ARTICLE XXIV

INTERPRETATION, APPLICATION, VIOLATIONS, VALIDITY, CONFLICT AND EFFECTIVE DATE

Section 24.01.- Interpretation, purpose and conflict.

In the interpretation and the application of the provisions of this ordinance, they shall be held to be the minimum requirements for the promotion of the public safety, health, convenience, comfort, prosperity, and general welfare.

It is not intended that this ordinance interfere with or abrogate or annul any ordinance, resolution, rules, regulations, or permits previously adopted or issued and not in conflict with any of the provisions of this zoning ordinance, or which will in the future be adopted or issued pursuant to law relating to the use of buildings or premises, and likewise not in conflict with this zoning ordinance. It is not intended that this ordinance interfere with or abrogate or annul any easements, covenants or other agreements between parties. When this ordinance imposes greater restrictions, imposes higher standards, or requires larger open spaces, or larger lot areas than are imposed or required by any ordinance, resolution, rule, regulation, or agreement between parties, the provisions of the zoning ordinance shall control.

Section 24.02. - Violations and penalties.

Any person violating or neglecting or refusing to comply with any of the provisions of this ordinance shall, upon conviction thereof, be punished by imposition of a fine not to exceed $200.00 or by imprisonment for a period not to exceed 60 days, or by imposition of both fine and imprisonment in the discretion of the court of proper jurisdiction. Each day that a violation is permitted to exist shall constitute a separate offense.

Section 24.03. - Validity.

The zoning ordinance and the various articles, sections, subsections, paragraphs, and clauses thereof, are hereby declared to be severable. If any article, section, subsection, paragraph or clause is adjudged unconstitutional or invalid, it is hereby provided that the remainder of the zoning ordinance shall not be affected thereby.

Section 24.04. - Conflicting provisions repealed.

All other ordinances or resolutions and parts of ordinance or resolutions in conflict with this zoning ordinance, to the extent of such conflict and no further, are hereby repealed.

Section 24.05. - Effective date.

The zoning ordinance shall take effect and be in force March 1, 2007.
