- LEVELS OF SERVICE
The purpose of this article is to provide a ready reference for determining development compliance with the levels of service adopted by this ordinance in compliance with Chapter 163, F.S. and Chapter 9J-5, F.A.C.
The following minimum levels of service shall guide the issuance of development permits pursuant to the concurrency management system (See Article 6).
15.02.01 Roadways.
Local: Palm Boulevard LOS D
Connector Roads LOS D
Collector Roads LOS D
All others LOS C
15.02.02 Sanitary sewer. One hundred (100) gallons/capita/day (reference Policy 10.A.1.3, comprehensive plan);
15.02.03 Solid waste. 5.0 lbs./capita/day (reference Policy 10.B.1.5, comprehensive plan);
15.02.04 Stormwater management.
a.
Treat the first inch of run-off on-site (one-half inch minimum). That amount will vary depending on the amount of impervious surface, from one-half inch up to one inch. For discharges into Outstanding Florida Waters, must treat an additional fifty percent (50%) of the applicable treatment volume; and
b.
Must provide detention so that the peak rate of post development run-off will not exceed the pre-development peak rate of run-off for the 25 year, 24 hour design storm event, utilizing a Natural Resources Conservation Service (NRCS) Type II distribution with an antecedent moisture condition II. Required detention volume must be available within 14 days following the design storm event; and

Elimination of stormwater from paved streets within twenty-four (24) hours of all but catastrophic rainfall events (reference Policy 10.C.2.3, comprehensive plan);

15.02.05 Potable water: One hundred twenty-four (124) gallons/capita/day (reference Policy 10.D.1.2, comprehensive plan);
15.02.06 Recreation and open space: One (1) acre per one thousand (1,000) population (reference Policy 12.A.3.2, comprehensive plan).
15.02.07 Public schools: 100% of permanent FISH capacity for Elementary, Middle, High, and Special Purpose Schools (reference Policy 17.A.5.1, comprehensive plan).

The following sets forth criteria for determining and managing concurrency. (see Article 6 for methodology).
15.03.01 Roadways (concurrency).
(a)
The city may not issue permits for development that will generate more trips than the transportation system can accommodate at the adopted LOS except as provided under section 5.02.01; and Article 6.04.
(b)
The comprehensive plan: 2035 Foundation (Support) Documents, Chapter 5 projects Department of Transportation (DOT) compatible LOS for roadways in Niceville through the year 2035. Pertinent information that may be used to satisfy roadway concurrency may be found in this chapter.
(c)
The impact of various types of development on roadways is generalized in Article 6. Impact is determined by calculating the estimated number of trips to be generated by the project. If the estimated trips do not degrade the affected roadways beyond the adopted LOS, the concurrency requirement is met.
(1)
If affected roadways are degraded beyond the adopted LOS, provisions in sections 6.04 and 6.05.03 apply.
(2)
Where the development will impact on more than one (1) road, the calculations shall show the split in generated traffic.
(3)
Calculations used in projecting traffic to be generated shall be based on the trip generation table provided under section 6.06.02, Trip generation rates.

15.03.02 Sanitary sewer.
(a)
Development shall not be approved unless there is sufficient available capacity to sustain the adopted level of service.
(1)
Applicants for wastewater capacity shall contact the planning director to obtain most recent flow/demand ratios and available capacity.
(2)
If capacity exists, the application for a DEP wastewater permit must first be approved by the City of Niceville.
(b)
Developers shall be required to construct sewers from the nearest source to the planned activity at no expense to the city.

15.03.03 Stormwater management.
(a)
Development shall not be approved unless there is sufficient stormwater capacity to sustain the adopted level of service.
(b)
The comprehensive plan foundation documents provide available data and analysis on stormwater management. Generally Policy 10.C.2.3 of the comprehensive plan and as stated under section 15.02.04 above applies.

15.03.04 Potable water.
(a)
The city shall not approve development unless there is sufficient available capacity to sustain the adopted levels of service.
(b)
Except as provided under section 6.05.03, developers shall be required to construct water lines from the nearest source to the planned activity at no expense to the city.
(1)
All necessary state permit applications shall be the responsibility of the developer.
15.03.05 Recreation and open space.
(a)
The city shall not approve development unless there is sufficient available capacity to sustain the adopted levels of service.
(b)
The comprehensive plan foundation documents, Chapter 9, provides available data and analysis on recreation and open space. Generally, Policy 12.A.3.2 of the comprehensive plan and as stated under section 15.02.06 applies.
