10.20 SPECIAL

PROVISIONS

10.20.010 HOME OCCUPATIONS

The following conditions, requirements and regulations shall be enforced as to home occupations.

  1. Home occupation is defined as a business operated out of the home which is subordinate to the main use as a residence, which does not employ more than one person other than family members.
  2. Permitted in all zones.
  3. A business license is required for all home occupations.
  4. The home occupation may not exceed 25 percent of the floor area of the primary structure and 50% of an existing accessory building on the premises.
  5. Inventory and supplies shall not occupy more than 50% of the area permitted to be used as a home occupation.
  6. There shall be no exterior display or storage of goods on said premises.
  7. There shall be no more than one advertising sign displayed on the premises and the sign shall not exceed 2 square feet.
  8. Location of sign shall be approved by the code official.
  9. Home occupations involving beauty shops or barber shops shall require a conditional use permit.
  10. Automobile repair or maintenance is not permitted as a home occupation.
  11. Sales and services to patrons shall be arranged by appointment and scheduled so that not more than one patron vehicle is on the premises at the same time.
  12. Two additional off street parking spaces shall be provided, except only one need be provided if the home occupation does not have an employee. (Ord. 2010-2)

10.20.020 ADULT USES

The following conditions, requirements and regulations shall be enforced as to adult uses.

  1. Adult use businesses are defined as businesses which sell, rent, or loan materials of a sexual nature for use on the premises or at other locations. They are only permitted in light industrial zones by conditional use. The following provisions apply to adult use business.
    1. No adult use business shall be located within 1,000 feet of a park, school, day care center, library or religious or cultural activity.
    2. No adult use business shall be located within 500 feet of any other adult use business or any agricultural or residential zone boundary.
    3. Such distances shall be measured in a straight line without regard to intervening structures, topography and zoning. (Ord. 2010-2)

10.20.030 PARKING OR ABANDONING MANUFACTURED HOMES ON STREETS

It shall be unlawful for any person to park, place or abandon any manufactured home upon any street, alley, highway or other public place within the corporate limits of the town; or temporary stopping or parking for more than twenty-four (24) hours, subject to any other limitations that may be imposed by other ordinances relative to parking. 10.20.040 EXISTING BUILDINGS AND USES

  1. General. Lawfully established buildings and uses in existence at the time of the adoption of this code may have their existing use or occupancy continued, if they are maintained with their conditions of approval, provided such continued use is not dangerous to life.
  2. Additions, Alterations and Repairs. Additions, alterations or repairs may be made to any building or use without requiring the existing building or use to comply with the requirements of this code, provided the addition, alteration or repair conforms to that required for a new building or use.
  3. Maintenance Required. All buildings or uses, both existing and new, and all parts thereof, shall be maintained. The owner or designated agent shall be responsible for the maintenance of buildings and parcels of land. To determine compliance with this paragraph, the code official may cause any structure or use to be inspected.
  4. Moved and Temporary Buildings. Buildings or structures moved into or within the Town of Mountain View shall comply with the provisions of this code for new buildings and structures. Temporary structures such as reviewing stands and other miscellaneous structures, sheds, canopies or fences used for the protection of the public around and in conjunction with construction work may be erected, provided a special approval is received from the code official for a limited period of time. Temporary buildings or structures shall be completely removed upon the expiration of the time limit stated in the permit. (Ord. 2010-2)
