CHAPTER 10

MOBILE HOME ZONE "T"

11-10-1: MOBILE HOMES RESTRICTED:

Except as provided in Chapter 6, Section 11-6-1, Chapter 7, Section 11-7-1 and Chapter 9, Section 11-9-1, mobile homes and mobile home courts, parks and subdivisions shall hereafter be restricted to location and use as specified in this Chapter of the zoning law. (Ord. 163, 11-5-84, eff. 11-14-84)

11-10-2: DEFINITIONS:

Every mobile home and mobile home court, park or subdivision hereafter installed or constructed shall conform to the following provisions:
MOBILE HOME: A detached single-family dwelling unit with all of the following characteristics:
   A.   Designed for long-term occupancy and containing sleeping accommodations, a flush toilet, a tub or shower bath and kitchen facilities with plumbing and electrical connections provided for attachment to outside system.
   B.   Designed to be transported after fabrication on its own wheels, or a flatbed or other trailers or detached wheels.
   C.   Arriving at the site where it is to be occupied as a dwelling, usually including major appliances and furniture and ready for occupancy except for minor and incidental unpacking and assembly operations, such as location on foundation supports, connection to utilities and the like.    D.   Excluding from the definition of mobile home any structure greater than twenty feet (20') in width and having six hundred (600) or more square feet of floor space on one floor. (Ord. 174, 9-3-86)
MOBILE HOME COURT: Any site or tract of land whereupon two (2) or more mobile homes or travel trailers are placed, located and maintained for dwelling purposes on a temporary basis.
MOBILE HOME PARK: Any site or tract of land upon which two (2) or more mobile homes are parked on a permanent or semi- permanent basis, either free of charge or for revenue purposes; including any roadway, building, structure, vehicle or enclosure used or intended for use as a part of the facilities of such park.
MOBILE HOME SUBDIVISION: Any parcel of land which may be divided or proposed to be divided in accordance with the definition of subdivision, whereupon one or more mobile homes shall be placed.

11-10-3: SITE SELECTIONS:

   (A)   Location: A mobile home court, park or subdivision shall not be located close to swamps, or other potential breeding places of insects or rodents, subject to flooding, fire, or other hazards or exposed to chronic nuisances, such as noise, smoke, fumes, and odors. The site should be bounded on at least one side by a public street or highway.
   (B)   Topography: The topography must be favorable to good site drainage, minimum grading, trailer placement and ease of maintenance.
   (C)   Availability of Utilities: The site must be readily accessible to public utilities, including water, sewerage, electricity.
   (D)   Necessary Land Area: The area of a mobile home park or court must be sufficient in size to accommodate the number of mobile home spaces desired, roads and parking areas for motor vehicles, service areas, buildings and playgrounds and on-site utilities where public utilities are not available.

11-10-4: SITE IMPROVEMENTS:

The physical improvements of the site must be arranged to provide a convenient means of pedestrian and vehicular access to each mobile home space, parking areas, accessory buildings, an adequate supply of potable water, a safe method of sewage disposal, electrical service for lighting and power and diversion of surface water away from buildings, mobile home spaces, service and recreation areas and its disposal from the site.

11-10-5: SITE PLANNING:

A plan of the proposed mobile home court or park must be developed for approval of the Engineer or other official indicating the layout of mobile home spaces, roads, walks, service buildings, service areas, utilities, and necessary grading.

11-10-6: MOBILE HOME SPACE SIZES:

Each mobile home space must be not less than one thousand two hundred fifty (1,250) square feet in area and should be at least twenty five feet (25') wide.

11-10-7: SPACING OF MOBILE HOMES:

The minimum spacing between mobile homes or between mobile homes and buildings must be:
   (A)   Side-to-side spacing: Fifteen feet (15').
   (B)   End-to-end spacing: Ten feet (10'), space between end of mobile home bodies and not chassis.
   (C)   No mobile home should be located closer than twenty five feet (25') from the right-of-way line of a main highway, or ten feet (10') from the mobile home court property line.

11-10-8: ROADS, WALKS AND PARKING AREAS:

   (A)   General Circulation: Safety and convenience must be a major consideration in the layout of roads, walks and parking areas within the mobile home court. All roads must be continuous.
   (B)   Servicing: Suitable vehicular access for firefighting equipment, delivery of fuel, removal of garbage and refuse, and for other necessary services must be provided. Minimum services distances as required by local regulations or accepted practice must control.
   (C)   Width of Roads and Parking Areas: Main access roads, excluding parking, two (2) lane, twenty feet (20'). The same number of motor vehicle parking spaces must be provided as the number of mobile home spaces. These must be provided in special parking areas.
   (D)   Walks:
      1.   The mobile home park or court walk system must include a walk from the entrance of each mobile home to service facilities.
      2.   Width of walks: Public walks, minimum four feet (4'); entrance walks (from public walk to mobile home door), two feet (2').

