CHAPTER 110

20.- EXCEPTIONS

Sec. 110.20.010.- Intent and purpose.

The purpose of this section is to provide consistent and standard general exceptions for the development and use of all land within the county, except the Lewiston Area of City Impact and incorporated cities.

Sec. 110.20.020. - Projections from buildings.

In residential zones, cornices, eaves, canopies, sunshades, gutters, chimneys, flues, belt courses, leaders, sills, pilasters, lintels, and other similar architectural features shall not extend beyond the exterior walls more than 33½ percent of the distance of the required setback.

Sec. 110.20.030. - General exceptions to front yard requirements.

The following exceptions to the front yard requirements are authorized for a lot in any zone:

(1)

On corner lots, the owner of the lot may determine which road the front of the lot shall face.

(2)

If the elevation of a lot rises or falls more than four feet in the first 20 feet measured from the front lot line, the following provision shall apply: The required depth of the front yard shall be equal to the horizontal distance measured from the front lot line to where the average lot profile line intersects a horizontal line four feet above or below the front lot line.

The planning and zoning commission may establish greater yard requirements when the yard abuts a road which the county has designated for widening.

Sec. 110.20.040. - General exceptions to building height limitations.

The following types of structures or structural parts are not subject to the building height limitations of this chapter: buildings used for the storage of agricultural produce pursuant to Idaho Code, § 39-4116, chimneys, tanks, church spires, belfries, domes, monuments, fire and hose towers, observation towers, transmission towers, smokestacks, flagpoles, radio and television towers, masts, aerials, cooling towers, elevator shafts, and other similar projections.

Sec. 110.20.050. - General exceptions to lot sizes.

For an original residence segregation lot, the lot size shall be at least one acre, but not more than two acres unless written approval by the zoning official for a larger lot is received. Conditions for a larger lot may include accessory buildings placed so that the lot would exceed two acres, topographic conditions such as a water body affecting the site or a utility (water or septic) used for the residence placed so that more than two acres is necessary. The residual acreage of the original lot shall meet the minimum lot size requirement of the zone in which it is located. However, for an original residence segregation lot, the lot depth and lot width shall each be at least 100 feet.
