CERTIFICATE OF OCCUPANCY

A.

Requirement. No land or building or other structure or part thereof for which a building permit is required shall be used or occupied until the Building Official has issued a certificate of occupancy stating that such building or structure or part thereof is found to be in conformity with the applicable building codes and the provisions of this Ordinance.

B.

Notification. Within five (5) business days after the owner or his agent has notified the Building Official that a building or premises or part thereof is ready for occupancy or use, it shall be the duty of the Building Official of the municipality to make a final inspection thereof, and to issue a certificate of occupancy if the building or premises or part thereof is found to conform with the applicable building codes and the provisions of this Ordinance, or if such certificate is refused, to state the refusal in writing with the cause.

C.

Revocation. The Building Official may suspend or revoke a certificate of occupancy wherever the certificate is issued in error, or on the basis of incorrect information supplied, or where it is determined that the building or structure or portion thereof is in violation of any ordinance or regulation or any of the provisions of the applicable building code.

D.

Appeal of Denial or Revocation. If the certificate of occupancy is denied or revoked, the applicant may appeal the action to the Zoning Board of Adjustment, as provided in Section 6 of this Ordinance.