11-10-9: SERVICE BUILDINGS:

Each mobile home court or park must be provided with one or more service buildings containing the requisite number of plumbing fixtures and other service equipment. The service buildings must conform in general to the following requirements.
   (A)   Location: The building should be located not more than two hundred feet (200') from any dependent mobile home space.
   (B)   Construction: The materials and methods used in the construction of service buildings must conform to the Building Code 1 for buildings of this nature. It must have an interior finish which is moisture resistant and can be easily cleaned. All rooms of service buildings must be ventilated and all exterior openings provided with screens.
   (C)   Facilities: Separate men's and women's toilet rooms must be provided and distinctly marked. These rooms must be separated by a sound resistant wall. A vestibule or screen wall must be provided to prevent direct view into the toilet rooms when exterior doors are open.
   (D)   Plumbing Fixtures:
      1.   Every mobile home court must provide adequate toilet and laundry facilities. In no instance should there be less than one laundry unit (laundry tray or washing machine); one water closet, one lavatory and one shower for women and one water closet, one lavatory and one shower for men. A slop water closet (water closet with seat removed) must be provided in each service building. The slop water closet should be in a separate room of the service building with a single direct opening to the outside.
      2.   The facilities listed hereinabove will accommodate any number of independent mobile homes, and up to ten (10) dependent mobile homes. One water closet must be provided for each sex for every ten (10) additional dependent mobile homes. (Urinals for men may be substituted for one-third (1/3) of these water closets.)
      3.   One lavatory must be provided for each sex for every ten (10) additional dependent mobile homes and one shower or bathtub for each sex for every twenty (20) additional dependent mobile homes. A laundry unit must be provided for every twenty (20) additional mobile home spaces.
      4.   All water closets and bathtub or showers for women, and all water closets and bathtub or showers for men must be located in separate compartments, with self closing doors. Gang type shower compartments may be used for men. Individual shower stalls must be approximately three by three feet (3' x 3'). Showers for women must have a dressing compartment with stool or bench. The room containing the laundry units must be separated from the toilet rooms, and have an exterior entrance only.
      5.   All plumbing installations shall conform to the Plumbing Code. 2
      6.   All electrical installations shall conform to the Electrical Code. 3
   (E)   Heating facilities capable of maintaining a temperature of seventy degrees (70) Fahrenheit in cold weather shall be provided.
   (F)   Hot Water: Facilities should provide for the continuous supply of three (3) to five (5) gallons of hot water per mobile home space. Hot water at a temperature of about one hundred eighty degrees (180) Fahrenheit should be provided for clothes washing equipment.

11-10-10: LAUNDRY DRYING FACILITIES:

Mechanical laundry drying equipment or laundry drying yards must be provided. Laundry drying machines must be located in the service buildings. Where laundry drying yards are used, they must be convenient to service buildings and have a area of approximately fifty (50) square feet per mobile home space.

11-10-11: REFUSE COLLECTION:

Refuse must be stored in fly-tight and rodent-proof containers. Each coach space shall be provided from four (4) to six (6) gallons of refuse storage capacity per day. Refuse container stations, where used, should be located a maximum of two hundred feet (200') from any mobile home space and preferably not more than one hundred fifty feet (150').

11-10-12: RECREATION AREAS:

At least one hundred (100) square feet per mobile home space must be made available in one or more areas for recreation uses. These areas should be located so as to be free of traffic hazards.

11-10-13: SITE ENGINEERING:

   (A)   Grading and drainage must be performed so that water will drain away from mobile home spaces, buildings, service and recreation areas, and off the site in a manner which will provide reasonable freedom from erosion. Walks, driveways and retaining walls must be so constructed as not to interfere with drainage.
   (B)   Roads must be constructed to conform to City road standards. Roads must be crowned at center to shed water to drainage facilities.

11-10-14: MOBILE HOMES: RESTRICTED PARKING:

   (A)   Any mobile home is hereby restricted to parking only in an approved mobile home court or park except as when in a stored capacity.
   (B)   A mobile home is hereby described as a vehicle constructed in such a manner as to permit occupancy as a dwelling or as a sleeping space for one or more persons.
   (C)   Anyone violating this Section shall be deemed guilty of a misdemeanor and is subject to the lawful penalties of fine and/or imprisonment or both. (Ord., 5-7-84)

11-10-15: INTERNAL ROADS NOT MEETING CITY STANDARDS:

   (A)   By a conditional use permit, the City Council may allow a developer of a mobile home park or mobile home court to have internal roads which do not meet City standards. These roads, however, shall be at least twenty four feet (24') curb to curb and where possible, the developer shall make a good faith effort to put in a thirty foot (30') street curb to curb.
   (B)   Whenever roads in a mobile home court or mobile home park do not meet City road specifications, the City shall never maintain those roads in any manner, plow or accept those roads. The City shall never accept the roads into the City system until the roads are brought up to the City standards by the property owner.
   (C)   In the event that from time to time the City chooses to maintain the road or allow clearance of the road by a City crew, that act shall not set a precedent and shall not be considered an acceptance of the road by the City.
   (D)   The fact that the City may maintain or clear roads or exercise jurisdiction over roads which are not up to City standards or which are not in as good a condition as the mobile home court or mobile home park roads shall not be a precedent for the City being required to accept or maintain or clear roads which are hereafter built and which do not meet City specifications.
   (E)   In all roads which are created in a mobile home park or mobile home subdivision, there must be sufficient clearance for emergency vehicles to perform emergency tasks, but this requirement shall not mean that the City in any way accepts substandard roads.
   (F)   In the future, any landowner who purchases property in a mobile home park or mobile home subdivision shall be put on notice by the seller that the City is not responsible for the roads and that it will be the responsibility of the purchaser to bear the costs of bringing those roads up to the City standards in the event that the purchaser desires to have the City accept and maintain those roads.
   (G)   Should the City choose to allow a developer or landowner to construct roads which are not up to City standards, that shall in no manner be deemed as a waiver by the City of its right to control City sewer and City water systems. (Ord. 165, 1-7-85)
