ARTICLE VI

District Regulations

§ 425-22 General district regulations.

These general regulations apply in all zoning districts:
A. 
Any use not expressly listed for a district is prohibited in that district, unless authorized by conditional use as uses not listed.
B. 
Accessory structures which are normally accessory to principal structures or uses authorized by conditional use shall be permitted by right.
C. 
Applications for permitted uses, special exceptions and conditional uses shall be reviewed in accordance with the procedures specified in this chapter.
D. 
Only one principal use, as identified in the Code of Ordinances, is permitted on a lot or parcel of land.

§ 425-23 Lot, yard and height requirements.

A. 
Corner lots. Corner lots shall provide front yards on each street frontage. The remaining two yards shall constitute a side yard and a rear yard. The rear yard shall be the yard which is opposite to the front yard on which the principal structure faces.
B. 
Permitted projections into required yards. The following shall be permitted to project into any required yard in any zoning district as follows:
(1) 
Typical architectural features, including, but not limited to, bay windows, window sills, cornices and eaves, shall be permitted to project into required yards no more than 18 inches.
(2) 
Steps and open fire escapes shall be permitted to project into required yards no more than 36 inches.
C. 
Height exceptions. The height limitations of this chapter shall not apply to the following structures: church spires, chimneys, elevator bulk heads, conveyors, flagpoles, silos, standpipes, elevated water tanks, derricks, public utility structures and other structures not intended for human habitation. Satellite dish antennas shall be subject to the accessory use regulations of this chapter.

§ 425-24 Additional general regulations.

A. 
Lots which abut on more than one street shall provide a required front yard depth along each street.
B. 
Nothing in this chapter shall preclude the construction, operation and maintenance of public utility distribution and transmission or collection systems. Such systems may include poles, wires, underground pipes, transformers, conduit, and appurtenances for the transmission and/or distribution of the commodity or service pertaining to the public utility. Structures permitted for these systems shall be necessary to the natural distribution and transmission or collection and shall be in harmony, as much as possible, with the uses permitted in the zone where said building or structure is located.
C. 
Restricted building sites. Nothing may be built within or above an easement. Nothing may be built on a site known to be landslide-prone or which has a slope over 25% unless the foundation plans have been approved by a registered geotechnical or structural engineer and submitted with the request for a building permit. Issuance of a building permit is not a warranty against structural damage resulting from subsidence due to improper engineering, fill or previous site activities.
D. 
Clear sight triangle. On a corner lot, no structure, fence, wall, hedge or other planting shall be erected, placed, planted or allowed to grow in such a way as to impede vision of pedestrian and vehicular traffic within clear sight triangles on all corners between a height of 2 1/2 feet and seven feet above the center-line grades of intersecting streets. This shall apply to the clear sight triangle area formed by the intersecting center lines of the street measured along each center line forming two sides of the triangle. The third side closes the triangle as it traverses the corner lot. There is no parking permitted within the clear sight triangle.
E. 
Basement structures. Earth homes which are designed to take advantage of the insulating qualities of earthen fill along walls and over the roof of a dwelling shall not be considered basement structures. No residential uses or occupancy shall be permitted in basements prior to the completion of the total structure.

§ 425-25 Nonresidential uses abutting residential zoning districts.

A. 
When a commercial use abuts a residentially zoned property not separated by an alley or a road, special consideration shall be given to lighting, screening and noise levels so as not to interfere with or restrict the lawful use and enjoyment by others of their property. Additional buffer may be recommended in each particular conditional use or special exception depending on proposed use and as determined by the appropriate reviewing body.
B. 
The required rear yard on a site proposed for a commercial or institutional structure, when adjacent to residential properties and are not separated by a dedicated street or alley, may be reduced by 20% by providing a transitional buffer area (minimum 20 feet), which provides screening by landscaping, walls or mounding. In a commercial zone, all buildings proposed to be located within 40 feet of a residential property shall be limited to two stories in height.

§ 425-26 Area and bulk regulations.

All uses in all zoning districts, as indicated, shall be subject to the following regulations, except as they may be modified by the standards and criteria for specific conditional uses in this chapter.[1]

§ 425-27 Additional R-3 Multifamily Residential District area and bulk regulations.

Area and bulk regulations. In the R-3 Multifamily Residential District, all uses shall be subject to the following additional regulations, except as they may be modified by the standards and criteria for specific conditional uses:
A. 
For a multifamily dwelling adjoining a single-family use or A-1 or R-2 Zoning District, the minimum side yard is 50 feet per side.
B. 
Minimum distance between buildings. In multifamily developments where more than one building is authorized on a lot, the following minimum distances between buildings shall be provided:
(1) 
Front to front, rear to rear, or front to rear when structures are parallel: 50 feet shall be provided between the faces of structures for one story in height plus five feet for each additional story.
(2) 
When front or rear faces are obliquely aligned, the above-required distances may be reduced by as much as 10 feet at one end if increased by similar or greater distance at the other end.
(3) 
Structures end to end: 25 feet shall be provided for one story plus five feet for each additional story.
(4) 
When adjacent structures differ in the number of stories, the required distance between the buildings shall be as required for the higher structure.

§ 425-28 Additional Route 136 Mixed Use Corridor Overlay District area and bulk regulations.

Area and bulk regulations. In the Route 136 Mixed Use Corridor Overlay District, all uses not permitted in the based zoning district and permitted in the overlay district shall be subject to the following additional regulations, except as they may be modified by the standards and criteria for specific conditional uses:
A. 
Location. Only properties immediately abutting the Route 136 road right-of-way.
B. 
Minimum lot frontage (along Route 136 road right-of-way): 150 feet.
C. 
Minimum lot depth: 500 feet measured from the Route 136 road right-of-way at all points along the lot frontage.
D. 
Access. Vehicular access must be from Route 136 only.
E. 
Residential buffering. The Board of Supervisors may require additional buffering where proposed Route 136 Overlay land uses abut existing or proposed residential land uses.
