District Regulations

§ 375-5 Zoning Map.

A map entitled "Zoning District Map, Borough of Oakdale" is hereby adopted as part of this chapter. The Zoning Map shall be kept on file, available for examination at the office of the Borough Secretary.

§ 375-6 Zoning districts.

The Borough is divided into the districts stated in this chapter as shown by the district boundaries on the Zoning Map. The districts are:
R-1 Single-Family Residential
R-2 Multiple-Family Residential
B-1 Business
B-2 Neighborhood Commercial
I-1 Industrial

§ 375-7 District boundaries.

District boundaries shown within the lines of streets, streams, and transportation rights-of-way shall be deemed to follow the center lines. The vacation of streets shall not affect the location of such district boundaries. When the Zoning Officer cannot definitely determine the location of a district boundary by such center lines by the scale or dimensions stated on the Zoning Map or by the fact that it clearly coincides with a property line, he shall refuse action, and the Zoning Hearing Board, upon appeal, shall interpret the location of the district boundary with reference to the scale of the Zoning Map and the purpose set forth in all relevant provisions of this chapter.

§ 375-8 Residential districts.

Districts designated for residential use, R-1 and R-2, are limited to dwellings and public or semi-public uses which are normally associated with residential neighborhoods. The only uses permitted in the residential districts are those which would not detract from the residential character of the neighborhood. The purpose of these two districts is to create an attractive, stable, and orderly residential environment. However, the families per dwelling and the lot and yard requirements are different in the two districts to provide for the various housing needs and desires of the citizens.

§ 375-9 Business districts.

The districts designated for business, B-1 and B-2, are limited to businesses, public and certain residential uses. By establishing compact districts for such uses, more efficient traffic movement, parking facilities, fire protection and police protection may be provided. Industrial uses are excluded in order to reduce the hazards caused by extensive truck and rail movements normally associated with such uses. The purpose of the B-1 Business district is to provide unified shopping centers conveniently located. The purpose of the B-2 Neighborhood Commercial district is to is to provide sufficient space for community-level commercial, retail, and service establishments and to promote stable commercial development for neighborhood business and service uses.

§ 375-10 Industrial district.

The district designated for industry, I-1, provides suitable space for existing industries and their expansion as well as for future industrial development. Performance standards, parking specifications, and yard regulations are set forth in this chapter in order to ensure safe industrial development that is compatible with adjacent uses. The locations of the districts are near railroads or highways in order to meet the transportation needs of industry.

§ 375-11 Permitted uses.

The permitted uses, conditional uses, and special exceptions for each district are shown on the following table. Uses given in the following categories shall be according to the common meaning of the term or according to definitions given in Article VII. Uses not specifically listed or defined to be included in the categories under this section shall not be permitted.

§ 375-12 Lot and yard requirements.

A. 
The minimum lot area, minimum width of lot, minimum depth of front yard, and the minimum width of each side yard for each district shall be as shown on the following table:

B. 
Lots which abut on more than one street shall provide the required front yards along every street.
C. 
All structures, whether attached to the principal structure or not, and whether open or enclosed, including porches, carports, balconies, or platforms above normal grade level, shall not project into any minimum front, side or rear yard.
D. 
Any lot of record existing at the effective date of this chapter and then held in separate ownership different from the ownership of adjoining lots may be used for the erection of a structure conforming to the use regulations of the district in which it is located, even though its area and width are less than the minimum requirements of this chapter.
E. 
Nonresidential structures or uses shall not be located or conducted closer to any lot line of any other lot in any "R" District than the distance specified in the following schedule:

F. 
The front yard setbacks for residential structures in R-1 and R-2 Zoning Districts must conform with the existing structure building lines adjacent or neighboring to the structure being constructed.

(1) 
The front yard setback for the principal building structure must be equidistant from the setback from the street with neighboring structures.
(2) 
Additionally, any porches, carports, balconies, platforms or other additions to the building footprint of the principal structure must adhere to a front yard setback of neighboring structures such that the setback is equidistant from the street in conformity with the setback for said neighboring structures.
(3) 
In the event that a structure being constructed in an R-1 or R-2 Zoning District has no nearby adjacent neighbors or is not a residential dwelling, the required front setback distances are 30 feet in depth for the R-1 Zoning District and 25 feet for the R-2 Zoning District.

§ 375-12.1 Yard and bulk requirements for two-family, townhouse, and multifamily dwellings.

A. 
Notwithstanding the requirements of § 375-12 (Lot and yard requirements), all dwelling units, except for single-family, permitted in the R-2 District shall be subject to the yard and bulk requirements of this subsection, if the uses are connected to a public sewer system and a public water system. Where no requirement is listed in this subsection, the requirement of the underlying zoning district shall govern:
(1) 
Minimum lot area (dwelling attached by at least two sides): 2,000 square feet.
(2) 
Minimum lot area (dwellings attached by one side only): 3,000 square feet.
(3) 
Minimum lot frontage at the street right-of-way line: 20 feet.
(4) 
Minimum lot frontage at the front building setback line: 20 feet.
(5) 
Minimum side yard (at attached dwelling party wall): zero feet; accessory structure: five feet.
(6) 
Minimum side yard (end dwelling units): 10 feet; accessory structure: five feet.
(7) 
Minimum distance between principal buildings: 20 feet.
(8) 
Minimum lot width: 20 feet.

§ 375-13 Height regulations.

No structure shall exceed 45 feet in height above average ground level unless approved by the Zoning Hearing Board. The Zoning Hearing Board may authorize a variance to this height regulation in any district if:
A. 
All front, side, and rear yard depths are increased one foot for each additional foot of height.
B. 
The structure is any of the following and does not constitute a hazard to an established airport:
(1) 
Television and radio towers.
(2) 
Church spires.
(3) 
Belfries.
(4) 
Monuments.
(5) 
Tanks.
(6) 
Water and fire towers.
(7) 
Stage towers and scenery lofts.
(8) 
Cooling towers.
(9) 
Ornamental towers and spires.
(10) 
Chimneys.
(11) 
Elevator bulkheads.
(12) 
Smokestacks.
(13) 
Conveyors.
(14) 
Flagpoles.
