet in area per face.
    2. Nonconforming and conditional use permitted businesses shall be permitted facade signage and/or one freestanding sign per public street frontage, not to exceed a combined total of twenty-five (25) square feet in area for every one-hundred fifty (150) feet of public street frontage. For frontage greater than one-hundred fifty (150) square feet, one (1) square foot of additional sign area shall be allowed for each six (6) feet of frontage up to a maximum of eighty (80) square feet. The height of a freestanding business sign shall not exceed that specified for fences. The height of freestanding signs for other conditionally permitted uses such as churches and schools shall be limited to fifteen (15) feet. (Ord. 2010-2)
  3. Signs in Commercial and Light Industrial Zones. The following conditions, requirements and regulations shall be enforced as to signs in commercial zones.
    1. Shall be designed, constructed and maintained in accordance with the International Building Code as adopted by the Town of Mountain View. (Ord. 2010-2)

10.24.060 NONCONFORMING STRUCTURES AND USES

  1. Except as otherwise required by law, a structure or use legally established prior to the adoption date of this code may be maintained unchanged. In other than criminal proceedings, the owner, occupant or user shall have the burden to show that the structure, lot or use was lawfully established.
  2. Any lot or structure, or portion thereof, occupied by a nonconforming use, which is or hereafter becomes vacant and remains unoccupied by a nonconforming use for a period of six (6) months shall not thereafter be occupied, except by a use which conforms to this code. For the purposes of this section, any non-conforming structure removed from a property WILL NOT be replaced by any structure other than a conforming structure.
  3. If any nonconforming structure or use is, by any cause, destroyed to the extent of seventy-five percent (75%) of its market value as determined by the building official, it shall not thereafter be reconstructed as such.
  4. Maintenance, repairs and structural alterations may be made to nonconforming structures or to a building housing a nonconforming use with valid permits.
  5. A change of use of a nonconforming use of a structure or parcel of land shall not be made except to that of a conforming use. Where such change is made, the use shall not thereafter be changed back to a nonconforming use.
  6. All additions to nonconforming structures shall conform to the requirements of this code.
  7. Additions to structures housing nonconforming uses that increase the area of a nonconforming use shall not be made. (Ord. 2010-2)
