ARTICLE I

General Provisions

§ 425-1 Title.

The official title of this chapter shall be the "Nottingham Township Zoning Ordinance."

§ 425-2 Authority; purpose.

This chapter is adopted by the authority vested in the Township under Article VI of the MPC, Act 247 of 1968, as amended.[1] The provisions of this chapter are designed to:
A. 
Promote, protect and facilitate one or more of the following: the public health, safety, and general welfare; coordinated and practical community development; provisions for adequate light, solar access and air;
B. 
Prevent one or more of the following: overcrowding of land; blight; danger and congestion in travel; loss of health, life or property from fire, flood, panic or other dangers; and
C. 
Preserve prime agriculture topography, soil type and use and farm land.

§ 425-3 Community development objectives.

Community development objectives are set forth in the Nottingham Township Comprehensive Plan. In addition, the general community development objectives upon which this chapter is based are:
A. 
To plan for land uses along key transportation corridors, including the Southern Beltway;
B. 
To set forth realistic population density controls;
C. 
To provide adequate areas for business, industrial and residential uses and to maintain a separation of incompatible uses, which is necessary to protect property values and neighborhood character;
D. 
To plan for and protect agricultural uses in the Township, which are an important part of the land use patterns and community fabric of Nottingham;
E. 
To guide development in order to provide adequate and economical community facilities and utilities.

§ 425-4 Compliance.

No structure shall be located, erected, constructed, reconstructed, structurally altered, converted, or enlarged, nor shall any structure or land be used or occupied, except in full compliance with all the provisions of this chapter and after the lawful issuance of all permits and certifications required by this chapter. Any use not expressly listed as a use by right, conditional use or special exception for a district is prohibited in that district, unless authorized by conditional use as uses not listed, nonresidential or residential.

§ 425-5 Interpretation.

In their interpretation and application, the provisions of this chapter shall be considered minimum requirements adopted for the promotion of the health, safety, morals and general welfare of the public. In the event of conflicts between the provisions of this chapter and any other ordinance or regulation, the more restrictive provision shall apply.

§ 425-6 Severability.

If any provision of this chapter, or the application of any provision to particular circumstances, is held invalid, the remainder of this chapter, or the application of such provision to other circumstances, shall not be affected.
