ARTICLE IV

District Regulations

§ 181-12 Permitted uses in all districts.

The following uses shall be permitted in all districts: church, synagogue or other religious building; public school; public park, public recreation building or area; public library; government building or use; parking area for a principal permitted use as required by this chapter.

§ 181-13 Permitted uses in residential districts.

The following are permitted uses in residence districts:
A. 
In all districts.
(1) 
Principal uses:
(a) 
One-family dwelling.
(2) 
Special permit uses:
(a) 
Hospital.
(b) 
Nursing home.
(c) 
Funeral home.
(d) 
Nonprofit membership club.
(e) 
Nursery school.
(f) 
Public utility structure or yard.
(g) 
One-family dwelling used on a seasonal basis.
(h) 
Private nonprofit recreation area.
(3) 
Accessory uses:
(a) 
Home occupation.
(b) 
Professional office.
(c) 
Private garage.
(d) 
Private swimming pool.
(e) 
Customary accessory structures to a dwelling use, such as a playhouse, toolhouse, garden house or greenhouse.
B. 
In R-1 or R-2 Districts only.
(1) 
Principal uses:
(a) 
Farm or other agricultural use.
(2) 
Special permit uses:
(a) 
Two-family dwelling, provided that the dwelling is in existence on the lot prior to the adoption of this chapter, the total floor area devoted to dwelling purposes is not less than 2,000 square feet and the lot area is not less than 10,000 square feet.
(3) 
Accessory uses:
(a) 
Farm products stand operated solely on a seasonal basis.
C. 
In R-3 Districts only.
(1) 
Principal uses:
(a) 
Two-family dwelling.
(b) 
Multifamily dwelling.
D. 
In RM Districts only.
(1) 
Principal uses:

Mobile home court.
(b)

§ 181-14 Lot, yard and coverage requirements in residential districts.

The following are minimum lot, yard and coverage requirements in residential districts:
A. 
Minimum area of lot in square feet:

R-1: 10,000.
(2) 
R-2: 6,500.
(3) 
R-3: 5,000 and at least 2,000 square feet of lot area for each dwelling unit.
B. 
Minimum lot width in feet:
(1) 
R-1: 85.

Minimum lot depth in feet:
(1) 
All districts: 100.

§ 181-16 Lot, yard and coverage requirements in nonresidential districts.

The following are lot, yard and coverage requirements in nonresidential districts:

§ 181-17 Prohibited uses.

Notwithstanding the provisions of any other section of this chapter, the following uses of buildings or land shall be prohibited in all districts:
A. 
Auto wrecking yard.
B. 
Waste material storage or processing; dump.
C. 
Use, processing or reduction of animal matter in a manner to cause odor beyond the boundaries of the lot.
D. 
Kennels, as defined in § 181-3.
E. 
Migratory labor camps, as defined in § 181-3.

§ 181-18 Minimum setback from Main Street.

Every building or structure hereafter erected on a lot adjoining or adjacent to Main Street shall be set back 50 feet from the nearest right-of-way line of Main Street or 50 feet plus 1/2 of the right-of-way width of Main Street, except in the area between Kimble Street and School Street and its projection westward.

§ 181-19 Special permit uses.

A. 
General. All special permit uses shall be deemed to be permitted uses in the district in which they are located; subject, however, to the additional standards of this section and such additional conditions and safeguards deemed necessary to eliminate, insofar as possible, any condition which would adversely affect the development of the district for the principal uses specified for it.
B. 
Procedure. All applications for the use of a lot for a special permit use shall be referred to the Board of Appeals by the Building Inspector. Such applications shall be accompanied by a detailed development plan and such other exhibits as may be needed to clearly indicate the proposed use, its location on the lot, the size and bulk of all structures, the location of vehicular ways, parking lots and all appurtenant facilities. The Board of Appeals may hold a public hearing on any such proposal if it deems such to be desirable. A special permit, where granted, may include any specific additional conditions and safeguards deemed necessary by the Board of Appeals to carry out the intent of this chapter.
C. 
Standards for all special permit uses.
(1) 
The lot area, width and depth shall be such as to minimize the adverse effect of the use on adjoining property.
(2) 
The extent, bulk and yard setbacks of buildings shall be such as to maintain the overall character of the district.
(3) 
The routing and parking of vehicles shall be such as to minimize hazard to street traffic and pedestrians.
D. 
Hospital; nursing home.
(1) 
All buildings shall be set back from all lot lines a distance equal to the maximum height of the tallest building.
(2) 
All yards adjoining any land in a residence district shall be permanently landscaped within 15 feet of the lot line.
(3) 
Off-street parking space shall be provided on the basis of one space for each two patient beds.
(4) 
In a residence district, no flashing sign or sign with exposed tubes shall be permitted.
E. 
Funeral home.
(1) 
There shall be four off-street parking spaces for each chapel or similar room.
(2) 
There shall be no more than one sign.
(3) 
There shall be no side yard less than 15 feet.
F. 
Nursery school.
(1) 
No school activities shall be conducted in a basement or above any floor having direct egress to ground level.
(2) 
There shall be 100 square feet of usable exterior play area for each child enrolled.
(3) 
No exterior play area shall be located less than 15 feet from an adjoining lot used for dwelling purposes.
G. 
Theater; drive-in theater.
(1) 
An interior theater shall have one off-street parking space for each four seats.
(2) 
A drive-in theater shall have a lot area of no less than 10 acres and lot frontage on a paved road of no less than 250 feet.
(3) 
There shall be no flashing signs and no floodlighting facing any land in a residence district closer than 200 feet.
H. 
Outdoor commercial recreation use.
(1) 
There shall be no flashing signs.
(2) 
There shall be no floodlighting facing any land in a residence district closer than 200 feet.
(3) 
There shall be no loudspeaker appurtenances used.
(4) 
No activity or lighting shall be continued beyond one hour after sunset.
I. 
Truck terminal.
(1) 
All access and egress drives, parking and exterior work areas shall be surfaced and maintained to prevent dust and to conduct drainage away from any street.
(2) 
There shall be no floodlighting facing any land in a residence district closer than 200 feet.
J. 
Junkyards. Junkyards are special permit uses in M-1 District only and are subject to the requirements and restrictions of Chapter 107, Junkyards.
